for the entirety of the text - Full Text of Norm 34176 Modifies for the Forest Fund the maximum budget expenditure set for the year 2008 Full Text record: B6D53 Nº 34176 Nº 34176 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by Articles 140, subsections 3) and 18), and 146 of the Political Constitution; Articles 25, subsection l); 27, subsection l); and 28, subsection 2), paragraph b) of Law Nº 6227, General Public Administration Law of 2 May 1978 and its amendments; Law Nº 8131, Financial Administration of the Republic and Public Budgets Law of 18 September 2001 and its amendments; its Regulations, Executive Decree Nº 32988-H-MP-PLAN of 31 January 2006 and its amendments; Law Nº 7554, Organic Environmental Law of 4 October 1995 and its amendments; Law Nº 7575, Forest Law (Ley Forestal) of 13 February 1996 and its amendments; its Regulations, Executive Decree Nº 27505-MINAE of 17 October 1996 and its amendments; Law Nº 7788, Biodiversity Law of 30 April 1998 and its amendments; Executive Decree Nº 32452-H of 29 June 2005 and its amendments; and Executive Decree Nº 33646-H of 9 March 2006 and its amendments.

1. 1That Law Nº 7554, Organic Environmental Law, published in La Gaceta Nº 215 of 13 November 1995, establishes that the State must ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it is obliged to promote economic and environmentally sustainable development, understood as development that satisfies basic human needs, without compromising the options of future generations.
2. 2That the Forest Fund (Fondo Forestal) created by Law Nº 7575, Forest Law (Ley Forestal), published in Supplement Nº 21 to La Gaceta Nº 72 of 16 April 1996, is administered by the National System of Conservation Areas, as established in Law Nº 7788, Biodiversity Law, published in La Gaceta Nº 101 of 27 May 1998.
3. 3That through official communication DM-1187-07 of 25 September 2007, the Acting Minister of Environment and Energy -the Office exercising the Rectoría of the Environment and Energy Sector- requested to increase the maximum budget expenditure set for the Forest Fund for the year 2008 in order to incorporate into its budget the sum of ¢128,075,378.85 (one hundred twenty-eight million seventy-five thousand three hundred seventy-eight colones and eighty-five céntimos).
4. 4That of this amount, ¢18,361,678.10 (eighteen million three hundred sixty-one thousand six hundred seventy-eight colones and ten céntimos) corresponds to free surplus (superávit libre) and will be allocated to cover expenses in sub-items such as transportation equipment, office equipment and furniture, computer equipment and software, educational, sports and recreational equipment and furniture, and miscellaneous machinery and equipment.
5. 5That ¢19,829,179.67 (nineteen million eight hundred twenty-nine thousand one hundred seventy-nine colones and sixty-seven céntimos) come from specific surplus (superávit específico) and will be used to cover current transfers to non-business decentralized institutions, current transfers to non-financial public enterprises, and current transfers to other private non-profit entities.
6. 6That ¢89,884,521.08 (eighty-nine million eight hundred eighty-four thousand five hundred twenty-one colones and eight céntimos) will be financed with resources that the National Forestry Financing Fund will transfer to the Forest Fund for the execution and operation of the Monitoring and Promotion Strategy for the Payment for Environmental Services Program (Programa de Pago de Servicios Ambientales, PSA) developed by the National System of Conservation Areas, specifically to cover administrative expenses such as printing, binding and others, domestic travel allowances, travel allowances abroad, protocolary and social activities, maintenance and repair of transportation equipment, inks, paints and thinners, among others.
7. 7That through Executive Decree Nº 32452-H, published in La Gaceta Nº 130 of 6 July 2005 and its amendments, the "Guideline for the application of Article 6 of Law Nº 8131 on the Financial Administration of the Republic and Public Budgets and the regulation of the Public Sector revenue class called Financing" was issued.
8. 8That Article 7 of the aforementioned Executive Decree Nº 32452-H provides that financing resources coming from free surplus (superávit libre) form part of the equity of the organs and entities and may be used in subsequent periods to finance expenses related to their ordinary activity, with which the interest of the community, the public service, and institutional purposes are served, provided that -as in the present case- such resources are not of a permanent nature nor generate an obligation that requires financing over time.
9. 9That Article 9 of the mentioned Executive Decree Nº 32452-H indicates that resources from previous fiscal years that refer to specific surplus (superávit específico) may be used to finance the expenses defined in the purposes established in the special or legal provisions applicable to those resources.

10.-That in the present case, the application of the surplus -both free and specific- conforms to the provisions of the aforementioned Executive Decree Nº 32452-H referred to in Considerandos 7, 8, and 9 of this Decree.

11.-That through Executive Decree Nº 33646-H, published in La Gaceta Nº 58 of 22 March 2007 and its amendments, the Budgetary Policy Guidelines for the year 2008 were issued, establishing in Article 1 of the cited decree the maximum budget expenditure for the year 2008 for the entities covered by the scope of the Budgetary Authority.

12.-That through Executive Decree Nº 34073-H, published in La Gaceta Nº 211 of 2 November 2007, the maximum budget expenditure set for the year 2008 for the Forest Fund was modified, leaving it established at the sum of ¢280,420,000.00 (two hundred eighty million four hundred twenty thousand exact colones), an amount that does not include the expenses indicated in Considerando 3 of this Decree.

13.-That due to the foregoing, it is necessary to modify the maximum budget expenditure set for the Forest Fund for the year 2008. Therefore,

1. 1Que la Ley Nº 7554, Ley Orgánica del Ambiente, publicada en La Gaceta Nº 215 de 13 de noviembre de 1995, establece que el Estado debe velar por la utilización racional de los elementos ambientales, con el fin de proteger y mejorar la calidad de vida de los habitantes del territorio nacional. Asimismo, está obligado a propiciar un desarrollo económico y ambientalmente sostenible, entendido como el desarrollo que satisface las necesidades humanas básicas, sin comprometer las opciones de las generaciones futuras.
2. 2Que el Fondo Forestal creado mediante la Ley Nº 7575, Ley Forestal, publicada en el Alcance Nº 21 a La Gaceta Nº 72 del 16 de abril de 1996, está administrado por el Sistema Nacional de Áreas de Conservación, según lo establecido en la Ley Nº 7788, Ley de Biodiversidad, publicada en La Gaceta Nº 101 del 27 de mayo de 1998.
3. 3Que por medio del oficio DM-1187-07 de 25 de setiembre de 2007, el Ministro a. í. de Ambiente y Energía -Despacho que ejerce la Rectoría del Sector Ambiente y Energía- requirió ampliar el gasto presupuestario máximo fijado al Fondo Forestal para el año 2008 a fin de incorporar a su presupuesto la suma de ¢128.075.378,85 (ciento veintiocho millones setenta y cinco mil trescientos setenta y ocho colones con ochenta y cinco céntimos).
4. 4Que de dicha cifra ¢18.361.678,10 (dieciocho millones trescientos sesenta y un mil seiscientos setenta y ocho colones con diez céntimos) corresponden a superávit libre y se destinarán a atender gastos en subpartidas como equipo de transporte, equipo y mobiliario de oficina, equipo y programas de cómputo, equipo y mobiliario educacional, deportivo y recreativo, maquinaria y equipo diverso.
5. 5Que ¢19.829.179,67 (diecinueve millones ochocientos veintinueve mil ciento setenta y nueve colones con sesenta y siete céntimos) provienen de superávit específico y se emplearán para atender transferencias corrientes a instituciones descentralizadas no empresariales, transferencias corrientes a empresas públicas no financieras y transferencias corrientes a otras entidades privadas sin fines de lucro
6. 6Que ¢89.884.521,08 (ochenta y nueve millones ochocientos ochenta y cuatro mil quinientos veintiún colones con ocho céntimos) se financiarán con recursos que el Fondo Nacional de Financiamiento Forestal le trasladará al Fondo Forestal para la ejecución y operación de la Estrategia de Seguimiento y Fomento al Programa de Pago de Servicios Ambientales elaborada por el Sistema Nacional de Áreas de Conservación, específicamente para atender gastos administrativos tales como impresión, encuadernación y otros, viáticos dentro del país, viáticos al exterior, actividades protocolarias y sociales, mantenimiento y reparación de equipo de transporte, tintas, pinturas y diluyentes, entre otros.
7. 7Que mediante el Decreto Ejecutivo Nº 32452-H, publicado en La Gaceta Nº 130 del 6 de julio de 2005 y sus reformas, se emitió el "Lineamiento para la aplicación del artículo 6º de la Ley Nº 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".
8. 8Que el artículo 7º del Decreto Ejecutivo Nº 32452-H supra citado, dispone que los recursos de financiamiento provenientes del superávit libre forman parte del patrimonio de los órganos y las entidades y pueden utilizarlos en períodos subsiguientes para financiar gastos que se refieran a su actividad ordinaria, con los cuales se atienda el interés de la colectividad, el servicio público y los fines institucionales, siempre que -como en el presente caso- tales recursos no tengan carácter permanente ni generen una obligación que requiera financiarse a través del tiempo.
9. 9Que el artículo 9º del Decreto Ejecutivo Nº 32452-H mencionado, señala que los recursos de vigencias anteriores que se refieren al superávit específico, podrán utilizarse para financiar los gastos definidos en los fines establecidos en las disposiciones especiales o legales aplicables a esos recursos.

10.-Que en el presente caso, la aplicación del superávit -tanto libre como específico- se ajusta a lo estipulado en el Decreto Ejecutivo Nº 32452-H aludido en los considerandos 7, 8 y 9 del presente Decreto.

11.-Que mediante el Decreto Ejecutivo Nº 33646-H, publicado en La Gaceta Nº 58 del 22 de marzo de 2007 y sus reformas, se emitieron las Directrices de Política Presupuestaria para el año 2008, estableciéndose en el artículo 1º del citado decreto, el gasto presupuestario máximo del año 2008 para las entidades cubiertas por el ámbito de la Autoridad Presupuestaria.

12.-Que por medio del Decreto Ejecutivo Nº 34073-H, publicado en La Gaceta Nº 211 del 2 de noviembre de 2007, se modificó el gasto presupuestario máximo fijado para el año 2008 al Fondo Forestal, quedando éste establecido en la suma de ¢280.420.000,00 (doscientos ochenta millones cuatrocientos veinte mil colones exactos), cifra que no contempla los gastos indicados en el considerando 3 de este Decreto.

13.-Que por lo anterior, se hace necesario modificar el gasto presupuestario máximo fijado al Fondo Forestal para el año 2008. Por tanto,
