Amendment to the Procedures Manual for the Payment of Environmental ServicesReforma al Manual de Procedimientos para el Pago de Servicios Ambientales

1. Objective: To establish the procedures to be applied in the Payment of Environmental Services (Pago de Servicios Ambientales, PSA) generated by the country’s forests and forest plantations, through the promotion of the activities of reforestation, protection of forest cover (cobertura boscosa), forest management, recovery of cover through natural regeneration, and planting of forest trees in agroforestry systems (sistemas agroforestales, SAF), paid with resources from the National Budget and any other donor or investor that does not establish conditions different from those established in this Manual.

2. Criteria for the prioritization of projects. The priority areas for Payment of Environmental Services (PSA), shall be those established through the Executive Decree to be issued by the Executive Branch, in the modalities of protection, reforestation, recovery of cover through natural regeneration, forest management, and planting of forest trees in SAF, which shall be applied for the selection of projects to be considered in the PSA program. Only, in those cases when the national demand for priority areas has been satisfied, will projects be accepted in other areas that FONAFIFO will opportunely make known.

For properties that are on the boundary of the priority areas, those that have at least 30% within said areas shall be considered for the purposes of the PSA Program.

2.4.2 Lands with land-use capacity (capacidad de uso)2, I, II, III, IV, V, and VI.

2.6. Forest Management Projects.

2.6.1 Properties that have management plans approved by the State Forestry Administration, in which harvesting was carried out according to the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices, and Procedures Manual, in accordance with Executive Decree No. 34559-MINAE, published in La Gaceta No. 115 of Monday, June 16, 2008, the State Forestry Administration (AFE) shall certify compliance with what is established in the management plan.

3. On the areas and minimum and maximum quantities. The minimum and maximum annual areas to be considered for PSA through the different modalities, shall be those detailed below:

3.7 For the modality of planting forest trees in SAF, the minimum quantity shall be three hundred fifty (350) trees and the maximum quantity five thousand (5,000) trees per beneficiary.

3.9.5. Block plantations of less than one hectare, with equivalent densities between 625 and 1,111 trees per hectare. A maximum of five blocks of one hectare per beneficiary is considered.

3.11 For Forest Management projects, the minimum area is two hectares and the maximum area is three hundred hectares.

4. On beneficiaries. As beneficiaries of the PSA Program shall be considered all those natural or legal persons, owners, lessees (arrendatarios), usufructuaries (usufructuarios) of properties registered in the National Registry who wish to enjoy the Payment of the Environmental Services in the various modalities. For forest protection projects, possessors (poseedores) who comply with the provisions of Article 9 of Law No. 8640, Ecomercados II Project, and the regulations to the Forestry Law shall also be considered. Interested applicants may submit pre-applications in the following manner:

4.1. Individually: For forest protection, forest protection in conservation gaps and water resource protection, recovery of cover through natural regeneration, reforestation, forest management, and establishment of forest trees in SAF.

4.2. In projects managed by organizations for forest protection, water resource protection, reforestation, recovery of cover through natural regeneration, forest management, and the establishment of forest trees in SAF.

Pre-applications that correspond to the quotas assigned by FONAFIFO to organizations, must expressly indicate whether or not they correspond to said quotas.

4.4. All individual PSA beneficiaries, must present to FONAFIFO a certification of their client account in colones issued by a banking, financial, mutual, and/or savings and credit cooperative entity, for each pre-application submitted, to receive the payments of the PSA Program.

7.1. Within the requirements to enter the PSA, the applicant or their representative must submit in writing and to the corresponding FONAFIFO Regional Office, the pre-application signed by the applicant (Annexes 1 and 2). Attaching a copy for a received stamp, on which the Regional Office personnel shall indicate the assigned pre-application number. Pre-applications that present incomplete information or that do not attach the requirements established in this Manual shall not be received. A maximum of five pre-applications per person per submission turn shall be admitted.

7.1.9 In pre-applications for the forest management modality, once the legal requirements established in subsections 7.1.1 through 7.1.5 have been met, applicants must provide, along with the technical study, a certification issued by the competent officials of SINAC, indicating compliance with what is established in the Management Plan according to the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decree No. 34559-MINAE, published in La Gaceta No. 115 of June 16, 2008.

7.1.10 Technical study according to Annex 16.

10.1. In the case of forest protection, forest protection in conservation gaps, water resource protection, and forest management, once the contract is signed by all parties, the encumbrance (afectación) of the property is registered before the Property Registry, or the contract is notarized (protocolizado) in the case of farms under possession (fincas en posesión), FONAFIFO shall process the respective Payment Order. The payment of contracts on a year-in-arrears basis (año vencido) shall be processed twelve months after their effective date. (see points 8.4 and 8.9).

10.2. For subsequent payments, the Forestry Regent (Regente Forestal) shall deliver to the respective FONAFIFO Regional Office a certified annual report at 12, 24, 36, and 48 months from the contract effective date, or at 24, 36, 48, and 60 months in the case of contracts signed on farms on a year-in-arrears basis according to the guide in Annex 6 and Annex 17, the responsible official of the FONAFIFO Regional Office shall evaluate the certified report and proceed to assign a consecutive number, to continue with the processing. FONAFIFO shall process the respective Payment Order.

10.12. The first payment of environmental services for the forest management modality shall be 20% of the amount established in the respective Executive Decree and shall be made once the respective contract is formalized.

the technical study for forest management projects The undersigned ____________, Professional License No. ______, In my capacity as Forestry Regent, with fidelity bond No. ______, protected by the Forestry Law, its regulations, its amendments, forestry regency regulations, and current legislation. I certify the content of the following Technical Study:

1. Name of beneficiaries, ID numbers, Folio(s) Real(es), plan number(s), total folio area(s), current use, administrative location, the exact address of the farm(s), and the adjacent landowners found in the field.

2. Regency form number, date of visit.

3. Indicate if the area is located in a protected wilderness area, stating its name.

4. Indicate the modality and the Pre-application number previously assigned by the respective Regional Office.

5. The property plan must be georeferenced with at least three points located by GPS with the WGS 84 datum and in decimal degrees format (GG.dddd). At least two of these points must be vertices of the plan. All GPS points must be at a distance of no less than 50 meters from each other. (the locations of the points must be indicated on the sketch, and they must be provided digitally using a point shape file, in the same coordinate system as the sketch, indicating the reference of each point). The information on the GPS points must be included.

6. Likewise, each Technical Study must contain the sketch of the area to be submitted to PSA with respect to the total area of the property, indicating the boundary survey (derrotero) and the corresponding vertex numbering. The system used and its accuracy must be indicated; also, the starting point (point 1) of the area to be submitted must be tied to a point with known coordinates. The sketch of the effective PSA area, as well as the sketch of the entirety of the plan, must be submitted printed and in digital form.

The digital form must comply with:

- The file must be in Arcview Shape File format (polygon), other formats will not be admitted.

- The Shape file must be named with the application number assigned by the Regional Office (e.g., SJ01000108).

- A single Shape file must be presented that includes in the attribute table the quantification of the area, use (PSA area, rest of the farm), and the surveyed plan number when applicable.

- In case of existing current contracts, include their location.

- The file must be presented georeferenced in the CRTM05 coordinate system (made official through Decree No. 33797-MJ-MOPT published in La Gaceta No. 108 of Wednesday, June 6, 2007) or in a geographic coordinate system, WGS84 datum, and in decimal degrees format (GG.dddd).

- It must be submitted on a compact disc (cd).

7. The scales to be used for areas smaller than thirty hectares must be 1:5,000 to 1:10,000. For larger areas, they may be used at professional convenience.

8. Furthermore, the Study must be prepared based on the legal area of the land, that is, the 'agricultural surface' (superficie agraria), this being defined as the area of a portion of land determined by the horizontal projection of its perimeter.

9. Express statement of the existence of other current PSA contracts, indicating the area, location, and certifying the capacity (cabida) of the contracts.

10. On properties with leases (arrendamientos), it must be certified that the PSA areas are excluded from the leased areas, this in case it is the property owner who requests entry to the PSA. Otherwise, certify that the leases effectively correspond to PSA areas requested by the lessees.

11. Only Certified Technical Studies shall be admitted that refer to plans whose displacements in the cartographic location do not exceed 500 meters, with respect to what is indicated on the plan and the real location of the farm. In cases where it exceeds 500 meters, a certification issued by a licensed surveyor must be attached, indicating the correct location of the plan.

12. In all cases, Certified Technical Studies must be prepared on security paper, contain the name, professional license number, and signature of the responsible professional, the date of preparation, and with the respective stamps.

Note: Installation of preventive signs. The sign must contain the following information: name of the beneficiary, modality, PSA area submitted, and forestry contract number.

For processing payments at 12, 24, 36, and 48 months from the signing of the contract, the Forestry Regent must submit the certification considering the following aspects:

The undersigned ____________, Professional License No. ______, In my capacity as Forestry Regent, with fidelity bond No. ______, protected by the Forestry Law, its regulations, its amendments, and current legislation. I certify the state of the forest according to the following criteria.

1. Indicate the name of the owner, Folio Real, and effective PSA area.

2. Add the PSA contract number and the respective installment number.

3. Regency form number, date of visit.

4. Indicate the actions taken to prevent hunting, felling, and forest fires, signage, and report any anomaly detected.

5. For subsequent payments, the Forestry Regent must certify the state of the forest, as well as compliance with what is established in the management plan approved by SINAC, and any other aspect related to the permanence of the forest.

6. In all cases, Certifications must be prepared on security paper, contain the name, professional license number, and signature of the responsible professional, the date of preparation, and with the respective stamps.

In all other aspects not covered in this amendment, the Procedures Manual for the Payment of Environmental Services, published in No. 46 of Friday, March 6, 2009, remains in force.

1. Objetivo: Establecer los procedimientos que se aplicaran en el Pago de los Servicios Ambientales (PSA) generados por los bosques y las plantaciones forestales del país, mediante el fomento de las actividades de reforestación, protección de la cobertura boscosa, manejo de bosque, recuperación de cobertura mediante regeneración natural y plantación de árboles forestales en sistema agroforestales (SAF), pagados con recursos provenientes del Presupuesto Nacional y de cualquier otro donante o inversionista que no establezca condiciones diferentes, a las establecidas en este Manual.

2. Criterios de priorización de proyectos. Las áreas prioritarias para el Pago de Servicios Ambientales (PSA), serán las establecidas mediante el Decreto Ejecutivo que emitirá el Poder Ejecutivo, en las modalidades de protección, reforestación, recuperación de cobertura mediante regeneración natural, manejo de bosque y plantación de árboles forestales en SAF, los cuales serán aplicados para la selección de los proyectos que se considerarán en el programa de PSA. Solamente, en aquellos casos cuando la demanda nacional de las áreas prioritarias ha sido satisfecha, se aceptarán proyectos en otras áreas que oportunamente el FONAFIFO dará a conocer.

Para inmuebles que se encuentren sobre el límite de las áreas prioritarias se considerarán para efectos del Programa de PSA aquellas que al menos tengan un 30% dentro de dichas áreas.

2.4.2 Tierras con capacidad de uso2, I, II, III, IV, V y VI.

2.6. Proyectos de Manejo de Bosque.

2.6.1 Inmuebles que tienen planes de manejo aprobados por la Administración Forestal del Estado, en los cuales se realizó la cosecha de acuerdo a los Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de Prácticas y Manual de Procedimientos, de acuerdo al Decreto Ejecutivo Nº 34559-MINAE, publicado en La Gaceta Nº 115 del día lunes 16 de junio del 2008, la Administración Forestal de Estado (AFE) certificará el cumplimiento de lo establecido en el plan de manejo.

3. De las áreas y cantidades mínimas y máximas. Las áreas mínimas y máximas anuales a considerar para el PSA a través de las diferentes modalidades, serán las que se detallan a continuación:

3.7 Para la modalidad de plantación de árboles forestales en SAF, la cantidad mínima será de trescientos cincuenta (350) árboles y máxima de cinco mil árboles (5.000) por beneficiario(a).

3.9.5. Plantaciones en bloque de menos de una hectárea, con densidades equivalentes entre 625 y 1.111 árboles por hectárea. Se considera como máximo cinco bloques de una hectárea por beneficiario(a).

3.11 Para proyectos de Manejo de Bosque el área mínima es de dos hectáreas y un área máxima de trescientas hectáreas.

4. De los beneficiarios (as). Se considerarán beneficiarios (as) del Programa PSA, todas aquellas personas físicas o jurídicas, propietarios (as), arrendatarios, usufructuarios de inmuebles inscritos en el Registro Nacional que deseen gozar del Pago de los Servicios Ambientales en las diversas modalidades. Para proyectos de protección de bosque también se considerará a los poseedores (as) que cumplan con lo establecido en el artículo 9º de la Ley Nº 8640, Proyecto Ecomercados II y el reglamento a la Ley Forestal. Los (las) solicitantes interesados podrán presentar presolicitudes de la siguiente manera:

4.1. En forma individual: Para la protección de bosque, protección de bosque en vacíos de conservación y protección de recurso hídrico, recuperación de cobertura mediante regeneración natural, reforestación, manejo de bosque y establecimiento de árboles forestales en SAF.

4.2. En proyectos regentados por organizaciones para la protección de bosques, protección de recurso hídrico, reforestación, recuperación de cobertura mediante regeneración natural, manejo de bosque y el establecimiento de árboles forestales en SAF.

Las presolicitudes que correspondan a las cuotas asignadas por FONAFIFO a las organizaciones, deberán indicar expresamente si corresponden o no a dichas cuotas.

4.4. Todos los beneficiarios (as) individuales de PSA, deberán presentar al FONAFIFO una certificación de su cuenta cliente en colones emitida por una entidad bancaria, financieras, mutual y/o cooperativa de ahorro y crédito, por cada presolicitud presentada, para recibir los pagos del Programa de PSA.

7.1. Dentro de los requisitos para ingresar al PSA, el solicitante o su representante debe presentar por escrito y ante la Oficina Regional del FONAFIFO correspondiente, la presolicitud firmada por el solicitante (Anexos 1 y 2). Adjuntando copia para sello de recibido, en la cual el personal de la Oficina Regional le indicará el número de presolicitud asignado. No se recibirán las presolicitudes que presenten información incompleta o que no adjunte los requisitos establecidos en el presente Manual. Se admitirá un máximo de cinco presolicitudes por persona por turno de presentación.

7.1.9 En las presolicitudes de la modalidad de manejo de bosque, una vez cumplidos los requisitos legales establecidos en los incisos 7.1.1 al 7.1.5, los solicitantes deberán aportar junto con el estudio técnico, una certificación del emitida por los funcionarios competentes del SINAC, que indique el cumplimiento de lo establecido en el plan de Manejo según los Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de Practicas y Manual de Procedimientos, Decreto Ejecutivo Nº 34559-MINAE, publicado en La Gaceta Nº 115 del 16 de junio del 2008.

7.10 Estudio técnico según el Anexo 16.

10.1. Tratándose de protección de bosque, protección de bosque en vacíos de conservación, protección de recurso hídrico y manejo de bosque, una vez firmado el contrato por todas las partes, inscrita la afectación del inmueble ante el Registro de la Propiedad o protocolizado el contrato en caso de fincas en posesión, el FONAFIFO tramitará la Orden de Pago respectiva. El pago de los contratos por año vencido se tramitará doce meses después de su vigencia. (ver puntos 8.4 y 8.9).

10.2. Para pagos posteriores, el Regente Forestal entregará a la Oficina Regional respectiva de FONAFIFO un informe certificado anual a los 12, 24, 36 y 48 meses de la fecha de vigencia de contrato, o de 24, 36, 48 y 60 meses cuando se trate de contratos suscritos sobre fincas por año vencido según la guía del Anexo 6 y anexo 17, el funcionario(a) responsable de la Oficina Regional de FONAFIFO, valorará informe certificado y procederá a asignar un número de consecutivo, para continuar con el trámite. El FONAFIFO tramitará la Orden de Pago respectiva.

10.12. El primer pago de servicios ambientales para la para la modalidad de manejo de bosque, será de un 20% del monto establecido en el Decreto Ejecutivo respectivo se realizará una vez formalizado el respectivo contrato.

el estudio técnico para proyectos de manejo de bosque El suscrito ____________, Nº colegiado ______, En mi calidad de Regente Forestal, con póliza de fidelidad Nº ______, amparado a la Ley Forestal, su reglamentación, sus modificaciones, reglamento de regencias forestales y la normativa vigente. Certifico el contenido del siguiente Estudio Técnico:

1. Nombre de beneficiarios (as), números de cédula, folio(s) real (es), número(s) de plano, área(s) total (es) de folio(s), uso actual, ubicación administrativa, la dirección exacta de la(s) finca(s) y los colindantes encontrados en el campo.

2. Número de formulario de regencia, fecha de visita.

3. Indicar si el área se encuentra en un área silvestre protegida, señalando el nombre de la misma.

4. Indicar la modalidad y el número de Presolicitud asignado de previo por la Oficina Regional respectiva.

5. El plano de la propiedad debe estar georeferenciado con al menos tres puntos ubicados mediante GPS con el datum WGS 84 y en formato grados-decimales (GG.dddd). Dos de estos puntos como mínimo deben ser vértices del plano. Todos los puntos GPS, deben de estar a una distancia no menor a 50 metros entre ellos. (deben indicarse en el croquis, las ubicaciones de los puntos y se deben de aportar de forma digital mediante un archivo de puntos shape, en el mismo sistema de coordenadas del croquis, indicando la referencia de cada punto). La información, de los puntos GPS debe estar incluida.

6. Asimismo, cada Estudio Técnico debe contener el croquis del área a someter a PSA con respecto al área total de la propiedad, indicando el derrotero y la numeración correspondiente de vértices, Debe indicarse el sistema empleado y exactitud del mismo; además debe amarrarse el punto de inicio (punto 1) del área a someter de un punto con coordenadas conocidas El croquis del área efectiva PSA, así como el croquis de la totalidad del plano debe entregarse impreso y en digital El digital debe de cumplir con:

- El archivo debe ser en formato Shape File de Arcview (polígono), no se admitirán otros formatos.

- El archivo Shape debe venir nombrado con el número de solicitud asignado por la Oficina Regional (ejemplo, SJ01000108).

- Se debe presentar un solo Shape que incluya en la tabla de atributos la cuantificación del área, uso (área PSA, resto de la finca) y el número de plano catastrado cuando sea el caso.

- En caso de existir contratos vigentes, incluir la ubicación de los mismos.

- El archivo debe presentarse georeferenciado en el sistema de coordenadas CRTM05 (oficializado mediante el Decreto Nº 33797-MJ-MOPT publicado en La Gaceta Nº 108 del miércoles 6 de junio del 2007) o bien en sistema de coordenadas geográficas, datum WGS84 y en formato grados decimales (GG.dddd).

- Debe ser entregado en un disco compacto (cd).

7. Las escalas a utilizar para áreas menores a treinta hectáreas deben de ser 1:5.000 a 1:10.000. Para el caso de áreas mayores pueden utilizarse a conveniencia profesional.

8. Además, el Estudio deberá elaborarse con base al área legal del terreno, es decir la 'superficie agraria', definiéndose ésta como el área de una porción de terreno determinada por la proyección horizontal de su perímetro.

9. Manifestación expresa de la existencia de otros contratos de PSA vigentes indicando el área, ubicación y certificando la cabida de los contratos.

10. En inmuebles con arrendamientos debe certificarse que las áreas PSA están excluidas de las áreas en arriendo, esto en caso de que sea el propietario del inmueble que solicita el ingreso al PSA. Caso contrario, certificar que los arriendos corresponden efectivamente a áreas PSA solicitados por los arrendatarios.

11. Solo se admitirán Estudios Técnicos Certificados que se refieran a planos cuyos desplazamientos en la ubicación cartográfica no superen los 500 metros, con respecto a lo indicado en el plano y la ubicación real de la finca. En los casos que supere los 500 metros se deberá adjuntar una certificación emitida por un topógrafo colegiado que indique la ubicación correcta del plano.

12. En todos los casos, los Estudios Técnicos Certificados deben ser elaborados en papel de seguridad, contener el nombre, número de colegiado y firma del profesional responsable, la fecha de elaboración y con los timbres respectivos.

Nota: Instalación de letreros preventivos, El rótulo debe de contener la siguiente información: nombre del beneficiario(a), modalidad, área PSA sometida y número de contrato forestal.

Para el trámite de los pagos a los 12, 24, 36 y 48 meses de la firma del contrato, el Regente Forestal debe presentar la certificación considerando los siguientes aspectos:

El suscrito ____________, Nº colegiado ______, En mi calidad de Regente Forestal, con póliza de fidelidad Nº ______, amparado a la Ley Forestal, su reglamentación, sus modificaciones y la normativa vigente. Certifico el estado del bosque de acuerdo a los siguientes criterios.

1. Indicar el nombre del propietario, folio real y área efectiva de PSA.

2. Agregar el número de contrato PSA y el número de cuota respectiva.

3. Número de formulario de regencia, fecha de visita.

4. Indicar las acciones realizadas para evitar la cacería, tala e incendios forestales, rotulación e informar de cualquier anomalía detectada.

5. Para los pagos posteriores, el Regente Forestal debe certificar el estado del bosque, así como el cumplimiento de lo establecido en el plan de manejo aprobado por el SINAC, y cualquier otro aspecto relacionado con la permanencia del bosque.

6. En todos los casos, las Certificaciones deben ser elaborados en papel de seguridad, contener el nombre, número de colegiado y firma del profesional responsable, la fecha de elaboración y con los timbres respectivos.

En todos los demás aspectos no considerados en la presente modificación, se mantiene vigente el Manual de Procedimientos para el Pago Servicios Ambientales, publicado en el Nº 46 del día viernes 6 de marzo 2009.
