Law 8771 — Ministry of Justice and PeaceLey 8771 — Ministerio de Justicia y Paz

The Organic Law of the Ministry of Justice, No. 6739, of April 28, 1982, is hereby amended in the following provisions:

• a)The title is hereby reformed, the text of which shall read:

"Organic Law of the Ministry of Justice and Peace." b) The designation "Ministry of Justice" or "Justice and Grace" is hereby replaced throughout the articles with Ministry of Justice and Peace.

• c)A new subsection c) is hereby added to Article 3; consequently, the numbering of the subsequent subsection is run. The text shall read:

"Article 3.- The Ministry of Justice and Peace shall exercise its functions through the following dependencies:

[...]

• c)The National System for the Promotion of Social Peace, attached to the office of the minister, which shall be composed of: the General Directorate for the Promotion of Peace and Citizen Coexistence; the National Directorate for Alternative Conflict Resolution; the Directorate of Public Spectacles, and the National Commission for the Prevention of Violence and the Promotion of Social Peace.

[...]" d) New subsections i), j), k), l), m), and n) are hereby added to Article 7; consequently, the numbering of the subsequent subsection is run. The text shall read:

"Article 7.- The functions of the Ministry of Justice and Peace shall be:

[...]

• i)To promote and coordinate plans and programs aimed at the promotion of peace at the national level.
• j)To support, from the perspective of violence prevention, the Ministry of Public Security in matters of firearms in the country, as a means to promote a culture of peace and non-violence.
• k)To promote alternative conflict resolution as a way of developing a culture of peace, without prejudice to the other functions established in the Law on Alternative Conflict Resolution and Promotion of Social Peace, No. 7727.
• l)To foster better inter-institutional coordination, in order to fulfill the mandate of the General Law on Public Spectacles, Audiovisual and Printed Materials, No. 7440.
• m)To promote the participation of civil society through non-governmental organizations and any other type of organization dedicated to promoting peace and non-violence.
• n)Any others assigned to it by law or decree.

[...]"

In sub-subsection ch) of subsection 1) of Article 23 of the General Law of Public Administration, the designation "Justice and Grace" is hereby substituted with "Justice and Peace".

As of the effective date of this Law, any regulation referring to the "Ministry of Justice" or "Justice and Grace" shall be understood to be replaced by the designation "Ministry of Justice and Peace".

This Law takes effect six months after its publication.

Given in the province of Cartago, on the fourteenth day of the month of September, two thousand nine.

Modifícase la Ley orgánica del Ministerio de Justicia, Nº 6739, de 28 de abril de 1982, en las siguientes disposiciones:

• a)Se reforma el título, cuyo texto dirá:

"Ley orgánica del Ministerio de Justicia y Paz." b) Se sustituye del articulado la denominación "Ministerio de Justicia" o "Justicia y Gracia" por Ministerio de Justicia y Paz.

• c)Se adiciona un nuevo inciso c) al artículo 3; en consecuencia se corre la numeración del inciso subsiguiente. El texto dirá:

"Artículo 3.- El Ministerio de Justicia y Paz ejercerá sus funciones por medio de las siguientes dependencias:

[...]

• c)El Sistema Nacional de Promoción de la Paz Social, adscrito al despacho del ministro o la ministra, que estará conformado por: la Dirección General de Promoción de la Paz y la Convivencia Ciudadana; la Dirección Nacional de Resolución Alternativa de Conflictos; la Dirección de Espectáculos Públicos y la Comisión Nacional de Prevención de la Violencia y la Promoción de la Paz Social.

[...]" d) Se adicionan los nuevos incisos i), j), k), l), m) y n), al artículo 7; en consecuencia, se corre la numeración del inciso subsiguiente. El texto dirá:

"Artículo 7.- Serán funciones del Ministerio de Justicia y Paz:

[...]

• i)Impulsar y coordinar planes y programas dirigidos a la promoción de la paz en el ámbito nacional.
• j)Apoyar, desde la perspectiva de prevención de la violencia, al Ministerio de Seguridad Pública en materia de las armas de fuego en el país, como medio para promover la cultura de paz y la no violencia.
• k)Promocionar la resolución alternativa de conflictos como una forma de desarrollar una cultura de paz, sin menoscabo de las demás funciones establecidas en la Ley sobre resolución alterna de conflictos y promoción de la paz social, Nº 7727.
• l)Propiciar la mejor articulación interinstitucional, a fin de cumplir el mandato de la Ley general de espectáculos públicos, materiales audiovisuales e impresos, Nº 7440.
• m)Promover la participación de la sociedad civil por medio de organizaciones no gubernamentales y cualquier otro tipo de organismo dedicado a promover la paz y la no violencia.
• n)Las demás que le sean asignadas por ley o decreto.

[...]"

Sustitúyese en el subinciso ch) del inciso 1) del artículo 23 de la Ley general de la Administración Pública, la denominación "Justicia y Gracia" por "Justicia y Paz".

A partir de la vigencia de esta Ley, cualquier normativa que se refiera al "Ministerio de Justicia" o "Justicia y Gracia", deberá entenderse sustituida por la denominación "Ministerio de Justicia y Paz".

Rige a partir de los seis meses después de su publicación.

Dado en la provincia de Cartago, a los catorce días del mes de setiembre del dos mil nueve.
