in the entirety of the text - Complete Text of Norm 34178 Modifies for the National Parks Fund, the maximum budget expenditure set for the year 2008 Complete Text of acta: BFA41 Nº 34178 Nº 34178 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred upon them by articles 140, subsections 3) and 18) and 146 of the Political Constitution; articles 25, subsection l); 27, subsection l) and 28, subsection 2), paragraph b) of Law Nº 6227, General Law of Public Administration of May 2, 1978 and its amendments; Law Nº 8131, Financial Administration of the Republic and Public Budgets Law of September 18, 2001 and its amendments; its Regulation, Decreto Ejecutivo Nº 32988-H-MP-PLAN of January 31, 2006 and its amendments; Law Nº 6084, National Parks Service Law of August 24, 1977 and its amendments; Law Nº 7554, Organic Law of the Environment of October 4, 1995 and its amendments; Law Nº 7788, Biodiversity Law of April 30, 1998; Decreto Ejecutivo Nº 32452-H of June 29, 2005 and its amendments and Decreto Ejecutivo Nº 33646-H of March 9, 2007 and its amendments.

1. 1That the Organic Law of the Environment Nº 7554, published in La Gaceta Nº 215 of November 13, 1995, establishes that the State must ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it is obliged to foster economically and environmentally sustainable development, understood as development that satisfies basic human needs, without compromising the options of future generations.
2. 2That the National Parks Fund created through Law Nº 6084, National Parks Service Law, published in La Gaceta Nº 169 of September 7, 1977, is administered by the Sistema Nacional de Áreas de Conservación, as established in Law Nº 7788, Biodiversity Law, published in La Gaceta Nº 101 of May 27, 1998.
3. 3That the National Parks Fund requires incorporating additional resources to address operational expenses in different protected wild areas, and therefore requests to increase the maximum budget expenditure approved for 2008, by ¢535,870,000.00 (five hundred thirty-five million eight hundred seventy thousand exact colones).
4. 4That the amounts to be incorporated will be financed with own resources in the amount of ¢31,350,000.00 (thirty-one million three hundred fifty thousand exact colones) which will finance expenses in services; and with Free Surplus (Superávit Libre) resources, expenses in machinery, equipment and furniture, other constructions, additions and improvements, and maintenance services will be financed, for the sum of ¢504,520,000.00 (five hundred four million five hundred twenty thousand exact colones).
5. 5That through Decreto Ejecutivo Nº 32452-H and its amendments, published in La Gaceta Nº 130 of July 6, 2005, the "Guideline for the application of article 6 of Law Nº 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the class of Public Sector revenues called Financing (Financiamiento)" is issued.
6. 6That article 7 of the aforementioned decree provides that resources from free surplus (superávit libre) form part of the equity of the organs and entities and may be used in subsequent periods to finance expenses related to their ordinary activity, which serve the interest of the community, public service, and institutional purposes, which, like those included herein, are not of a permanent nature nor generate an obligation that requires financing over time.
7. 7That through Decreto Ejecutivo Nº 33646-H and its amendments, published in La Gaceta Nº 58 of March 22, 2007, the General Budgetary Policy Guidelines for the year 2008 were issued, establishing in article 1 of the cited Decree, the maximum budget expenditure for the year 2008 for the institutions covered by the scope of the Budgetary Authority (Autoridad Presupuestaria).
8. 8That by official communication STAP-0795-07 of April 26, 2007, the National Parks Fund was notified of the maximum budget expenditure authorized for the year 2008, in the amount of ¢3,106,490,000.00 (three billion one hundred six million four hundred ninety thousand exact colones), which does not contemplate the additional expenses the institution needs to incur.
9. 9That the Rector Minister of the Environment, Energy, and Telecommunications Sector, through official communication DM-1187-07 of September 25, 2007, endorses the request made by the National Parks Fund.

10.-That because of the foregoing, it is necessary to modify the maximum budget expenditure set for the National Parks Fund for the year 2008. Therefore,

1. 1Que la Ley Orgánica del Ambiente Nº 7554, publicada en La Gaceta Nº 215 del 13 de noviembre de 1995, establece que el Estado debe velar por la utilización racional de los elementos ambientales, con el fin de proteger y mejorar la calidad de vida de los habitantes del territorio nacional. Asimismo, está obligado a propiciar un desarrollo económico y ambientalmente sostenible, entendido como el desarrollo que satisface las necesidades humanas básicas, sin comprometer las opciones de las generaciones futuras.
2. 2Que el Fondo de Parques Nacionales creado mediante Ley Nº 6084, Ley del Servicio de Parques Nacionales, publicada en La Gaceta Nº 169 del 7 de setiembre de 1977, está administrado por el Sistema Nacional de Áreas de Conservación, según lo establecido en la Ley Nº 7788, Ley de Biodiversidad, publicada en La Gaceta Nº 101 del 27 de mayo de 1998.
3. 3Que el Fondo de Parques Nacionales requiere incorporar recursos adicionales para atender gastos operativos en diferentes áreas silvestres protegidas, por lo que solicita incrementar el gasto presupuestario máximo aprobado para el 2008, en ¢535.870.000,00 (quinientos treinta y cinco millones ochocientos setenta mil colones exactos).
4. 4Que los montos a incorporar se financiarán con recursos propios por un monto de ¢31.350.000,00 (treinta y un millones trescientos cincuenta mil colones exactos) los cuales financiarán gastos en servicios; y con recursos de Superávit Libre se financiarán gastos en maquinaria, equipo y mobiliario, otras construcciones, adiciones y mejoras y servicios de mantenimiento, por la suma de ¢504.520.000,00 (quinientos cuatro millones quinientos veinte mil colones exactos).
5. 5Que mediante el Decreto Ejecutivo Nº 32452-H y sus reformas, publicado en La Gaceta Nº 130 del 6 de julio de 2005, se emite el "Lineamiento para la aplicación del artículo 6º de la Ley Nº 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".
6. 6Que el artículo 7º del decreto supracitado, dispone que los recursos provenientes del superávit libre forman parte del patrimonio de los órganos y las entidades y pueden utilizarlos en períodos subsiguientes para financiar gastos que se refieran a su actividad ordinaria, con los cuales se atienda el interés de la colectividad, el servicio público y los fines institucionales, que como los aquí incluidos, no tienen carácter permanente ni generan una obligación que requiera financiarse a través del tiempo.
7. 7Que mediante el Decreto Ejecutivo Nº 33646-H y sus reformas, publicado en La Gaceta Nº 58 del 22 de marzo de 2007, se emitieron las Directrices Generales de Política Presupuestaria para el año 2008, estableciéndose en el artículo 1º del citado Decreto, el gasto presupuestario máximo para el año 2008 para las instituciones cubiertas por el ámbito de

la Autoridad Presupuestaria.

1. 8Que con el oficio STAP-0795-07 del 26 de abril de 2007, se comunicó al Fondo de Parques Nacionales el gasto presupuestario máximo autorizado para el año 2008, por un monto de ¢3.106.490.000,00 (tres mil ciento seis millones cuatrocientos noventa mil colones exactos), el cual no contempla los gastos adicionales que la institución requiere realizar.
2. 9Que el señor Ministro Rector del Sector Ambiente, Energía y Telecomunicaciones, mediante el oficio DM-1187-07 del 25 de setiembre de 2007, avala la solicitud planteada por el Fondo de Parques Nacionales.

10.-Que por lo anterior, resulta necesario modificar el gasto presupuestario máximo fijado para el Fondo de Parques Nacionales para el año 2008. Por tanto,
