8205, published in the Official Gazette La Gaceta No. 13 of January 18, 2002, additionally requested from the Corporación Andina de Fomento (CAF) a Non-Reimbursable Technical Cooperation, for up to an amount of USD $180,000.00 (One hundred eighty thousand exact dollars, legal tender of the United States of America).

The foregoing, by virtue of the fact that due to the origin of the funds and the nature of the Contracting, this will be a private contract between the Corporación Andina de Fomento (CAF) and the natural or legal person that is selected; whose final result will be the donation of the EsIA for the aforementioned Project. The resources are not considered public funds of the Government of Costa Rica, despite the participation of the Ministry of Public Works and Transport as a collaborating body in the development of the aforementioned "Special Procedure". Therefore, They Decree:

Creation of the Technical Committee for the Contracting by the Corporación Andina de Fomento (CAF), of the Consulting Services, for the Environmental Impact Study (EsIA) and Annexes of the Project "Road Section Bajos de Chilamate Vuelta Kooper, located on National Route No. 4

Create within the scope of the Ministry of Public Works and Transport a Technical Committee to assist the Corporación Andina de Fomento (CAF) in the selection and contracting of a consulting company, with experience in Environmental Impact Studies, for the preparation of the Environmental Impact Study and Annexes necessary for the verification of the Project: "Road Section Bajos de Chilamate Vuelta Kooper", in accordance with the requirements of the Secretaría Técnica Nacional Ambiental through its Resolution No. 181-2008-SETENA, of 10:00 a.m. on the 7th day of the month of February of the year 2008.

The Contracting Procedure established for the purpose of contracting the services of the company that will prepare the Environmental Impact Study (EsIA) and its Annexes, for the Project called: "Road Section Bajos de Chilamate Vuelta Kooper", will be governed by the provisions agreed in the Non-Reimbursable Technical Cooperation Agreement signed between the MOPT and the Corporación Andina de Fomento (CAF) on March 31, 2009 and by the internal rules and provisions of organization and management of the CAF.

The Contracting Procedure will be governed by the Principles of Equality, Free Competition, Publicity, Efficiency, and others applicably relevant within the framework of Costa Rican Legislation.

The Technical Committee will be an ad hoc commission, which will be attached to the Office of the Vice Minister of Public Works of the Ministry of Public Works and Transport and whose main functions will be: to issue the invitation to the respective contracting process, to receive and analyze the offers, and to submit the selection recommendation to the Corporación Andina de Fomento (CAF); as well as to perform the oversight (fiscalización) of the Consulting Contract, signed between the Corporación Andina de Fomento (CAF) and the selected bidder. The Corporación Andina de Fomento being directly responsible for the contractual relationship itself.

The coordination and monitoring of the work carried out by the Technical Committee, regarding the execution of the Non-Reimbursable Technical Cooperation Agreement agreed between the Ministry of Public Works and Transport and the Corporación Andina de Fomento (CAF), is delegated to the Directorate of Sectoral Planning of the Ministry of Public Works and Transport. Likewise, the coordination of the functions of the Oversight Unit of said Committee is delegated to the Directorate of Sectoral Planning.

This Technical Committee will be subdivided into two Units: Contracting Procedure Unit and Oversight Unit.

The Contracting Procedure Unit will be composed, at least, of the following officials:

• a)The Institutional Supplier of the MOPT or their representative b) The Director of the Legal Directorate of the MOPT or their representative.
• c)The Director of Engineering of the Consejo Nacional de Vialidad, or their representative.
• d)The Director of Sectoral Planning of the MOPT or their Representative.
• e)The Members of the Oversight Unit.

The Oversight Unit will be coordinated by the Directorate of Sectoral Planning of the MOPT and will be composed, at least, of the following officials:

• a)A Biologist from the Directorate of Sectoral Planning of the MOPT.
• b)A Forest Engineer appointed by the Directorate of Beautification and Safety of National Highways.
• c)A Sociologist appointed by the Gender Equity Office.
• d)An Environmental Engineer appointed by the Consejo Nacional de Vialidad.
• e)A Geologist appointed by the Office of the Vice Minister of Public Works.
• f)A Geographer appointed by the Instituto Geográfico Nacional.
• g)An Architect appointed by the Directorate of Sectoral Planning.
• h)A Civil Engineer appointed by the Directorate of Sectoral Planning.

The other administrative units of the Ministry are obliged to provide collaboration and advice to the Technical Committee, in fulfilling its tasks.

All members of the Technical Committee will be officials from the regular payroll of the Ministry of Public Works and Transport, the Consejo Nacional de Vialidad and/or its other Attached Bodies. Should the advisory services of a professional in a specific subject matter be required, which the Ministry of Public Works and Transport does not have on its regular payroll, their services may be contracted.

The functions of this unit will be:

• a)Define and prepare the Terms of Reference that will determine the scope of the studies to be carried out and present them to the Corporación Andina de Fomento (CAF) for its no objection.
• b)Prepare and promote the call for the special procedure.
• c)Receive requests for clarification of the Terms of Reference, from interested parties.
• d)Receive Offers at the Institutional Procurement Office of the Ministry of Public Works and Transport, on the date established in the Invitation to the Special Procedure.
• e)Analyze and evaluate, in accordance with the established methodology, each of the offers presented, according to order of merit, and prepare the "Offer Analysis Report".
• f)Present the offer analysis report to the Corporación Andina de Fomento (CAF), including the evaluation process and the recommendation of the best-qualified bidder.
• g)Inform the bidders of the final selection by the Corporación Andina de Fomento (CAF).
• h)Prepare the draft Consulting Contract to be signed between the Corporación Andina de Fomento (CAF) and the Consultant (Selected Bidder) and present it to the Corporación Andina de Fomento (CAF) for its consideration.
• i)Prepare the "Final Beneficiary Report" in accordance with the terms established in Annex B, of the Non-Reimbursable Technical Cooperation Agreement signed between the Ministry of Public Works and Transport and the Corporación Andina de Fomento (CAF).

Once the Consulting Contract has been signed between the Corporación Andina de Fomento (CAF) and the selected Consultant and the official communication has been received by this Unit, its functions will be:

• a)Convene the Consultant to a Pre-start Meeting.
• b)Notify the Commencement Order to the Consultant.
• c)Request the Work Plan and Administrative Structure prepared by the Consultant and, once received to satisfaction, in accordance with the Terms of Reference, inform the Directorate of Sectoral Planning, so that the corresponding payment process before the Corporación Andina de Fomento (CAF) can proceed.
• d)Receive and oversee (fiscalizar) the Technical-Administrative Progress Reports, presented by the Consultant and, once received to satisfaction, in accordance with the Terms of Reference, inform the Directorate of Sectoral Planning, so that the corresponding payment process before the Corporación Andina de Fomento (CAF) can proceed.
• e)Receive the Final Report of the EsIA for the Project, presented by the Consultant and, once the official receipt to satisfaction is issued by this Unit, inform the Directorate of Sectoral Planning, so that the corresponding payment process before the Corporación Andina de Fomento (CAF) can proceed.

The Corporación Andina de Fomento, by virtue of the provisions of Law No. 8205 and the Headquarters Agreement, signed between the Government of the Republic of Costa Rica and the CAF, and the Non-Reimbursable Technical Cooperation Agreement, dated March 31, 2009, will invite, through the respective bodies of the Ministry of Public Works and Transport, referred to in this same Decree, the consulting companies specialized in the preparation of environmental impact studies, duly registered before the corresponding entities, to participate.

National or foreign consulting firms that meet all the requirements established in the Terms of Reference issued for the purpose may participate in this contracting procedure.

• a)Guarantee Fund.

The Corporación Andina de Fomento (CAF) will establish a Guarantee Fund, with percentage withholdings applied to each partial payment made to the Consultant, in accordance with the provisions established in the Terms of Reference.

• b)Contract Signing:

The Corporación Andina de Fomento (CAF), by way of exception, will sign the Professional Services Contract with the Consultant that is selected, given that due to the origin of the funds and the nature of the contracting, these resources are not considered public funds of the Government of Costa Rica; therefore, the contractual relationship will be between the Corporación Andina de Fomento (CAF) and the Consultant.

• c)Payments to the Consultant:

The Corporación Andina de Fomento (CAF) will make the payments directly to the Consultant in accordance with the Terms of Reference of the Contracting, upon written request from the Ministry of Public Works and Transport, indicating that the strict requirements for making the payment have been met and issuing the necessary administrative instructions for the payment.

Lo anterior, en virtud de que por el origen de los fondos y por la naturaleza de la Contratación, esta será una contratación privada entre la Corporación Andina de Fomento (CAF) y la persona física o jurídica que resulte seleccionada; cuyo resultado final será la donación del EsIA del Proyecto antes mencionado. Los recursos no se consideran fondos públicos del Gobierno de Costa Rica, no obstante la participación del Ministerio de Obras Públicas y Transportes como órgano colaborador en el desarrollo del "Procedimiento Especial" aludido. Por tanto,

Creación del Comité Técnico para la Contratación por parte de la Corporación Andina de Fomento (CAF), de los Servicios de Consultoría, para el Estudio de Impacto Ambiental (EsIA) y Anexos del Proyecto "Tramo Carretero Bajos de Chilamate Vuelta Kooper, localizado en la Ruta Nacional Nº 4

Créase en el ámbito del Ministerio de Obras Públicas y Transportes un Comité Técnico para coadyuvar con la Corporación Andina de Fomento (CAF) en la selección y contratación de una empresa consultora, con experiencia en Estudios de Impacto Ambiental, para la elaboración del Estudio de Impacto Ambiental y Anexos necesarios para la verificación del Proyecto: "Tramo Carretero Bajos de Chilamate Vuelta Kooper", de conformidad con lo requerido por la Secretaría Técnica Nacional Ambiental mediante su Resolución Nº 181-2008-SETENA, de las 10:00 horas del día 07 del mes de febrero del año 2008.

El Procedimiento de Contratación que se disponga a efecto de contratar los servicios de la empresa que elaborará el Estudio de Impacto Ambiental (EsIA) y sus Anexos, para el Proyecto denominado: "Tramo Carretero Bajos de Chilamate Vuelta Kooper", será regido por las disposiciones acordadas en el Convenio de Cooperación Técnica No Reembolsable suscrito entre el MOPT y la Corporación Andina de Fomento (CAF) el día 31 de marzo del 2009 y por las normas y disposiciones internas de organización y gestión de la CAF.

El Procedimiento de Contratación estará regido por los Principios de Igualdad, Libre Competencia, Publicidad, Eficiencia y demás conducentemente aplicables en el marco de la Legislación costarricense.

El Comité Técnico será una comisión ad hoc, la cual estará adscrita al Despacho del Viceministro de Obras Públicas del Ministerio de Obras Públicas y Transportes y que tendrá como funciones principales: realizar la invitación al proceso de contratación respectiva, recibir, analizar las ofertas y someter la recomendación de selección a la Corporación Andina de Fomento (CAF); así como realizar la fiscalización del Contrato de Consultoría, suscrito entre la Corporación Andina de Fomento (CAF) y el oferente seleccionado. Siendo la Corporación Andina de Fomento la directamente responsable por la relación contractual en sí.

Se delega en la Dirección de Planificación Sectorial del Ministerio de Obras Públicas y Transportes, la coordinación y seguimiento de las labores realizadas por el Comité Técnico, en lo referente a la ejecución del Convenio de Cooperación Técnica no Reembolsable acordado entre el Ministerio de Obras Públicas y Transportes y la Corporación Andina de Fomento (CAF). Asimismo, se delega en la Dirección de Planificación Sectorial la coordinación de las funciones de la Unidad de Fiscalización de dicho Comité.

Este Comité Técnico se subdividirá en dos Unidades: Unidad de Procedimiento de Contratación y Unidad de Fiscalización.

La Unidad de Procedimiento de Contratación estará integrada al menos, por los siguientes funcionarios:

• a)El (La) Proveedor (a) Institucional del MOPT o su representante b) El (La) Director (a) de la Dirección Jurídica del MOPT o su representante.
• c)El (La) Director (a) de Ingeniería del Consejo Nacional de Vialidad, o su representante.
• d)El (La) Director (a) de Planificación Sectorial del MOPT o su Representante.
• e)Los Miembros de la Unidad de Fiscalización.

La Unidad de Fiscalización estará coordinada por la Dirección de Planificación Sectorial del MOPT y estará integrada al menos, por los siguientes funcionarios:

• a)Un Biólogo de la Dirección de Planificación Sectorial del MOPT.
• b)Un Ingeniero Forestal designado por la Dirección de Embellecimiento y Seguridad de Carreteras Nacionales.
• c)Un Sociólogo designado por la Oficina de Equidad de Género.
• d)Un Ingeniero Ambiental designado por el Consejo Nacional de Vialidad.
• e)Un Geólogo designado por Despacho del Viceministro de Obras Públicas.
• f)Un Geógrafo designado por el Instituto Geográfico Nacional.
• g)Un Arquitecto designado por la Dirección de Planificación Sectorial.
• h)Un Ingeniero Civil designado por la Dirección de Planificación Sectorial.

Las demás unidades administrativas del Ministerio, están obligadas a brindarle colaboración y asesoría al Comité Técnico, en el cumplimiento de sus cometidos.

Todos los miembros del Comité Técnico, serán funcionarios de la planilla regular del Ministerio de Obras Públicas y Transportes, del Consejo Nacional de Vialidad y/o de sus demás Órganos adscritos. En caso de requerirse la asesoría de algún profesional en una materia específica, que el Ministerio de Obras Públicas y Transportes no posea en su planilla regular, se podrán contratar sus servicios.

Las funciones de esta unidad serán:

• a)Definir y preparar los Términos de Referencia que determinarán el alcance de los estudios a realizar y presentarlos a la Corporación Andina de Fomento (CAF) para su no objeción.
• b)Preparar y promover la convocatoria al procedimiento especial.
• c)Recibir las solicitudes de aclaración a los Términos de Referencia, por parte de los interesados.
• d)Recibir Ofertas en la Proveeduría Institucional del Ministerio de Obras Públicas y Transportes, en la fecha establecida en la Invitación al Procedimiento Especial.
• e)Analizar y evaluar acorde con la metodología establecida, cada una de las ofertas presentadas, según orden de mérito y confeccionar el "Informe de Análisis de las Ofertas".
• f)Presentar a la Corporación Andina de Fomento (CAF) el informe de análisis de las ofertas, que incluya el proceso de evaluación y la recomendación del oferente mejor calificado.
• g)Informar a los oferentes de la selección definitiva por parte de la Corporación Andina de Fomento (CAF).
• h)Preparar el borrador del Contrato de Consultoría por suscribirse entre la Corporación Andina de Fomento (CAF) y el Consultor (Oferente seleccionado) y presentarlo a la Corporación Andina de Fomento (CAF) para su consideración.
• i)Elaborar el "Informe Final del Beneficiario" de conformidad con los términos señalados en el Anexo B, del Convenio de Cooperación Técnica no Reembolsable suscrito entre el Ministerio de Obras Públicas y Transportes y la Corporación Andina de Fomento (CAF).

Una vez firmado el Contrato de Consultoría entre la Corporación Andina de Fomento (CAF) y el Consultor seleccionado y recibida por esta Unidad la comunicación oficial, sus funciones serán:

• a)Convocar al Consultor a Reunión de Pre-inicio.
• b)Comunicar la Orden de Inicio al Consultor.
• c)Solicitar el Plan de Trabajo y la Estructura Administrativa elaborado por el Consultor y una vez recibidos a satisfacción, acorde con los términos de Referencia, informar a la Dirección de Planificación Sectorial, para que se proceda con el trámite de pago correspondiente ante la Corporación Andina de Fomento (CAF).
• d)Recibir y fiscalizar los Informes de Avance Técnico-Administrativo, presentados por el Consultor y una vez recibidos a satisfacción, acorde con los Términos de Referencia, informar a la Dirección de Planificación Sectorial, para que se proceda con el trámite de pago correspondiente ante la Corporación Andina de Fomento (CAF).
• e)Recibir el Informe Final del EsIA del Proyecto, presentado por el Consultor y una vez que se emita por esta Unidad el recibo oficial a satisfacción, informar a la Dirección de Planificación Sectorial, para que se proceda con el trámite de pago correspondiente ante la Corporación Andina de Fomento (CAF).

La Corporación Andina de Fomento en virtud de lo dispuesto en la Ley Nº 8205 y del Acuerdo Sede, suscrito entre el Gobierno de la República de Costa Rica y la CAF, y del Convenio de Cooperación Técnica No Reembolsable, de fecha 31 de marzo del 2009, invitará por medio de los órganos respectivos del Ministerio de Obras Públicas y Transportes, referido en este mismo Decreto, a participar a las empresas consultoras con especialidad en elaboración de estudios de impacto ambiental, debidamente registrados ante las entidades correspondientes.

Podrán participar en el presente procedimiento de contratación, las firmas consultoras nacionales o extranjeras, que cumplan con todos los requisitos establecidos en los Términos de Referencia que se emitan al efecto.

• a)Fondo de Garantía.

La Corporación Andina de Fomento (CAF) constituirá un Fondo de Garantía, con retenciones porcentuales aplicadas a cada pago parcial que se realice al Consultor, de conformidad con lo establecido en los Términos de Referencia.

• b)Firma del Contrato:

La Corporación Andina de Fomento (CAF), por vía de excepción, firmará el Contrato de Servicios Profesionales con el Consultor que resulte seleccionado, dado que por el origen de los fondos y por la naturaleza de la contratación, estos recursos no se consideran fondos públicos del Gobierno de Costa Rica, por lo tanto, la relación contractual será entre la Corporación Andina de Fomento (CAF) y el Consultor.

• c)Pagos al Consultor:

La Corporación Andina de Fomento (CAF) realizará los pagos directamente al Consultor de conformidad con los Términos de Referencia de la Contratación, previa solicitud escrita del Ministerio de Obras Públicas y Transportes, indicando que se han cumplido con los requisitos de rigor para la realización del mismo y girando las instrucciones administrativas necesarias para el pago.

Rige a partir de su publicación en el Diario Oficial La Gaceta.
