in the entirety of the text - Complete Text of Norm 34743 Amends for the National Parks Fund the maximum budgetary expenditure set for the year 2008 Complete Text of act: BFA3E Nº 34743-H Nº 34743-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Pursuant to the powers vested in them by articles 140, subsections 3) and 18) and 146 of the Political Constitution; articles 25, subsection 1), 27, subsection 1) and 28, subsection 2) subparagraph b) of Law Nº 6227, the General Law of Public Administration of 2 May 1978 and its amendments; Law Nº 8131, the Law of the Financial Administration of the Republic and Public Budgets of 18 September 2001 and its amendments; its Regulations, Executive Decree Nº 32988-H-MP-PLAN of 31 January 2006 and its amendments; Law Nº 6084, the Law of the National Parks Service of 24 August 1977 and its amendments; Law Nº 7554, the Organic Law of the Environment of 4 October 1995 and its amendments; Law Nº 7788, the Biodiversity Law of 30 April 1998; Executive Decree Nº 32452-H of 29 June 2005 and its amendments, Executive Decree Nº 33646-H of 9 March 2007 and its amendments.

1. 1That the Organic Law of the Environment Nº 7554, published in La Gaceta Nº 215 of 13 November 1995 and its amendments, establishes that the State must ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it is obliged to promote an economically and environmentally sustainable development, understood as development that satisfies basic human needs, without compromising the options of future generations.
2. 2That the National Parks Fund created through Law Nº 6084, the Law of the National Parks Service, published in La Gaceta Nº 169 of 7 September 1977 and its amendments, is administered by the National System of Conservation Areas, as established in Law Nº 7788, the Biodiversity Law, published in La Gaceta Nº 101 of 27 May 1998.
3. 3That the National Parks Fund requires incorporating additional resources to meet operating expenses in the following line items: payment of services, materials and supplies, and current transfers, and therefore requests an increase in the maximum budgetary expenditure approved for 2008, in the amount of ¢577,580,000.00 (exactly five hundred seventy-seven million five hundred eighty thousand colones).
4. 4That of the amount cited in the preceding considerando, ¢397,580,000.00 (exactly three hundred ninety-seven million five hundred eighty thousand colones) correspond to own resources coming from the increase in entrance fees to Protected Wild Areas, authorized through Executive Decree Nº 34164-MINAE, published in La Gaceta Nº 7 of 10 January 2008, with which they will finance expenses in the line items of services, materials and supplies, and current transfers, and ¢180,000,000.00 (exactly one hundred eighty million colones) coming from Free Surplus, which will be allocated to expenses in transportation equipment.
5. 5That through Executive Decree Nº 32452-H, published in La Gaceta Nº 130 of 6 July 2005 and its amendments, the Guideline for the application of article 6 of Law Nº 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the class of revenues of the Public Sector called Financing is issued.
6. 6That article 7 of the above-cited Decree provides that the resources coming from the free surplus form part of the equity of the organs and entities and can be used in subsequent periods to finance expenses referring to their ordinary activity, with which the interest of the community, the public service, and the institutional purposes are served, which, like those included herein, do not have a permanent character nor generate an obligation that requires financing over time.
7. 7That through Executive Decree Nº 33646-H, published in La Gaceta Nº 58 of 22 March 2007 and its amendments, the General Budgetary Policy Directives for the year 2008 were issued, establishing in article 1 of the cited Decree, the maximum budgetary expenditure for the year 2008 for the institutions covered by the scope of the Budgetary Authority.
8. 8That through Executive Decree Nº 34178-H, published in La Gaceta Nº 34 of 18 February 2008, the maximum budgetary expenditure authorized for the National Parks Fund for the year 2008 was modified, setting it at the sum of ¢3,642,360,000.00 (exactly three billion six hundred forty-two million three hundred sixty thousand colones).
9. 9That the Rector Minister of the Environment, Energy and Telecommunications Sector, through official communication DM-477-2008 of 8 May 2008, endorses the request made by the National Parks Fund.

10.-That due to the foregoing, it is necessary to modify the maximum budgetary 2008, increasing it by the sum of ¢577,580,000.00 (exactly five hundred seventy-seven million five hundred eighty thousand colones). Therefore, THEY DECREE:

Considering:

1. 1Que la Ley Orgánica del Ambiente Nº 7554, publicada en La Gaceta Nº 215 de 13 de noviembre de 1995 y sus reformas, establece que el Estado debe velar por la utilización racional de los elementos ambientales, con el fin de proteger y mejorar la calidad de vida de los habitantes del territorio nacional. Asimismo, está obligado a propiciar un desarrollo económico y ambientalmente sostenible, entendido como el desarrollo que satisface las necesidades humanas básicas, sin comprometer las opciones de las generaciones futuras.
2. 2Que el Fondo de Parques Nacionales creado mediante Ley Nº 6084, Ley del Servicio de Parques Nacionales, publicada en La Gaceta Nº 169 de 7 de setiembre de 1977 y sus reformas, está administrado por el Sistema Nacional de Áreas de Conservación, según lo establecido en la Ley Nº 7788, Ley de Biodiversidad, publicada en La Gaceta Nº 101 de 27 de mayo de 1998.
3. 3Que el Fondo de Parques Nacionales requiere incorporar recursos adicionales para atender gastos operativos en las siguientes partidas: pago de servicios, materiales y suministros y transferencias corrientes, por lo que solicita incrementar el gasto presupuestario máximo aprobado para el 2008, en ¢577.580.000,00 (quinientos setenta y siete millones quinientos ochenta mil colones exactos).
4. 4Que del monto citado en el considerando anterior, ¢397.580.000,00 (trescientos noventa y siete millones quinientos ochenta mil colones exactos) corresponden a recursos propios provenientes del aumento en las tarifas de entrada a las Áreas Silvestres Protegidas, autorizadas mediante el Decreto Ejecutivo Nº 34164-MINAE, publicado en La Gaceta Nº 7 de 10 de enero de 2008, con los cuales financiarán gastos en las partidas de servicios, materiales y suministros y transferencias corrientes y ¢180.000.000,00 (ciento ochenta millones de colones exactos) provenientes de Superávit Libre, que se destinarán a gastos en equipo de transporte.
5. 5Que mediante el Decreto Ejecutivo Nº 32452-H, publicado en La Gaceta Nº 130 de 6 de julio de 2005 y sus reformas, se emite el Lineamiento para la aplicación del artículo 6º de la Ley Nº 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento.
6. 6Que el artículo 7º del Decreto supra citado, dispone que los recursos provenientes del superávit libre forman parte del patrimonio de los órganos y las entidades y pueden utilizarlos en períodos subsiguientes para financiar gastos que se refieran a su actividad ordinaria, con los cuales se atienda el interés de la colectividad, el servicio público y los fines institucionales, que como los aquí incluidos, no tienen carácter permanente ni generan una obligación que requiera financiarse a través del tiempo.
7. 7Que mediante el Decreto Ejecutivo Nº 33646-H, publicado en La Gaceta Nº 58 de 22 de marzo de 2007 y sus reformas, se emitieron las Directrices Generales de Política Presupuestaria para el año 2008, estableciéndose en el artículo 1º del citado Decreto, el gasto presupuestario máximo del año 2008 para las instituciones cubiertas por el ámbito de la Autoridad Presupuestaria.
8. 8Que mediante el Decreto Ejecutivo Nº 34178-H, publicado en La Gaceta Nº 34 de 18 de febrero de 2008, se modificó el gasto presupuestario máximo autorizado al Fondo de Parques Nacionales para el año 2008, fijándolo en la suma de ¢3.642.360.000,00 (tres mil seiscientos cuarenta y dos millones trescientos sesenta mil colones exactos).
9. 9Que el señor Ministro Rector del Sector Ambiente, Energía y Telecomunicaciones, mediante el oficio DM-477-2008 de 8 de mayo de 2008, avala la solicitud planteada por el Fondo de Parques Nacionales.

10.-Que por lo anterior, resulta necesario modificar el gasto presupuestario máximo fijado para el Fondo de Parques Nacionales para el año 2008, incrementándolo en la suma de ¢577.580.000,00 (quinientos setenta y siete millones quinientos ochenta mil colones exactos). Por tanto,
