1That in accordance with Law No. 7384, the Law Creating Incopesca, and Law No. 8436, the Fisheries and Aquaculture Law, it is the power and authority of Incopesca to establish, according to technical, scientific, economic, and social criteria, the zones or seasons for closures (veda), whether by Areas or by specific species, for the purpose of protecting and utilizing hydrobiological resources in a sustainable manner.
2That it is technically demonstrated that one of the forms of management and protection of hydrobiological resources for sustainable use, is by establishing closure (veda) periods and areas.
3That the Gulf of Nicoya is considered one of the most important fishing zones in the country.
4That it has been considered pertinent to restructure the Permanent Advisory Commission established by agreement No. AJDIP/565-2006, whose main mission and objective is the study, analysis, and formulation of recommendations for the regulation and sustainable use of the Gulf of Nicoya, which must expand its coverage to the national level. Therefore,

AGREES:

Considering:

a- Two representatives of small-scale fishers of the Gulf of Nicoya, one representing the inner part (Zone 201) and another representative of the Islands, Costa de Pájaros, Chomes, Jicaral, and surrounding fishing communities (Zone 202) b- One representative of the sardine semi-industrial fishers c- One representative of sport and tourist fishing.

d- The Head of the Department of Research and Development of Incopesca.

e- The Head of the Department of Registration of Incopesca.

f- The Head of the Department of Fisheries and Aquaculture Extension of Incopesca, who will be the Coordinator of this Commission g- One representative of the National Coast Guard Service (Servicio Nacional de Guardacostas) h- One representative of the Joint Institute for Social Aid (Instituto Mixto de Ayuda Social).

a)Be of legal age, b) Be Costa Rican by birth or by naturalization, with no less than ten years of residence in the country, c) Have extensive experience or knowledge in fisheries matters and hold a valid fishing license.

a)Debtors of Incopesca.
b)Those who have been declared bankrupt or insolvent; those convicted of crimes against property or for embezzlement or misappropriation of funds.
c)Those who are related by kinship, by consanguinity or affinity up to the third degree inclusive, with other members of the Board of Directors or with the Auditor.

a)For being in any of the circumstances set forth in Article 4 of this agreement.
b)For having failed to attend three ordinary sessions, without justified cause.
c)For being responsible, by final judgment, for the infraction of any of the provisions contained in the laws, decrees, or regulations applicable to the Institute.
d)For being responsible, by final judgment, for fraudulent or illegal acts or operations.
e)For being declared legally incapacitated.

If so, it shall proceed to appoint the person to fill the vacancy for the remainder of the legal term.

Likewise, it shall meet in extraordinary session when absolutely necessary, upon convocation by the Coordinator by means of written communication presented at least forty-eight hours in advance.

The agreements shall be adopted by a simple majority of those present. In case of a tie, the Coordinator shall decide and for this purpose shall have a double vote.

a)Directing and keeping minutes of the commission sessions, b) Proposing the work agenda, c) Convening an ordinary session on the date and time that has been agreed upon for that purpose, and an extraordinary session with no less than 48 hours in advance, d) Presenting to the Board of Directors the reports and recommendations issued by the Commission, or that are requested of it. The recommendations for the establishment of closures (vedas) must be presented to the Board of Directors, at least 45 calendar days before the deadline proposed for their start or establishment e) Carrying out any infra- and inter-institutional coordination that may be required as a result of the agreements of the Commission.
f)Presenting an evaluation report on the result of the closures (vedas) implemented within a period no longer than 30 business days after their completion.

Final agreement.

Transitional Provision.-Within the peremptory period of eight calendar days, counted from the entry into force of this agreement, the Fisheries Organizations must send to the Executive Presidency of Incopesca, the respective shortlists (ternas) for their corresponding designation.

1Que de conformidad con la Ley N° 7384, Ley de Creación del Incopesca y la Ley N° 8436, Ley de Pesca y Acuicultura, es atribución y competencia del Incopesca establecer conforme a criterios técnicos, científicos, económicos y sociales, las zonas o épocas de veda, sea por Áreas o por especies determinadas, a fin de proteger y aprovechar los recursos hidrobiológicos de manera sostenible.
2Que esta técnicamente demostrado que una de las formas de manejo y protección de los recursos hidrobiológicos un aprovechamiento sostenible, es estableciendo períodos y áreas de veda.
3Que el Golfo de Nicoya es considerado una de las zonas pesqueras más importantes del país.
4Que se ha considerado pertinente reestructurar la Comisión Aseso ra Permanente establecida mediante acuerdo Nº AJDIP/565-2006, cuya principal misión y objetivo es el estudio, análisis y formulación de recomendaciones para la regulación y aprovechamiento sostenible del Golfo de Nicoya, la cual debe ampliar su cobertura a nivel nacional. Por tanto,

ACUERDA:

Considerando:

a- Dos representantes de pescadores en pequeña escala del Golfo de Nicoya, uno en representación de la parte interna (Zona 201) y otro representante de las Islas, Costa de Pájaros, Chomes, Jicaral y comunidades pesqueras circunvecinas (Zona 202) b- Un representante de los pescadores semiindustriales de sardina c- Un representante de la pesca deportiva y turística.

d- La Jefatura del Departamento de Investigación y Desarrollo del Incopesca.

e- La Jefatura del Departamento de Registro del Incopesca.

f- La Jefatura del Departamento de Extensión Pesquera y Acuícola del Incopesca, quien será el Coordinador de esta Comisión g- Un representante del Servicio Nacional de Guardacostas h- Un representante del Instituto Mixto de Ayuda Social.

a)Ser mayor de edad, b) Ser costarricense por nacimiento o por naturalización, con no menos de diez años de residencia en el país, c) Tener amplia experiencia o conocimientos en materia pesquera y tener licencia de pesca vigente.

a)Los deudores del Incopesca.
b)Quienes hayan sido declarados en estado de quiebra o insolvencia; los condenados por delitos contra la propiedad o por peculado o malversación de fondos.
c)Quienes estén ligados por parentesco, por consanguinidad o afinidad hasta el tercer grado inclusive, con otros miembros de la Junta Directiva o con el Auditor.

a)Por encontrarse en alguno de los supuestos del artículo 4 de este acuerdo.
b)Por haber dejado de concurrir a tres sesiones ordinarias, sin causa justificada.
c)Por ser responsable, por sentencia firme, de la infracción de alguna de las disposición contenidas en la leyes, decretos o reglamentos aplicables al Instituto.
d)Por ser responsable, por sentencia firme, de actos u operaciones fraudulentas o ilegales.
e)Por ser declarado legalmente incapaz.

De ser así, procederá a nombrar a la persona para llenar la vacante para el resto del período legal.

Asimismo, sesionarán en forma extraordinaria cuando sea absolutamente necesario, por convocatoria del Coordinador mediante comunicación escrita presentada por lo menos con cuarenta y ocho horas de antelación.

Los acuerdos se tomarán por simple mayoría de los presentes. En caso de empate, el Coordinador resolverá y para ello tendrá doble voto.

a)Dirigir y llevar actas de las sesiones de la comisión, b) Proponer la agenda de trabajo, c) Convocar a sesión ordinaria en la fecha y hora que para tal efecto se haya acodado y a sesión extraordinaria con no menos de 48 horas de antelación, d) Presentar a la Junta Directiva los informes y recomendaciones emitidas por la Comisión, o que le sean solicitadas. Las recomendaciones para el establecimiento de las vedas deberán ser presentadas ante la Junta Directiva, con al menos 45 días naturales antes del plazo propuesto para su inicio o establecimiento e) Realizar toda aquella coordinación infra e interinstitucional que se requiera como resultados de los acuerdos de la Comisión.
f)Presentar un informe de evaluación del resultado de las vedas implementadas en un plazo no mayor de 30 días hábiles posteriores a su finalización.

Acuerdo firme.

Transitorio.-En el tiempo perentorio de ocho días calendario, contados a partir de la entrada en vigencia del presente acuerdo, las Organizaciones Pesqueras deberán remitir a la Presidencia Ejecutiva del Incopesca, las ternas respectivas para su correspondiente designación.

Artículo 2 — Said Commission will be comprised of:

Artículo 3 — To be a member of this Commission, the representatives of the fisheries subsectors must meet the following requirements:

Artículo 4 — The following may not be appointed as representatives of the Fisheries Subsectors on this Commission:

Artículo 5 — If, subsequent to the appointment, the existence of any of the impediments referred to in the preceding article is verified, the designation of the respective member shall be rendered void.

Artículo 6 — In any of the cases specified in Article 4, it shall be the responsibility of the Executive Presidency (Presidencia Ejecutiva) to declare or not the loss of the status of member.

Artículo 7 — The members of this Commission shall serve in their positions for two years and may be reelected.

Artículo 8 — The members of this Commission may be removed during the period for which they were appointed, for the following reasons:

Artículo 9 — In any of the cases cited above, it shall be the responsibility of the Executive Presidency of Incopesca to determine whether or not the separation from the position proceeds.

Artículo 10 — This Commission shall meet on an honorary basis (ad honorem), in ordinary session once a month, at the place, day, and time determined.

Artículo 11 — The quorum shall be formed by five of its members.

Artículo 13 — Any agreement that opposes this agreement is hereby repealed.

Artículo 14 — It shall take effect upon its publication in the Official Gazette (Diario Oficial).

Artículo 2 — Dicha Comisión estará conformada por:

Artículo 3 — Para ser miembro de este Comisión, los representantes de los subsectores de pesca deberán cumplir con los siguientes requisitos:

Artículo 4 — No podrán designarse como representantes de los Subsectores de Pesca en este Comisión a:

Artículo 5 — Cuando con posterioridad al nombramiento se compruebe la existencia de alguno de los impedimentos a los que se refiere el artículo anterior, quedará sin efecto la designación del miembro respectivo.

Artículo 6 — En cualquiera de los casos especificados en el artículo 4, le corresponderá a la Presidencia Ejecutiva declarar o no la pérdida de la condición de miembro.

Artículo 7 — Los miembros de esta Comisión durará en sus cargos dos años y podrán ser reelegidos.

Artículo 8 — Los miembros de esta Comisión podrán ser removidos durante el período para el cual fueron designados, por las siguientes razones:

Artículo 9 — En cualquiera de los casos citados anteriormente corresponderá a la Presidencia Ejecutiva del Incopesca, determinar si procede o no la separación del cargo.

Artículo 10 — Esta Comisión se reunirá en forma adhonorem, en sesión ordinaria una vez al mes, en el lugar, día y hora que se determine.

Artículo 11 — El quórum lo formarán cinco de sus miembros.

Artículo 12 — El Director General Técnico del Incopesca o el Subdirector, fungirá como coordinador de dicha Comisión y tendrá la responsabilidad de convocar y procurar las mayores facilidades dentro de las posibilidades de la Institución y le corresponderá:

Artículo 13 — Se deroga cualquier acuerdo que se oponga al presente acuerdo.

Artículo 14 — Rige a partir de su publicación en el Diario Oficial.
