Stormwater Sewerage Service Regulation of the Municipality of AlajuelaReglamento del Servicio de Alcantarillado Pluvial de la Municipalidad de Alajuela

a). Alcalde: the Alcalde of the Municipality of Alajuela.

b). Council: the Municipal Council of the Municipality of Alajuela.

• c)Construction: that technical and construction activity carried out by the Municipality through the Storm Drainage Activity which involves the execution of new works for the purpose of d) Taxpayer (Contribuyente): a natural or legal person obligated to pay the rate related to the storm drainage service.
• f)Curb and gutter (Cordón y caño): the civil work built at the edge of the sidewalk, whose purpose is to channel rainwater toward the catch basins.
• g)Cost (Costo): the financial cost incurred by the Municipality for the maintenance, repair, and construction of works related to the storm drainage system, which includes expenses for personal and non-personal services, materials and supplies, depreciation of machinery, equipment, and facilities, administrative expenses, and profit for the development of the system.
• h)Outfall (Desfogue): the civil work built and used to protect the outlet of the storm drainage system into rivers, streams, or ditches.
• i)Stormwater runoff or surface runoff (Escorrentía o escurrimiento pluvial): waters that flow freely on the earth's surface as a result of rainfall.
• j)Maintenance and repair of the storm drainage network: that technical and construction activity carried out by the Municipality through the Storm Drainage Activity for the upkeep of the system, with the purpose of ensuring its proper functioning.
• k)Municipality: the Municipality of the Central Canton of Alajuela.
• l)Manhole (Pozo de registro): the civil work whose purpose is to provide the storm drainage pipe with changes in direction, slope, or size, as well as ensure access to the storm drainage network for its maintenance, repair, and inspection.
• m)System: the set or network of pipes, manholes, catch basins, outfalls, or other works necessary for the correct collection, evacuation, and drainage of stormwater runoff owned by the Municipality and intended for the provision of the public service regulated in this regulation.
• n)Rate (Tarifa): the fee that the owners of real estate registered in the Central Canton of Alajuela must pay to the Municipality in order to cover the costs demanded by the public storm drainage service.
• ñ)Catch basin (Tragante): the Civil Work built to receive stormwater runoff.
• o)Storm drainage pipe (Tubería pluvial): a conduit exclusively intended for the evacuation of water produced by surface runoff.
• p)User (Usuario): Owner or possessor, by any title, of a real estate property in the Canton of Alajuela, who by that condition is obligated to pay the rate charged by the Municipality for the maintenance, repair, and construction of the storm drainage system.
• q)Trench or open channel (Zanja o canal a cielo abierto): a trench excavated in the surface, in earth or lined with concrete or any other material, intended for the evacuation of stormwater runoff.

On the Municipal Storm Drainage Service

1. The construction, maintenance, and repair of works related to the storm drainage system.

2. The cleaning of catch basins, pipes, and manholes.

3. The collection and treatment of waste resulting from cleaning activities performed on the various components of the storm drainage system.

4. The cleaning and dredging of rivers, streams, and ditches.

5. Inspection and technical assessment of the storm drainage systems.

6. The establishment and collection of rates and fines established in this regulation.

7. Any work or action directly or indirectly related to the control and management of stormwater.

On the Charge for the Storm Drainage Service

Said rate must be paid by each taxpayer, proportionally to the linear measure of the frontage of each of their properties.

They shall take effect thirty days after their publication in the Official Gazette La Gaceta.

On the Users

• a)Request authorization from the municipality to connect to the storm drainage systems or to channel, by piping, the flow of unmanaged ditches classified as storm drainage collectors, which must be supported by corresponding feasibility studies.
• b)Build on their buildings the elements appropriate for the collection and disposal of stormwater from the roofs up to the curb and gutter, roadside ditch, or storm drainage system, in accordance with the provisions of Article IV.17 of the Construction Regulation (Reglamento de Construcciones).
• c)Guarantee that vehicular access ramps to properties, built from the curb and gutter, do not constitute a bottleneck caused by the use of pipes with inadequate diameters for that purpose; also complying with the provisions of Article IV.4.2 of the Construction Regulation (Reglamento de Construcciones) and Law 7600 regarding the construction of sidewalks and ramps.
• d)Provide maintenance to the grates used to give access to properties from the public road, removing solid waste and sediments that accumulate, to prevent obstruction of the storm drainage system.
• e)Monitor the use of, and report the theft of, grates, covers, and, in general, any damage caused to any of the elements that make up the storm drainage system.
• f)Provide maintenance to the trenches, open channels, or unmanaged ditches considered as storm drainage collectors that cross their properties, in order to eliminate vegetation, sediments, or waste that reduce their channel and may cause overflowing.
• g)Allow the passage, through their properties, of stormwater coming from higher properties according to the natural slope of the land, when it is not possible to channel said waters through infrastructure works to a public collector.

• a)Discharging domestic or industrial, wastewater or black water into the storm drainage network.
• b)Depositing any type of solid waste in any of the elements that make up the storm drainage system.
• c)Carrying out any type of construction on the storm drainage system, which could cause it damage, or hinder the tasks of maintenance, repair, or inspection.
• d)Causing, by any means, blockages or overflows of the storm drainage system.
• e)Building drainages over open channels, or access ways to properties over such channels, without prior authorization from the Municipality.
• f)Allowing the growth of weeds or vegetation at the edge of the curb and gutter or any other element of the storm drainage system that faces their property, which makes the adequate flow of water impossible and which deteriorates the works, all in accordance with Article 20 of the General Law of Public Roads (Ley General de Caminos Públicos).
• g)Placing construction materials, debris, or similar objects on the curb and gutter, in such a way that they obstruct the adequate passage of stormwater runoff.

In the event that a breach is determined, that department must issue a notification to the owner or possessor by any title of the property; indicating the work that must be carried out and the period granted to execute them.

When the magnitude of the work to be performed, or the procedures to be complied with by the administered party before external entities so justifies it, that period may be extended for an equal period at the request of the interested party and at the discretion of the Storm Drainage Activity, which must grant the extension in writing.

In such a case, the Municipality shall be authorized to carry out the ordered maintenance work, charging the user the respective cost plus fifty percent as a penalty.

Final Provisions

a). Alcalde: el Alcalde o la Alcaldesa de la Municipalidad de Alajuela.

b). Concejo: el Concejo Municipal de la Municipalidad de Alajuela.

• c)Construcción: aquella actividad técnica y constructiva que realiza la Municipalidad por medio de la Actividad de Alcantarillado pluvial que implica la realización de obras nuevas con el fin de ampliar el sistema a zonas del cantón no servidas.
• d)Contribuyente: persona física o jurídica obligada a cancelar la tarifa relativa al servicio de alcantarillado pluvial.
• f)Cordón y caño: la obra civil construida al borde de la acera, cuya finalidad es la conducción de las aguas de lluvia hacia los tragantes.
• g)Costo: costo financiero en que incurre la Municipalidad por el mantenimiento, reparación y construcción de obras relacionadas con el sistema de alcantarillado pluvial que incluye los gastos por servicios personales y no personales, materiales y suministros, depreciación de maquinaria, equipo e instalaciones, gastos administrativos y utilidad para el desarrollo del sistema.
• h)Desfogue: la obra civil construida y utilizada para dar protección a la salida del sistema de alcantarillado pluvial hacia ríos, quebradas o acequias.
• i)Escorrentía o escurrimiento pluvial: las aguas que fluyen libremente en la superficie terrestre producto de las lluvias.
• j)Mantenimiento y reparación de la red pluvial: aquella actividad técnica y constructiva que realiza la Municipalidad por medio de la Actividad de Alcantarillado pluvial para la atención del sistema, con el fin de procurar su buen funcionamiento.
• k)Municipalidad: la Municipalidad del Cantón Central de Alajuela.
• l)Pozo de registro: la obra civil cuya finalidad en dotar a la tubería pluvial de cambios de dirección, pendiente o tamaño, así como asegurar el acceso a la red pluvial para su mantenimiento, reparación e inspección.
• m)Sistema: Conjunto o red de tuberías, pozos de registro, tragantes, desfogues u otras obras necesarias para la correcta recolección, evacuación y drenaje de la escorrentía pluvial propiedad de la Municipalidad y destinadas a la prestación del servicio público que se regula en este reglamento.
• n)Tarifa: tasa que deberán cancelar a la Municipalidad, los propietarios de bienes inmuebles inscritos en el Cantón Central de Alajuela con el fin de sufragar los costos que demanda el servicio público de alcantarillado pluvial.
• ñ)Tragante: La obra Civil construida para el recibimiento de la escorrentía pluvial.
• o)Tubería pluvial: conducto destinado exclusivamente a la evacuación del agua producida por el escurrimiento pluvial.
• p)Usuario: Propietario o poseedor a cualquier título, de un inmueble en el Cantón de Alajuela, quien por tal condición está obligado al pago de la tarifa que cobra la Municipalidad para el mantenimiento, reparación y construcción del sistema pluvial.
• q)Zanja o canal a cielo abierto: trinchera excavada en la superficie, en tierra o revestida de concreto o cualquier otro material, destinada a la evacuación de la escorrentía pluvial.

Del servicio municipal de alcantarillado pluvial

1. La construcción, mantenimiento y reparación de obras relacionadas con el sistema de alcantarillado pluvial.

2. La limpieza de tragantes, tuberías y pozos de registro.

3. La recolección y tratamiento de los desechos producto de las limpiezas realizadas a los diversos componentes del sistema pluvial.

4. La limpieza y dragado de ríos, quebradas y acequias.

5. Inspección y valoración técnica de los sistemas de alcantarillado pluvial.

6. El establecimiento y cobro de tarifas y multas establecidas en este reglamento.

7. Toda obra o acción relacionada de manera directa o indirecta con el control y manejo de las aguas pluviales.

Del cobro por el servicio de alcantarillado pluvial

Dicha tarifa deberá cancelarla cada contribuyente, en forma proporcional a la medida lineal de frente de cada una de sus propiedades.

Entrarán a regir treinta días después de su publicación en el Diario Oficial La Gaceta.

De los usuarios

• a)Solicitar autorización al municipio para conectarse a los sistemas pluviales o para canalizar mediante entubado el flujo de acequias no administradas calificadas como colectores pluviales y que deberá estar sustentada en los correspondientes estudios de factibilidad.
• b)Construir en sus edificaciones los elementos apropiados para la recolección y disposición de las aguas pluviales desde los techos hasta el cordón de caño, cuneta o sistema de alcantarillado pluvial, de acuerdo con lo establecido en el artículo IV. 17 del Reglamento de Construcciones.
• c)Garantizar que las rampas de acceso vehicular a predios, construidas desde el cordón de caño, no constituyan un cuello de botella producido por el uso de tubería con diámetros inadecuados para tal fin; cumpliendo además con los establecido en el artículo IV.4.2 del Reglamento de construcciones y la ley 7600 referente a la construcción de aceras y rampas.
• d)Dar mantenimiento a las parrillas empleadas para dar acceso a predios desde la vía pública, eliminando los desechos sólidos y sedimentos que se acumulen, para evitar la obstaculización del sistema pluvial.
• e)Vigilar el uso y reportar el hurto e parrillas, tapas y en general, cualquier daño producido a cualquiera de los elementos que conforman el sistema de alcantarillado pluvial.
• f)Dar mantenimiento a las zanjas, canales a cielo abierto o acequias no administradas consideradas como colectores pluviales que atreviesen sus propiedades, a fin de eliminar la vegetación, los sedimentos o los desechos que disminuyan su cauce y puedan ser causantes de desbordamiento.
• g)Permitir el discurso a través de sus predios, de las aguas pluviales provenientes de predios superiores según la pendiente natural del terreno, cuando no sea posible canalizar dichas aguas mediante obras de infraestructura, a un colector público.

• a)Realizar descargas de aguas domésticas o industriales, residuales o negras a la red pluvial.
• b)Depositar cualquier tipo de desecho sólido en cualquiera de los elementos que conforman el sistema pluvial.
• c)Realizar cualquier tipo de construcción sobre el sistema pluvial, que le pueda ocasionar daño, o que dificulten las labores de mantenimiento, reparación, inspección.
• d)Provocar por cualquier medio, taponamientos o desbordamientos del sistema pluvial.
• e)Construir alcantarillados sobre cauces a cielo abierto, o pasos de acceso a predios sobre tales cauces, sin la previa autorización de la Municipalidad.
• f)Permitir el crecimiento de maleza o vegetación a orillas del cordón de caño o cualquier otro elemento del sistema pluvial que enfrente su propiedad, que imposibilite el flujo adecuado de las aguas y que deteriore las obras, todo conforme al artículo 20 de la Ley General de Caminos Públicos.
• g)Colocar materiales de construcción, escombros u objetos similares, sobre el condón de caño, de tal manera que obstaculicen el paso adecuado de la escorrentía pluvial.

En caso de que se determine algún incumplimiento, esa dependencia deberá cursar una notificación al propietario o poseedor por cualquier título del inmueble; en la que se indiquen los trabajos u obras que deberá realizar y el plazo con que cuenta para ejecutarlas.

Cuando la magnitud de los trabajos a realizar, o los trámites que deba cumplir el administrado ante instancias externas así lo justifiquen, ese plazo podrá prorrogarse hasta por otro período igual a solicitud del interesado y a juicio de la Actividad de Alcantarillado pluvial, quine deberá otorgar la prórroga por escrito.

En tal caso, la Municipalidad quedará facultada para realizar los trabajos u obras de mantenimiento prevenidos, trasladándole al usuario el costo respectivo más un cincuenta por ciento por concepto de penalización.
