in the entirety of the text - Full Text of Standard 315 Approves Fisheries Management Plan for the establishment of the Palito, Isla de Chira Marine Area for Responsible Fishing Full Text of record: CB32C COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE A.J.D.I.P./315-2009.-Puntarenas, on the twenty-fifth day of the month of October, 2009.

1. 1That Article 50 of the Political Constitution provides that it is the obligation of the State to procure the greatest well-being for all the inhabitants of the country, organizing and stimulating production and the most adequate distribution of wealth. Likewise, it incorporates the right of every person to a healthy and ecologically balanced environment.
2. 2That Article 56 of the Political Constitution establishes that the State must guarantee dignified, honest, and useful work for Society.
3. 3That the Law creating the Costa Rican Institute of Fisheries and Aquaculture, Law N° 7384, establishes as a function of this state public entity, to regulate the rational use of fishery resources to achieve greater economic returns and the protection of marine and aquaculture species.
4. 4That it is the responsibility of INCOPESCA, as the Governing Institution of the fisheries and aquaculture sector of our country, to establish management measures for the sustainable use of hydrobiological resources, which allow for the protection of reproduction, recruitment, and feeding areas, that favor the increase of species and the increase of their biomass, in a way that guarantees their sustainability for the benefit of the ecosystems and the fishers.
5. 5That the FAO Code of Conduct for Responsible Fisheries, Executive Decree N° 27919-MAG, recognizes in its Article 6, the important contribution of artisanal small-scale fisheries to the generation of employment, income, and food security. Hence the need for the State to appropriately guarantee the right of male and female fishers, adopting regulatory measures that favor the use of fishery resources in the waters of national jurisdiction.
6. 6That there are scientific studies through which it has been possible to demonstrate that the regulation of fishing gear and methods, as well as the fishing effort in certain strategic areas, contribute to the increase of biomass and species populations.
7. 7That the measures indicated in the preceding recital also represent a viable alternative for the generation of economic, social, and environmental benefits for fishing communities and for the ecosystems on which fishers depend for fishing.
8. 8That the Board of Directors of INCOPESCA, in 1995, issued an agreement adopting the project of the community of Palito de Chira, supported by scientific foundations from academics of different institutions to reserve a marine area of reefs and rocky bottoms, where fish reproduction occurs, reason why only fishing with handline was permitted in that zone.

9º-In 2003, this organization was transformed into an association, with the purpose of protecting and defending its fishing zone in a more organized manner and in this way carrying out protection and surveillance work in this zone.

10.-That The Board of Directors of INCOPESCA approved through Agreement N° 138-2008 A.J.D.I.P., dated April 4, 2008, the "Regulation for the establishment of Marine Areas for Responsible Fishing." 11.-That through a letter dated January 15, 2009, the Palito Isla de Chira Handline Fishers Association, filed a request before the Board of Directors of INCOPESCA for the creation of a Marine Area for Responsible Fishing, with the aim of ensuring long-term sustainable management of marine resources, as well as allowing the Island's fishers to fish responsibly to improve the socioeconomic situation of the associated fishers and therefore of the Community of Palito.

12.-That the Board of Directors of INCOPESCA, through Agreement A.J.D.I.P./046-2009 dated January 30, 2009, approved the project for the creation of the Marine Area for Responsible Fishing in the area comprised between Isla Paloma and the sector of Coloradito, Palito, Isla de Chira.

13.-That in accordance with the provisions of "Article 2 of the Regulation for the establishment of Marine Areas for Responsible Fishing", through Resolution PEP-0382-06-2009, the Executive Presidency of INCOPESCA created the Inter-institutional Working Group, with the aim of formulating and presenting before the Board of Directors the Fisheries Management Plan as a prerequisite for approving the establishment of the Marine Areas for Responsible Fishing.

14.-That the Inter-institutional Working Group carried out a participatory zoning of the area destined for the location of the Marine Area for Responsible Fishing, which also included the detail on the types of fishing (commercial, sport, tourist, among others), quantity, number and type of gear to be used, as well as the collection of other relevant information for the viability of the proposal.

15.-That the Inter-institutional Working Group has fulfilled the formalities established by the so-called Regulation N°138/2009 and that the Technical Director General of INCOPESCA, in his capacity as coordinator of this aforementioned Group, presented at the extraordinary session of the Board of Directors, on September 22, 2009, the "Proposed Fisheries Management Plan for the establishment of the Palito, Isla de Chira Marine Area for Responsible Fishing".

THE BOARD OF DIRECTORS OF INCOPESCA, AGREES:

Considering:

1. 1Que el Artículo 50 de la Constitución Política dispone que es obligación del Estado procurar el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Asimismo, incorpora el derecho de toda persona a un ambiente sano y ecológicamente equilibrado.
2. 2Que el Artículo 56 de la Constitución Política establece que el Estado debe garantizar el trabajo digno, honesto y útil para la Sociedad.
3. 3Que la Ley de creación del Instituto Costarricense de Pesca y Acuicultura, Ley N° 7384, establece como función d este ente público estatal, normar el aprovechamiento racional de los recursos pesqueros para lograr mayores rendimientos económicos y la protección de las especies marinas y acuícolas.
4. 4Que corresponde al INCOPESCA como Institución Rectora del sector pesquero y acuícola de nuestro país, establecer medidas de ordenamiento para el aprovechamiento sostenible de los recursos hidrobiológicos, que permitan proteger áreas de reproducción, reclutamiento y de alimentación, que favorezcan el incremento de las especies y el aumento de su biomasa, de manera que se garantice su sostenibilidad en provecho de los ecosistemas y de los pescadores.
5. 5Que el Código de Conducta para la Pesca Responsable de la FAO, Decreto Ejecutivo N° 27919-MAG reconoce en su Artículo 6, la importante contribución de la pesca artesanal en pequeña escala a la generación de empleo, ingresos y seguridad alimentaria. De ahí la necesidad de que el Estado garantice apropiadamente el derecho de los pescadores y pescadoras, adoptando medidas de regulación que favorezcan el aprovechamiento de los recursos pesqueros en las aguas de jurisdicción nacional.
6. 6Que se cuenta con estudios científicos mediante los cuales se ha logrado demostrar que la regulación de las artes y métodos de pesca, así como el esfuerzo pesquero en determinadas áreas estratégicas, contribuyen al aumento de la biomasa y de las poblaciones de especies.
7. 7Que las medidas señaladas en el considerando anterior, representan también una alternativa viable para la generación de beneficios económicos, sociales y ambientales para las comunidades pesqueras y para los ecosistemas, de los que los pescadores dependen para la pesca.
8. 8Que la Junta Directiva del INCOPESCA, en el año 1995, emitió un acuerdo donde se acogió el proyecto de la comunidad de Palito de Chira, apoyados en fundamentos científicos de académicos de diferentes instituciones para reservar un área marina de arrecifes y fondos rocosos, en donde se da la reproducción de peces, por lo cual solo se permitió la pesca con cuerda de mano, en esa zona.

9º-En el año 2003, esta organización se transformo en una asociación, con el propósito de proteger y defender su zona de pesca de una manera más organizada y de este modo realizar labores de protección y vigilancia en esta zona.

10.-Que La Junta Directiva del INCOPESCA aprobó mediante Acuerdo N° 138-2008 A.J.D.I.P., de fecha 04 de abril del 2008, el "Reglamento para el establecimiento de las Áreas Marinas de Pesca Responsable.

11.-Que mediante carta de fecha 15 de enero del 2009, la Asociación de Pescadores Cuerderos de Palito Isla de Chira, presentaron solicitud ante la Junta Directiva del INCOPESCA, para la creación de un Área Marina de Pesca Responsable, con el fin de asegurar un manejo sostenible de los recursos marinos a largo plazo, así como permitir a los pescadores de la Isla pescar responsablemente para mejorar la situación socioeconómica de los pescadores asociados y por ende de la Comunidad de Palito.

12.-Que la Junta Directiva del INCOPESCA mediante Acuerdo A.J.D.I.P./046-2009 de fecha 30 de enero del 2009, aprobó el proyecto para la creación del Área Marina de Pesca Responsable en el área comprendida entre Isla Paloma y el sector de Coloradito, Palito, Isla de Chira.

13.-Que de conformidad con lo que establece el "Artículo 2 del Reglamento para establecimiento de las Áreas Marinas de Pesca Responsable", mediante Resolución PEP-0382-06-2009 la Presidencia Ejecutiva del INCOPESCA creó el Grupo de Trabajo Interinstitucional, con el fin de formular y presentar ante la Junta Directiva, el Plan de Ordenamiento Pesquero como requisito previo para aprobar el establecimiento de las Áreas Marinas de Pesca Responsable.

14.-Que el Grupo de Trabajo Interinstitucional realizó una Zonificación participativa del área destinada para la ubicación del Área Marina para Pesca Responsable, que incluyó además el detalle sobre los tipos de pesca (comercial, deportiva, turística, entre otros), cantidad, número y tipo de artes a utilizar, al igual que la recolección de otra información relevante para la viabilidad de la propuesta.

15.-Que el Grupo Interinstitucional de Trabajo ha cumplido con las formalidades que establece el denominado Reglamento N°138/2009 y que el Director General Técnico del INCOPESCA, en su condición de coordinador de este supracitado Grupo, presentó en la sesión extraordinaria de Junta Directiva, del pasado 22 de setiembre del 2009, la "Propuesta de Plan de Ordenamiento Pesquero para el establecimiento del Área Marina de Pesca Responsable de Palito, Isla de Chira".
