1st-That the accelerated increase in solid waste and its inadequate management generates serious damage to health and serious environmental impacts, deteriorating the quality of life and also causing high costs for its proper treatment, collection, and transportation.

2nd-That the proper final disposal of solid waste in the country, as well as its collection and transport, is a serious problem that severely threatens public health, life, and a healthy and ecologically balanced environment.

3rd-That a sustainable solution to the problem is based on education for the recovery of recyclable materials, through their separation and separate collection.

4th-That the recovery of materials may be utilized by organized groups or responsible companies, previously authorized.

Therefore, this Municipal Council agrees to approve the following:

REGULATION FOR THE DISCRIMINATED MANAGEMENT OF WET AND DRY SOLID WASTE IN THE CANTON OF CURRIDABAT (Published as a public consultation in La Gaceta No. 202 of Monday, October 22, 2007)

General Provisions

Considering:

CHAPTER I

Temporary Storage (Almacenamiento Temporal). It is the place designated for the temporary accumulation of solid waste, in apartment buildings, condominiums, or commercial premises.

Urban Cleanliness (Aseo Urbano). These are the activities of sweeping the curb and gutter, cleaning storm sewers, parks, green areas in public educational centers, rivers and streams, as well as vacant lots due to omission by the owners; moreover, the collection of bulky or non-traditional waste.

Collection Center (Centro de Acopio). It is the place used for the storage, classification, and temporary commercialization of usable or recyclable materials.

Placement (Colocación). It is the disposal of waste in containers or bags at the site of its generation, for subsequent collection according to the collection schedule defined by the Municipality.

Container (Contenedor). It is the device used to place the containers of wet and dry solid waste until their collection; they can be baskets, drums, enclosures, or similar.

Environmental Affairs Commission (Comisión de Asuntos Ambientales). It is the permanent commission of the Municipal Council that must propose and formulate the guidelines for the environmental management of the Municipality, in conjunction with the Mayor's Office and the Operations Directorate (Dirección de Operaciones).

Composting (Compostaje). It is the process of biological degradation under aerobic conditions of the organic matter present in biodegradable solid waste.

Wet Solid Waste (Residuos Sólidos Húmedos). This classification includes all wet solid waste of an organic type and waste that is not recyclable.

Dry or Recyclable Solid Waste (Desechos Sólidos Secos o Reciclables). Solid waste that can be reintegrated into nature or into production processes, without harm to human health or the environment, such as paper, cardboard, glass, aluminum, and plastics.

Garden Waste. These are wastes from the cleaning and clearing of gardens and green areas on private lots, including grass, leaves, stems, and branches from shrubs and trees. They do not include trunks more than 10 centimeters in diameter.

Biohazardous Waste (Desechos Bio Peligrosos). It is that which, due to its characteristics and composition, can be a reservoir or vehicle of infection. Among them, those from medical/dental offices and clinics, veterinary clinics, and clinical and pharmaceutical laboratories.

Bulky or Non-Traditional Waste (Desechos Voluminosos o No Tradicionales). Those objects disposed of by their owners sporadically, having reached the end of their useful life, which due to their size and weight are not suitable for ordinary collection, such as metal scrap.

Special Solid Waste (Desechos Sólidos Especiales). Includes biohazardous, toxic, combustible, flammable, objects or elements that, due to their size, volume, or weight, require special management, like commercial, industrial waste, debris (escombros), and others.

Final Disposal (Disposición Final). It is the controlled and environmentally adequate operation of definitively depositing, treating, and/or confining the waste, according to its nature.

Debris (Escombros). This is waste from demolition and construction activities.

Generators of Solid Waste (Generadores de Desechos Sólidos). Corresponds to the users of the collection, transport, and treatment system for wet and dry solid waste, whether or not they are citizens of the canton.

Discriminated Management (Manejo Discriminado). A set of actions aimed at reducing the amounts of waste to be treated in a sanitary landfill through the organization of separation, collection, and utilization and/or recycling of usable materials for their commercialization.

Municipality. Municipality of Curridabat.

(*) Environmental Services Directorate (Dirección de Servicios Ambientales). Entity attached to the Mayor's office responsible, among other functions, for compliance with the environmental regulations applicable to the local government and for collaborating with the definition of policies in the environmental field.

(*)(Its name was modified through session No. 105 of April 29, 2008) Recipient (Recipiente). It is the receptacle used to store waste until its collection, such as plastic bags, buckets with lids, or similar.

Wet Solid Waste Collection Service (Servicio de Recolección Residuos Sólidos Húmedos). Regular collection service for wet solid waste provided by the Municipality in the canton of Curridabat.

Dry or Recyclable Solid Waste Collection Service (Servicio de Recolección Residuos Sólidos Secos o Reciclables): Regular collection service for dry solid waste provided by the Municipality in the canton.

Special Collection Service (Servicio Especial de Recolección). Discriminated collection service for specific materials such as garden waste, batteries, metals, debris (escombros), etc.

On the Promotion and Organization of the Discriminated Management of Solid Waste

CHAPTER II

Furthermore, for these purposes, the Municipality shall establish and maintain a registry of providers of said services.

Likewise, it shall incorporate into the Annual Operating Plan (Plan Anual Operativo) all related actions aimed at compliance with this Regulation.

On the placement of wet and dry solid waste for its collection

CHAPTER III

Cardboard boxes must be folded and tied.

On the generators of large quantities of waste

CHAPTER IV

To guarantee the above, the waste containers (contenedores) must have the necessary and sufficient dimensions to avoid excess garbage outside of them, and furthermore, offer the location that best guarantees access for collection trucks, in accordance with the topographical characteristics of the site and the construction features of the premises in question. The aforementioned containers (contenedores) must be located on the private property but adjacent to the sidewalk, as otherwise, the Municipality will not provide the service.

On the Collection Centers (Centros de Acopio)

CHAPTER V

The commercial collection centers (centros de acopio) must also have their respective municipal business license (patente municipal).

On special and biohazardous waste

CHAPTER VI

All of the above, framed within strict compliance with and adherence to the existing regulations on the matter, as well as any other guideline that the cited Ministry may issue on the subject.

Any failure to comply with the above will imply the application of the corresponding sanctions.

On the responsibilities of the Municipality

Said deposit shall be returned when the organizers prove the state of cleanliness, the morning following the activity, through the approval of the (*)Environmental Services Directorate (Dirección de Servicios Ambientales).

Likewise, the Administration is obliged to comply with articles 134, 135, 136, 137, 139, and 141 of the Municipal Code, regarding the evaluation and qualification of the service and the application of incentives and sanctions to municipal officials.

In the event that waste obstructs the sidewalk or pedestrian walkways, the Municipality shall apply the fines stipulated in the Regulation for the Collection of the Fee for Omissions of the Duties of Owners of Real Estate located in the canton of Curridabat.

1Que el acelerado aumento de los desechos sólidos y su manejo inadecuado, genera graves daños a la salud y serios impactos ambientales, deteriorando la calidad de vida y provocando además altos costos para su adecuado tratamiento, recolección y transporte.
2Que la adecuada disposición final de los desechos sólidos en el país, así como su recolección y acarreo es un serio problema que atenta severamente contra la salud pública, la vida y un ambiente sano y ecológicamente equilibrado.
3Que una solución sostenible del problema se basa en la educación para la recuperación de los materiales reciclables, por medio de su selección y recolección por separado.
4Que la recuperación de los materiales podrá ser aprovechada por grupos organizados o por empresas responsables, previamente autorizadas.

Por tanto, este Concejo Municipal acuerda aprobar el siguiente:

REGLAMENTO PARA EL MANEJO DISCRIMINADO DE LOS RESIDUOS SÓLIDOS HÚMEDOS Y SECOS EN EL CANTÓN DE CURRIDABAT (Publicado como consulta pública en La Gaceta Nº 202 del lunes 22 de octubre del 2007)

Generalidades

Considerando:

CAPÍTULO I

Almacenamiento Temporal. Es el lugar designado para la acumulación temporal de los desechos sólidos, en edificios de apartamentos, condominios o locales comerciales.

Aseo Urbano. Son las actividades de barrido del cordón y caño, limpieza de alcantarillados pluviales, parques, áreas verdes en centros educativos públicos, ríos y quebradas, así como en lotes baldíos por omisión de los propietarios; además, la recolección de los desechos voluminosos o no tradicionales.

Centro de Acopio. Es el lugar que se utiliza para el almacenamiento, clasificación y comercialización temporal de los materiales aprovechables o reciclables.

Colocación. Es la disposición de los desechos en recipientes o bolsas en el sitio de su generación, para su recolección posterior de acuerdo al horario de recolección definido por la Municipalidad.

Contenedor. Es el dispositivo usado para colocar los recipientes de residuos sólidos húmedos y secos hasta su recolección, pueden ser canastas, estañones, encierros o similares.

Comisión de Asuntos Ambientales. Es la comisión permanente del Concejo Municipal que debe plantear y formular las pautas de la gestión ambiental de la Municipalidad, en conjunto con la Alcaldía y la Dirección de Operaciones.

Compostaje. Es el proceso de degradación biológico bajo condiciones aeróbicas de la materia orgánica presente en los desechos sólidos biodegradables.

Residuos Sólidos Húmedos. Esta clasificación incluye todos los desechos sólidos húmedos de tipo orgánico y los desechos que no son reciclables.

Desechos Sólidos Secos o Reciclables. Desechos sólidos que pueden ser reintegrados a la naturaleza o, a procesos productivos, sin perjuicio para la salud humana o el medio ambiente, tales como papel, cartón, vidrio, aluminio y plásticos.

Desechos de Jardines. Son desechos provenientes de la limpieza y chapea de jardines y áreas verdes en lotes privados, incluyendo zacate, hojas, tallos y ramos de arbustos y arboleda. No incluyen troncos de más de 10 centímetros de diámetro.

Desechos Bio Peligrosos. Es aquel que por sus características y composición puede ser reservorio o vehículo de infección. Entre ellos los provenientes de consultorios y clínicas médicas/odontológicos, veterinarias y de laboratorios clínicos y farmacéuticos.

Desechos Voluminosos o No Tradicionales. Son aquellos objetos dispuestos por sus propietarios en forma esporádica, al haber terminado su vida útil, los cuales por su tamaño y peso no son aptos para la recolección ordinaria, tales como chatarra metálicas.

Desechos Sólidos Especiales. Incluyen los residuos biopeligrosos, tóxicos, combustibles, inflamables, objetos o elementos que por su tamaño, volumen o peso requieren un manejo especial, como desechos comerciales, industriales, escombros y otros.

Disposición Final. Es la operación controlada y ambientalmente adecuada de depositar, tratar y o confinar definitivamente los desechos, según su naturaleza.

Escombros. Son desechos provenientes de las actividades de demolición y construcción.

Generadores de Desechos Sólidos. Corresponde a los usuarios del sistema de recolección, acarreo y tratamiento de desechos sólidos húmedos y secos, sean o no ciudadanos del cantón.

Manejo Discriminado. Conjunto de acciones tendientes a reducir las cantidades de desechos a ser tratados en un relleno sanitario por medio de la organización de la separación, recolección y utilización y/o reciclaje de los materiales aprovechables para su comercialización.

Municipalidad. Municipalidad de Curridabat.

(*) Dirección de Servicios Ambientales. Entidad adscrita al despacho del Alcalde responsable entre otras funciones, del cumplimiento de la normativa ambiental aplicable al gobierno local y de colaborar con la definición de políticas en el campo ambiental.

(*)(Modificada su denominación mediante sesión N° 105 del 29 de abril de 2008) Recipiente. Es el contenedor usado para almacenar los desechos hasta su recolección, como son bolsas plásticas, baldes con tapa, o similares.

Servicio de Recolección Residuos Sólidos Húmedos. Servicio regular de recolección de los desechos sólidos húmedos que presta la Municipalidad en el cantón de Curridabat.

Servicio de Recolección Residuos Sólidos Secos o Reciclables: Servicio regular de recolección de los desechos sólidos secos que presta la Municipalidad en el cantón.

Servicio Especial de Recolección. Servicio de recolección discriminada de materiales específicos como son desechos de jardines, baterías, metales, escombros, etc.

Sobre la Promoción y Organización del Manejo Discriminado de los Residuos Sólidos

CAPÍTULO II

Además, para los efectos, la Municipalidad establecerá y dispondrá de un registro de proveedores de dichos servicios.

La Municipalidad dotará dichas actividades del contenido presupuestario necesario para el impulso de las mismas, de conformidad con sus posibilidades presupuestarias.

Igualmente, incorporará dentro del Plan Anual Operativo, todas las acciones relacionadas y tendientes al cumplimiento del presente Reglamento.

Sobre la colocación de residuos sólidos húmedos y secos para su recolección

CAPÍTULO III

Las cajas de cartón deben ser dobladas y amarradas.

Sobre los generadores de grandes cantidades de residuos

CAPÍTULO IV

Para garantizar lo anterior, los contenedores de los desechos deben tener las dimensiones necesarias y suficientes para evitar excesos de basura fuera de los mismos, y además, ofrecer la ubicación que mejor garantice el acceso de los camiones recolectores, de acuerdo con las características topográficas del sitio y constructivas del local o locales de que se trate. Los contenedores citados deben encontrarse dentro de la propiedad privada pero contiguo a la acera, ya que de lo contrario, la Municipalidad no brindará el servicio.

Sobre los Centros de Acopio

CAPÍTULO V

Los centros de acopio comerciales deben contar, además, con su respectiva patente municipal.

Sobre los residuos especiales y bio-peligrosos

CAPÍTULO VI

Todo lo anterior, enmarcado en el cumplimiento y acatamiento riguroso de la normativa existente al respecto, así como, cualquier otra directriz que al respecto emita el Ministerio citado.

Cualquier incumplimiento de lo anterior, implicará la aplicación de las sanciones correspondientes.

Sobre las responsabilidades de la Municipalidad

CAPÍTULO VII

Dicho depósito de devolverá cuando los organizadores comprueben el estado de limpieza, la mañana siguiente a la actividad, por medio del visto bueno de la (*)Dirección de Servicios Ambientales.

Asimismo, la Administración está en la obligación de cumplir con los artículos 134, 135, 136, 137, 139 y 141 del Código Municipal, en cuanto a la evaluación y calificación del servicio y la aplicación de incentivos y sanciones a los funcionarios municipales.

En caso de que desechos obstaculicen la acera o pasos peatonales, la Municipalidad aplicará las multas estipuladas en el Reglamento para el Cobro de la Tarifa por las Omisiones a los Deberes de los Propietarios de Bienes Inmuebles localizados en el cantón de Curridabat.

TRANSITORIOS

Regulation for the Discriminated Management of Wet and Dry Solid Waste in the Canton of CurridabatReglamento para el Manejo Discriminado de los Residuos Sólidos Húmedos y Secos en el Cantón de Curridabat

Artículo 1 — Definitions:

Artículo 2 — The generators of solid waste shall be responsible for knowing and complying with the measures aimed at reducing and separating solid waste for its subsequent recovery.

Artículo 3 — The Municipality shall establish a discriminated system of collection, transport, and disposal of solid waste and shall promote it in the communities through a permanent campaign of environmental and civic education and training.

Artículo 5 — The Municipality shall promote and support community initiatives for the stockpiling and recovery of usable materials, provided that the current regulations on the matter are complied with.

Artículo 6 — The Municipality, by means of its (*) Environmental Services Directorate (Dirección de Servicios Ambientales), shall organize the programming of the discriminated collection in the communities, as detailed in Article 9 of this regulation.

Artículo 7 — The Municipality may stimulate the active participation of the population in reduction and separation measures, through incentives and public recognition.

Artículo 8 — The Municipality shall promote and support initiatives for the composting of biodegradable waste at the household and community level, among others.

Artículo 9 — The collection of recyclable materials shall be carried out according to schedules and dates to be communicated to the population.

Artículo 10 — The collection of wet solid waste shall be carried out according to a previously communicated schedule, according to the different routes or sectors defined by the Municipality.

Artículo 11 — The collection of bulky or non-traditional waste shall be carried out at least once every 45 calendar days according to the routes and schedules programmed by the (*) Environmental Services Directorate (Dirección de Servicios Ambientales).

Artículo 12 — The Municipality may establish a debris collection service upon prior request and payment of a special fee, or authorize its collection and disposal through private companies, after prior inspection of the vehicles to be used and the sanitary landfill or the final confinement site.

Artículo 13 — The Municipality shall promote the placement of containers for the stockpiling of usable dry waste in the most important commercial centers of the canton, in coordination with private enterprise and industry.

Artículo 14 — To guarantee the promotion, dissemination, and discriminated management of wet and dry solid waste, the Municipality shall endow said activities with the budgetary content necessary for their advancement, in accordance with its budgetary possibilities.

Artículo 15 — It is strictly prohibited to place waste containers and bags on the curb gutter or on the sidewalk outside the schedules established by the Municipality for each sector, as well as burning weeds and stubble.

Artículo 16 — The baskets used for the placement of waste must prevent it from getting wet, scattering at the site, emitting unpleasant odors, or attracting domestic animals, pests, insects, or rodents; the cleaning of the place being the obligation of the owner of the property.

Artículo 17 — The generators of waste must separate the materials into the following groups: dry solid waste (recyclable) and wet waste (non-recyclable) and place the respective materials during their collection schedule.

Artículo 18 — Recyclable waste must be dry, clean, and placed in clearly defined or transparent separate containers.

Artículo 19 — In the collection of garden waste, only grass, leaves, and stems shall be collected, in black bags, as well as branches up to a diameter of 10 centimeters; on the days and at the times scheduled.

Artículo 20 — It is strictly prohibited to place dead animals, chemical materials, sharp objects, biohazardous materials, and generators of possible diseases, in containers for wet or dry solid waste.

Artículo 21 — It is strictly prohibited for persons outside the authorized collecting entity or the Municipality to appropriate the waste placed for its collection.

Artículo 22 — For the purposes of application of this Regulation, the following are considered large generators of waste: apartment buildings, condominiums, commercial or service premises, supermarkets, public and private institutions, and industries in general.

Artículo 23 — Waste generators are obliged to separate and store waste within their property or in a common place with other businesses or commercial establishments, where adequate conditions of hygiene and safety must be ensured, according to the respective regulation of the Ministry of Health.

Artículo 24 — The disposal of this waste must not represent any nuisance to neighbors or passersby, nor in any way affect free transit on public roads and sidewalks of the canton.

Artículo 25 — In construction and remodeling permits, the specifications for size and location for the installations used for temporary storage (almacenamiento temporal) must be indicated and approved by the Municipal Operations Directorate (Dirección de Operaciones Municipal).

Artículo 26 — Large generators of wet and dry solid waste may contract collection services with a private company, provided that it complies with the sanitary requirements contemplated in the relevant laws and regulations.

Artículo 28 — The public and private vehicles used for the transport of waste must meet the conditions required by the Ministry of Health, to prevent the scattering of the waste, or the dripping of liquids on the road.

Artículo 29 — It is strictly prohibited to deliver waste from the food industry within the ordinary waste collection.

Artículo 30 — The Municipality does not assume the collection of non-recyclable solid waste from industries.

Artículo 31 — The Municipality does not assume the collection of non-recyclable solid waste from commerce, as long as that waste is raw material or the result of industrial, manufacturing, or similar processes.

Artículo 32 — The collection centers (centros de acopio) organized by community initiatives or educational centers must present hygienic, safety, and tidiness conditions, in accordance with municipal norms and those of the Ministry of Health.

Artículo 33 — The Municipality, through the (*)Environmental Services Directorate (Dirección de Servicios Ambientales), shall establish a registry of the collection centers (centros de acopio) in the canton and shall supervise their operation.

Artículo 34 — For the placement and storage of biohazardous waste, the regulations that the Ministry of Health has established on the matter apply.

Artículo 35 — The Municipality will not provide a collection service for special and biohazardous waste, the entity generating that type of waste being responsible for its transfer as established by the Ministry of Health.

Artículo 36 — The operational management of the discriminated management of solid waste shall be in charge of the (*)Environmental Services Directorate (Dirección de Servicios Ambientales) of the Municipality of Curridabat.

Artículo 37 — The (*)Environmental Services Directorate (Dirección de Servicios Ambientales) shall monitor the implementation and operation of the System for the Discriminated Management of Wet and Dry Solid Waste, as well as its evacuation and continuous improvement of the respective services.

Artículo 39 — The Municipality shall facilitate training processes for the designated persons and other interested parties in the Discriminated Management of Solid Waste, in accordance with the previous article.

Artículo 40 — The observations that the Municipality makes during its inspections or due to complaints, shall be channeled through the (*)Environmental Services Directorate (Dirección de Servicios Ambientales) to the Mayor's Office and the representative(s) of the involved entity.

Artículo 43 — In the selection or internal transfer of personnel responsible for municipal procedures or services referred to in the scope of application of this Regulation, special emphasis shall be given to persons with knowledge, experience, and background in environmental matters.

Artículo 48 — It is the obligation of the Municipality to periodically update the database and install an efficient billing system, in order to reduce delinquency in the payment of the garbage collection service.

Artículo 51 — It takes effect upon its publication.

Transitorio II — Articles 11, 12, 13, 14, 35, 36, 37, and 38 shall enter into force according to the Operating Plan (Plan Operativo) of the System for the Discriminated Management of Solid Waste.

Artículo 1 — Definiciones:

Artículo 2 — Los generadores de desechos sólidos serán responsables de conocer y acatar las medidas tendientes a reducir y separar los desechos sólidos para su recuperación posterior.

Artículo 3 — La Municipalidad establecerá un sistema discriminado de recolección, acarreo y disposición de los desechos sólidos y lo promoverá en las comunidades por medio de una campaña permanente de educación y capacitación ambiental y cívica.

Artículo 5 — La Municipalidad promoverá y apoyará iniciativas comunales para el acopio y la recuperación de los materiales aprovechables, siempre y cuando se cumpla con la normativa vigente sobre el particular.

Artículo 6 — La Municipalidad por medio de su (*) Dirección de Servicios Ambientales organizará la programación de la recolección discriminada en las comunidades, según se detalla en el artículo 9º del presente reglamento.

Artículo 7 — La Municipalidad podrá estimular la participación activa de la población en las medidas de reducción y separación, por medio de incentivos y reconocimiento público.

Artículo 8 — La Municipalidad promoverá y apoyará iniciativas para el compostaje de los desechos biodegradables a nivel domiciliario y comunal, entre otros.

Artículo 9 — La recolección de los materiales reciclables se realizará según los horarios y fechas a comunicarse a la población.

Artículo 10 — La recolección de los desechos sólidos húmedos se realizará de acuerdo a un horario previamente comunicado, según las diferentes rutas o sectores que defina la Municipalidad.

Artículo 11 — La recolección de desechos voluminosos o no tradicionales se realizará al menos una vez cada 45 días naturales según las rutas y horarios programados por la (*) Dirección de Servicios Ambientales.

Artículo 13 — La Municipalidad promoverá la colocación de contenedores para el acopio de desechos secos aprovechables en los centros comerciales más importantes del cantón, en coordinación con la empresa privada y la industria.

Artículo 14 — Para garantizar la promoción, la divulgación y el manejo discriminados de los desechos sólidos húmedos y secos.

Artículo 15 — Queda terminantemente prohibido, colocar recipientes y bolsas de basura en el cordón de caño o en la acera fuera de los horarios establecidos por la Municipalidad para cada sector, así como quemar malezas y rastrojos.

Artículo 16 — Las canastas utilizadas para la colocación de los desechos deben evitar que éstos se mojen, se dispersen en el lugar, emita olores molestos o atraigan animales domésticos, plagas, insectos o roedores, siendo la limpieza del lugar obligación del dueño de la propiedad.

Artículo 17 — Los generadores de desechos deben separar los materiales en los siguientes grupos: desechos sólidos secos (reciclables) y desechos húmedos (no reciclables) y colocar los respectivos materiales en el horario de su recolección.

Artículo 18 — Los desechos reciclables deben estar secos, limpios y colocados en recipientes separados claramente definidos o transparentes.

Artículo 19 — En la recolección de desechos de jardines sólo se recogerá zacate, hojas y tallo, en bolsas negras, así como ramas hasta un diámetro de 10 centímetros; los días y horas programados.

Artículo 20 — Queda terminantemente prohibida la colocación de animales muertos, materiales químicos, objetos punzocortantes, biopeligrosos y generadores de posibles enfermedades, en recipientes de desechos sólidos húmedos o secos.

Artículo 21 — Queda terminantemente prohibido, que personas ajenas a la entidad recolectora autorizada o la Municipalidad; se apropien de los desechos colocados para su recolección.

Artículo 22 — Para los efectos de aplicación del presente Reglamento, se consideran grandes generadores de desechos, los edificios de apartamentos, condominios, locales comerciales o de servicios, los supermercados, instituciones públicas y privadas y las industrias en general.

Artículo 24 — La disposición de estos desechos no debe representar ninguna molestia para los vecinos o transeúntes, ni afectar en forma alguna el libre tránsito por las vías públicas y aceras del cantón.

Artículo 25 — En los permisos de construcción y remodelación, se deben indicar y aprobar por parte de la Dirección de Operaciones Municipal las especificaciones de tamaño y ubicación para las instalaciones utilizadas para almacenamiento temporal.

Artículo 26 — Los grandes generadores de residuos sólidos húmedos y secos, pueden contratar los servicios de recolección con una empresa privada, siempre que esta cumpla con los requisitos sanitarios contemplados en las leyes y reglamentos del caso.

Artículo 27 — En el caso de contratarse una empresa o transportista privado, el generador de los residuos debe demostrar, a solicitud de la (*)Dirección de Servicios Ambientales, el contrato y los documentos que permitan verificar la entrega de los desechos en el relleno sanitario.

Artículo 28 — Los vehículos públicos y privados utilizados para el transporte de residuos, deben reunir las condiciones exigidas por el Ministerio de Salud, para evitar la dispersión de los desechos, o el escurrimiento de líquidos en el camino.

Artículo 29 — Está terminantemente prohibido entregar desechos de la industria alimenticia dentro de la recolección ordinaria de desechos.

Artículo 30 — La Municipalidad no asume la recolección de residuos sólidos no reciclables de las industrias.

Artículo 31 — La Municipalidad no asume la recolección de desechos sólidos no reciclables del comercio, en tanto que esos desechos sean materia prima o el resultado de procesos industriales, de manufactura o similares.

Artículo 32 — Los centros de acopio organizados por iniciativas comunales o centros educativos, tienen que presentar condiciones higiénicas, de seguridad y de ornato, de acuerdo con las normas municipales y del Ministerio de Salud.

Artículo 33 — La Municipalidad, a través de la (*)Dirección de Servicios Ambientales, establecerá un registro de los centros de acopio en el cantón y fiscalizará su operación.

Artículo 34 — Para la colocación y el almacenamiento de desechos bio-peligrosos se aplica a la normativa que al respecto ha dispuesto el Ministerio de Salud.

Artículo 35 — La Municipalidad no prestará servicio de recolección de los desechos especiales y bio- peligrosos, siendo el ente generador de ese tipo de desecho el responsable por su traslado tal y como lo establece el Ministerio de Salud.

Artículo 36 — La gestión operativa del manejo discriminado de los desechos sólidos estará a cargo de la (*)Dirección de Servicios Ambientales de la Municipalidad de Curridabat.

Artículo 37 — La (*)Dirección de Servicios Ambientales vigilará la implementación y operación del Sistema de Manejo Discriminado de Desechos Sólidos Húmedos y Secos, así como su evacuación y mejora continua de los servicios respectivos.

Artículo 39 — La Municipalidad facilitará procesos de capacitación para las personas designadas y otros interesados en el Manejo Discriminado de los Residuos Sólidos, de conformidad con el artículo anterior.

Artículo 40 — Las observaciones que la Municipalidad, realice en sus inspecciones o por denuncias, serán canalizadas a través de la (*)Dirección de Servicios Ambientales para ante la Alcaldía y él o los representantes de la entidad involucrada.

Artículo 43 — En la selección o el traslado interno de personal responsable de trámites o servicios municipales referidos al ámbito de aplicación de este Reglamento, se dará énfasis especial a las personas con conocimientos, experiencia y antecedentes en materia ambiental.

Artículo 48 — Es obligación de la Municipalidad la actualización periódica de la base de datos y la instalación de un eficiente sistema de cobro, con el fin de reducir la morosidad en el pago del servicio de recolección de basura.
