in the entirety of the text - Complete Text of Norm 34073 Modifies for the Forest Fund the maximum budget expenditure set for the year 2008 Complete Text of record: B6D56 Nº 34073 Nº 34073 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred upon them by Articles 140, subsections 3) and 18) and 146 of the Political Constitution; Articles 25, subsection l), 27, subsection l) and 28, subsection 2) paragraph b) of Law Nº 6227, General Law of Public Administration of 2 May 1978 and its amendments; Law Nº 8131, Law of the Financial Administration of the Republic and Public Budgets of 18 September 2001 and its amendments; its Regulations, Executive Decree Nº 32988-H-MP-PLAN of 31 January 2006 and its amendments; Law Nº 7554, Organic Law of the Environment of 4 October 1995 and its amendments; Law Nº 7575, Ley Forestal of 13 February 1996 and its amendments; its Regulations, Executive Decree Nº 27505-MINAE of 17 October 1996 and its amendments; Law Nº 7788, Law of Biodiversity of 30 April 1998 and its amendments; Executive Decree Nº 32452-H of 29 June 2005 and its amendments and Executive Decree Nº 33646-H of 9 March 2006 and its amendments.

1. 1That Law Nº 7554, Ley Orgánica del Ambiente, published in La Gaceta Nº 215 of 13 November 1995, establishes that the State must ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it is obliged to promote economically and environmentally sustainable development, understood as development that satisfies basic human needs, without compromising the options of future generations.
2. 2That the Forest Fund created through Law Nº 7575, Ley Forestal, published in Supplement Nº 21 to La Gaceta Nº 72 of 16 April 1996, is administered by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), as established in Law Nº 7788, Ley de Biodiversidad, published in La Gaceta Nº 101 of 27 May 1998.
3. 3That the Forest Fund requires increasing the maximum budget expenditure for the year 2008 by an amount of ¢234,200,000.00 (exactly two hundred thirty-four million two hundred thousand colones), in order to include financial resources intended to reinforce expenditures, of which domestic per diems (viáticos dentro del país), electrical, telephone and computer materials and products, tools and supplies, security and safeguarding supplies and materials, transportation equipment, communication equipment, office equipment and furniture, computer equipment and programs, sanitary, laboratory and research equipment, and diverse machinery and equipment, shall be financed with free surplus (superávit libre) for an amount of ¢111,000,000.00 (exactly one hundred eleven million colones), and other normal operating expenditures of the institution shall be financed from funds resulting from the provisions of the second paragraph of numeral 64 of Executive Decree Nº 27505-MINAE and its amendments, published in La Gaceta Nº 16 of 23 January 1997, for an amount of ¢123,200,000.00 (exactly one hundred twenty-three million two hundred thousand colones).
4. 4That through Executive Decree Nº 32452-H and its amendments, published in La Gaceta Nº 130 of 6 July 2005, the "Guideline for the application of Article 6 of Law Nº 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the Public Sector revenue class called Financing" is issued.
5. 5That Article 7 of the aforementioned decree provides that resources from the free surplus (superávit libre) form part of the equity of the bodies and entities and may be used by them in subsequent periods to finance expenditures related to their ordinary activity, with which the interest of the community, the public service and institutional purposes are served, which, like those included herein, are not of a permanent nature nor generate an obligation that requires financing over time.
6. 6That in the present case, the application of the free surplus (superávit libre) conforms to the stipulations in the Executive Decree cited in considering 4 of this decree.
7. 7That with Executive Decree Nº 33646-H and its amendments, published in La Gaceta Nº 58 of 22 March 2007, the Budget Authority (Autoridad Presupuestaria) formulated the 2008 Budget Policy Guidelines, which were known to the Government Council and approved by the Executive Branch, establishing in Article 1 of the cited Decree the budget expenditure limit for the year 2008, for the entities covered by the scope of that Collegiate Body.
8. 8That by means of official communication STAP-0917-07 of 25 May 2007, the maximum budget expenditure set for the year 2008 was communicated to the Forest Fund, in the amount of ¢46,220,000.00 (exactly forty-six million two hundred twenty thousand colones), which does not contemplate the expenditures indicated in considering 3 of this decree.
9. 9That the Minister Rector of the Environment Sector, through official communication DM-951-07 of 15 August 2007, endorses the request made by the Fund.

10.—That for the foregoing reasons, it is necessary to modify the maximum budget expenditure set for the Forest Fund for the year 2008. Therefore, THEY DECREE:

1. 1Que la Ley Nº 7554, Ley Orgánica del Ambiente, publicada en La Gaceta Nº 215 de 13 de noviembre de 1995, establece que el Estado debe velar por la utilización racional de los elementos ambientales, con el fin de proteger y mejorar la calidad de vida de los habitantes del territorio nacional. Asimismo, está obligado a propiciar un desarrollo económico y ambientalmente sostenible, entendido como el desarrollo que satisface las necesidades humanas básicas, sin comprometer las opciones de las generaciones futuras.
2. 2Que el Fondo Forestal creado mediante la Ley Nº 7575, Ley Forestal, publicada en el Alcance Nº 21 a La Gaceta Nº 72 de 16 de abril de 1996, está administrado por el Sistema Nacional de Áreas de Conservación, según lo establecido en la Ley Nº 7788, Ley de Biodiversidad, publicada en La Gaceta Nº 101 de 27 de mayo de 1998.
3. 3Que el Fondo Forestal requiere ampliar el gasto presupuestario máximo para el año 2008 por un monto de ¢234.200.000,00 (doscientos treinta y cuatro millones doscientos mil colones exactos), con el fin de incluir recursos financieros destinados a reforzar gastos, de los cuales los viáticos dentro del país, materiales y productos eléctricos, telefónicos y de cómputo, herramientas y suministros, útiles y materiales de resguardo y seguridad, equipo de transporte, equipo de comunicación, equipo y mobiliario de oficina, equipo y programas de cómputo, equipo sanitario, laboratorio e investigación y maquinaria y equipo diverso, se financiarán con superávit libre por un monto de ¢111.000.000,00 (ciento once millones de colones exactos), y otros gastos operativos normales de la institución se financiarán de fondos producto de lo establecido en el párrafo segundo del numeral 64 del Decreto Ejecutivo Nº 27505-MINAE y sus reformas, publicado en La Gaceta Nº 16 de 23 de enero de 1997, por un monto de ¢123.200.000,00 (ciento veintitrés millones doscientos mil colones exactos).
4. 4Que mediante el Decreto Ejecutivo Nº 32452-H y sus reformas, publicado en La Gaceta Nº 130 de 6 de julio de 2005, se emite el "Lineamiento para la aplicación del artículo 6º de la Ley Nº 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".
5. 5Que el artículo 7º del decreto supra citado, dispone que los recursos provenientes del superávit libre forman parte del patrimonio de los órganos y las entidades y pueden utilizarlos en períodos subsiguientes para financiar gastos que se refieran a su actividad ordinaria, con los cuales se atienda el interés de la colectividad, el servicio público y los fines institucionales, que como los aquí incluidos no tienen carácter permanente ni generan una obligación que requiera financiarse a través del tiempo.
6. 6Que en el presente caso, la aplicación del superávit libre se ajusta a lo estipulado en el Decreto Ejecutivo citado en el considerando 4 de este decreto.
7. 7Que con el Decreto Ejecutivo Nº 33646-H y sus reformas, publicado en La Gaceta Nº 58 de 22 de marzo de 2007, la Autoridad Presupuestaria formuló las Directrices de Política Presupuestaria del 2008, las cuales fueron conocidas por el Consejo de Gobierno y aprobadas por el Poder Ejecutivo, estableciendo en el artículo 1º del citado Decreto el límite de gasto presupuestario del año 2008, para las entidades cubiertas por el ámbito de ese Órgano Colegiado.
8. 8Que por medio del oficio STAP-0917-07 de 25 de mayo de 2007, se comunicó al Fondo Forestal el gasto presupuestario máximo fijado para el año 2008, por un monto de ¢46.220.000.00 (cuarenta y seis millones doscientos veinte mil colones exactos), el cual no contempla los gastos indicados en el considerando 3 de este decreto.
9. 9Que el señor Ministro Rector del Sector Ambiente, mediante el oficio DM-951-07 de 15 de agosto de 2007, avala la solicitud planteada por el Fondo.

10.-Que por lo anterior, se hace necesario modificar el gasto presupuestario máximo fijado para el Fondo Forestal para el año 2008. Por tanto,
