in the entirety of the text - Full Text of Regulation 136 Adds article 4 Bis to Agreement AJDIP/099-2007 to Allow the Importation of Vessels for Commercial Longline Fishing and Shrimp Fishing Activities Full Text of Record: C535C COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP-136-2009.-Puntarenas, on the seventeenth day of the month of April, 2009.
I.-That through agreement AJDIP/099-2007, published in the Official Gazette La Gaceta No. 83 of May 2, 2007, the pertinent regulations were established regarding the size of vessels and the percentages of increase for purposes of importations or substitutions, setting a maximum limit of 24 meters length overall (eslora).
II.-That in the indicated regulations, and even with their spirit, the situations of those vessels that, before the regulation, were already registered in the corresponding registries of the country and held a fishing license were omitted from consideration, and they should not be harmed by the indicated limitation. Therefore, THE BOARD OF DIRECTORS OF INCOPESCA, AGREES:
Considering:
"Article 4 Bis.-The substitution of vessels measuring more than 24 meters length overall (eslora) shall be permitted, only in the case of those vessels that, before the effective date of this agreement, were registered in the Ship Registry of Costa Rica, held a fishing license, and measured more than the indicated length, in which case the exceptional maintenance of that measurement shall be permitted without the possibility of increasing it."

I.-Que mediante acuerdo AJDIP/099-2007, publicado en el Diario Oficial La Gaceta N° 83 del 2 de mayo del 2007, se establecieron las regulaciones pertinentes respecto del tamaño de las embarcaciones y los porcentajes de incremento para efectos de importaciones o sustituciones planteándose un límite máximo de 24 metros de eslora.
II.-Que en las regulaciones indicadas y aún con el espíritu de las mismas, se omitió considerar las situaciones de aquellas embarcaciones que antes de la regulación, ya se encontraban inscritas en los registros correspondientes del país y con licencia de pesca, las cuales no deben ser perjudicadas con la limitante indicada. Por tanto, LA JUNTA DIRECTIVA DEL INCOPESCA, ACUERDA:
