in the entirety of the text - Complete Text of Regulation 35072 Amends for the National Parks Fund, the maximum budget expenditure set for the year 2009 Complete Text of record: C7D74 Nº 35072 -H Nº 35072 -H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers granted by articles 140, subsections 3) and 18) and 146 of the Political Constitution; articles 25, subsection 1), 27, subsection 1) and 28, subsection 2) paragraph b) of Law Nº 6227, General Law of Public Administration of May 2, 1978 and its amendments; Law Nº 8131, Law of Financial Administration of the Republic and Public Budgets of September 18, 2001 and its amendments; its Regulation, Decreto Ejecutivo Nº 32988-H-MP-PLAN of January 31, 2006 and its amendments; Law Nº 6084, National Parks Service Law of August 24, 1977 and its amendments; Law Nº 7554, Organic Law of the Environment of October 4, 1995 and its amendments; Law Nº 7788, Biodiversity Law of April 30, 1998; Decreto Ejecutivo Nº 32452-H of June 29, 2005 and its amendments and Decreto Ejecutivo Nº 34404-H of March 5, 2008 and its amendment.

1. 1That the Organic Law of the Environment No. 7554, published in La Gaceta No. 215 of November 13, 1995 and its amendments, establishes that the State must ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it is obligated to promote economically and environmentally sustainable development, understood as development that meets basic human needs without compromising the options of future generations.
2. 2That the National Parks Fund created by Law No. 6084, National Parks Service Law, published in La Gaceta No. 169 of September 7, 1977 and its amendments, is administered by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), as established in Law No. 7788, Biodiversity Law, published in La Gaceta No. 101 of May 27, 1998.
3. 3That through official letter SINAC-DE 1649 of September 30, 2008 and SINAC-DE 2002 of November 20, 2008, the Executive Director of SINAC requests to increase the maximum budget expenditure for 2009 by ¢2,613,600,000.00 (two billion six hundred thirteen million six hundred thousand colones exactly), to cover various expenses that require a budget provision for their adjudication and execution.
4. 4That the above amount will be financed with own resources of ¢1,302,000,000.00 (one billion three hundred two million colones exactly), coming from the sale of goods and services for entrance fees and use of facilities of the Protected Wild Areas (Áreas Silvestres Protegidas), authorized through Decreto Ejecutivo Nº 34164-MINAE, published in La Gaceta No. 7 of January 10, 2008, to finance services, as well as with Free Surplus (Superávit Libre) in the amount of ¢1,311,600,000.00 (one billion three hundred eleven million six hundred thousand colones exactly), to finance expenses for materials and supplies, machinery, equipment and furniture, constructions, additions and improvements.
5. 5That through Decreto Ejecutivo Nº 32452-H and its amendments, published in La Gaceta No. 130 of July 6, 2005, the "Guideline for the application of Article 6 of Law No. 8131, of the Financial Administration of the Republic and Public Budgets and the regulation of the class of Public Sector revenues called Financing" is issued.
6. 6That article 7 of the aforementioned decree provides that resources from free surplus may be used in subsequent periods to finance current expenses provided that they relate to ordinary activities of the entity, with which the interest of the community, public service, and institutional purposes are served, provided that they do not have a permanent nature or generate an obligation that requires financing over time, as occurs in the present case.
7. 7That with official letters STAP CIRCULAR-2276-08 of November 28, 2008, the maximum budget expenditure set for 2009 was communicated to the Fund, for ¢3,734,080,000.00 (three billion seven hundred thirty-four million eighty thousand colones exactly).
8. 8That the Minister Rector of the Environment, Energy and Telecommunications Sector, through official letter DM-1189-2008 of October 13, 2008, endorses the request made by the National Parks Fund.
9. 9That for the foregoing, it is necessary to modify the maximum budget expenditure set for the Fund for 2009, increasing it by the sum of ¢2,613,600,000.00 (two billion six hundred thirteen million six hundred thousand colones exactly). Therefore,

en la totalidad del texto - Texto Completo Norma 35072 Modifica para el Fondo de Parques Nacionales, el gasto presupuestario máximo fijado para el año 2009 Texto Completo acta: C7D74 Nº 35072 -H Nº 35072 -H EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los artículos 140, incisos 3) y 18) y 146 de la Constitución Política; los artículos 25, inciso 1), 27, inciso 1) y 28, inciso 2) acápite b) de la Ley Nº 6227, Ley General de la Administración Pública de 2 de mayo de 1978 y sus reformas; la Ley Nº 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre de 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo Nº 32988-H-MP-PLAN de 31 de enero de 2006 y sus reformas; la Ley Nº 6084, Ley del Servicio de Parques Nacionales de 24 de agosto de 1977 y sus reformas; la Ley Nº 7554, Ley Orgánica del Ambiente de 4 de octubre de 1995 y sus reformas; la Ley Nº 7788, Ley de Biodiversidad de 30 de abril de 1998; el Decreto Ejecutivo Nº 32452-H de 29 de junio de 2005 y sus reformas y el Decreto Ejecutivo Nº 34404-H de 5 de marzo de 2008 y su reforma.

1. 1Que la Ley Orgánica del Ambiente Nº 7554, publicada a La Gaceta Nº 215 de 13 de noviembre de 1995 y sus reformas, establece que el Estado debe velar por la utilización racional de los elementos ambientales, con el fin de proteger y mejorar la calidad de vida de los habitantes del territorio nacional. Asimismo, está obligado a propiciar un desarrollo económico y ambientalmente sostenible, entendido como el desarrollo que satisface las necesidades humanas básicas, sin comprometer las opciones de las generaciones futuras.
2. 2Que el Fondo de Parques Nacionales creado mediante Ley Nº 6084, Ley del Servicio de Parques Nacionales, publicada a La Gaceta Nº 169 de 7 de setiembre de 1977 y sus reformas, está administrado por el Sistema Nacional de Áreas de Conservación, según lo establecido en la Ley Nº 7788, Ley de Biodiversidad, publicada a La Gaceta Nº 101 de 27 de mayo de 1998.
3. 3Que mediante oficio SINAC-DE 1649 de 30 de setiembre de 2008 y SINAC-DE 2002 de 20 de noviembre de 2008, el Director Ejecutivo del Sistema Nacional de Áreas de Conservación (SINAC), solicita incrementar en ¢2.613.600.000,00 (dos mil seiscientos trece millones seiscientos mil colones exactos), el gasto presupuestario máximo para el 2009, para atender gastos diversos que requieren de una previsión presupuestaria para su adjudicación y ejecución.
4. 4Que el monto anterior se financiará con recursos propios por ¢1.302.000.000,00 (mil trescientos dos millones de colones exactos), provenientes de la venta de bienes y servicios por entradas y uso de las instalaciones de las Áreas Silvestres Protegidas, autorizadas mediante el Decreto Ejecutivo Nº 34164-MINAE, publicado a La Gaceta Nº 7 de 10 de enero de 2008, para financiar servicios, así como con Superávit Libre por un monto de ¢1.311.600.000,00 (mil trescientos once millones seiscientos mil colones exactos), para financiar gastos de materiales y suministros, maquinaria, equipo y mobiliario, construcciones, adiciones y mejoras.
5. 5Que mediante el Decreto Ejecutivo Nº 32452-H y sus reformas, publicado a La Gaceta Nº 130 de 6 de julio de 2005, se emite el "Lineamiento para la aplicación del Artículo 6 de la Ley Nº 8131, de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".
6. 6Que el artículo 7 del decreto supra citado dispone que los recursos provenientes de superávit libre, se pueden utilizar en períodos subsiguientes para financiar gastos corrientes siempre que se refieran a actividades ordinarias de la entidad, con los cuales se atienda el interés de la colectividad, el servicio público y los fines institucionales, siempre que no tengan un carácter permanente o generen una obligación que requiera financiarse a través del tiempo, tal y como sucede en el presente caso.
7. 7Que con oficios STAP CIRCULAR-2276-08 de 28 de noviembre de 2008 se comunicó al Fondo, el gasto presupuestario máximo fijado para el 2009, por ¢3.734.080.000,00 (tres mil setecientos treinta y cuatro millones ochenta mil colones exactos).
8. 8Que el señor Ministro Rector del Sector Ambiente, Energía y Telecomunicaciones, mediante el oficio DM-1189-2008 de 13 de octubre de 2008, avala la solicitud planteada por el Fondo de Parques Nacionales.
9. 9Que por lo anterior, resulta necesario modificar el gasto presupuestario máximo fijado al Fondo para el 2009, incrementándolo en la suma de ¢2.613.600.000,00 (dos mil seiscientos trece millones seiscientos mil colones exactos). Por tanto,
