in the entirety of the text - Full Text of Norma 35351 Amends, for the National Parks Fund, the maximum budgetary expenditure for 2009 Full Text of acta: C7D71 No. 35351-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Pursuant to the powers conferred upon them by articles 140 subsections 3) and 18) and 146 of the Political Constitution; articles 25 subsection 1), 27 subsection 1), and 28 subsection 2) paragraph b) of Law No. 6227, General Law of Public Administration of 2 May 1978 and its amendments; Law No. 8131, Law of Financial Administration of the Republic and Public Budgets of 18 September 2001 and its amendments; its Regulation, Decreto Ejecutivo No. 32988-H-MP-PLAN of 31 January 2006 and its amendments; Law No. 6084, Law of the National Parks Service of 24 August 1977 and its amendments; Law No. 7554, Organic Environmental Law of 4 October 1995 and its amendments; Law No. 7788, Biodiversity Law of 30 April 1998 and its amendments; Decreto Ejecutivo No. 32452-H of 29 June 2005 and its amendments; and Decreto Ejecutivo No. 34404-H of 5 March 2008 and its amendments.

Whereas (Considerando):

7554, published in La Gaceta No. 215 of 13 November 1995 and its amendments, establishes that the State must ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it is obligated to promote sustainable economic and environmental development (desarrollo económico y ambientalmente sostenible), understood as development that meets basic human needs without compromising the options of future generations.

6084, published in La Gaceta No. 169 of 7 September 1977 and its amendments, is administered by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), pursuant to the provisions of Law No. 7788, published in La Gaceta No. 101 of 27 May 1998 and its amendments.

32452-H, published in La Gaceta No. 130 of 6 July 2005 and its amendments, the "Guideline for the application of Article 6 of Law No. 8131 on Financial Administration of the Republic and Public Budgets and the regulation of the class of Public Sector revenues denominated Financing (Financiamiento)" was issued.

34404-H, the General Guidelines of Budgetary Policy for the year 2009 were issued, establishing in article 1 of said Decree the budgetary expenditure for the year 2009 for the entities covered by the scope of the Budgetary Authority (Autoridad Presupuestaria).

35072-H, published in La Gaceta No. 79 of 24 April 2009, the maximum budgetary expenditure authorized for the National Parks Fund for the year 2009 was increased, setting it at ¢6,347,680,000.00 (six billion three hundred forty-seven million six hundred eighty thousand exact colones), a figure that does not include the expenses indicated in Considerando 4 of this decree.

10.-That for the foregoing reasons, it is necessary to modify the maximum budgetary expenditure set for the National Parks Fund for the year 2009, increasing it by the sum of ¢1,441,884,567.00 (one billion four hundred forty-one million eight hundred eighty-four thousand five hundred sixty-seven exact colones). Therefore (Por tanto); Decree (Decretan):

35072-H, published in La Gaceta No. 79 of 24 April 2009, is hereby modified, resulting in a maximum budgetary expenditure limit of the sum of ¢7,789,564,567.00 (seven billion seven hundred eighty-nine million five hundred sixty-four thousand five hundred sixty-seven exact colones) for that period.

Considerando:

Asimismo, está obligado a propiciar un desarrollo económico y ambientalmente sostenible, entendido como el desarrollo que satisface las necesidades humanas básicas, sin comprometer las opciones de las generaciones futuras.

10.-Que por lo anterior, resulta necesario modificar el gasto presupuestario máximo fijado al Fondo de Parques Nacionales para el año 2009, incrementándolo en la suma de ¢1.441.884.567,00 (mil cuatrocientos cuarenta y un millones ochocientos ochenta y cuatro mil quinientos sesenta y siete colones exactos). Por tanto;

Decretan:

Dado en la Presidencia de la República, a los dieciséis días del mes de junio del año dos mil nueve.

Artículo 1 — The maximum budgetary expenditure for 2009 for the National Parks Fund, established in Decreto Ejecutivo No.

Artículo 2 — It is the responsibility of the active administration of the National Parks Fund to comply with the provisions of article 6 of Law No.

Artículo 3 — It shall enter into force upon its publication.

Artículo 1 — Que la Ley Nº 7554, publicada en La Gaceta Nº 215 de 13 de noviembre de 1995 y sus reformas, establece que el Estado debe velar por la utilización racional de los elementos ambientales, con el fin de proteger y mejorar la calidad de vida de los habitantes del territorio nacional.

Artículo 3 — Rige a partir de su publicación.
