Cost to be paid (Costo a abonar): is the amount that every future developer or subdivider (fraccionador) must pay in favor of the Developer (Desarrollador) who, in application of Article 38 of the Urban Planning Law, built some work aimed at enabling potable water and/or sanitary sewer services in a determined zone and has requested from AyA the determination of the amount to be recovered. This amount must be paid within five years counting from the acceptance (recepción) of the works by said Institute, and its collection will be made when the developer or subdivider requests from AyA the necessary documents to process the construction permits for their project.
Water Supply System (Sistema de Suministro de Agua): is that which comprises the works, equipment, materials, human labor, and technical knowledge employed for the collection, conveyance, treatment, storage, and distribution of water for human consumption, from the supply source to delivery to the customer.
Sanitary Sewer System (Sistema de Alcantarillado Sanitario): is the set of works, equipment, materials, human labor, and technical knowledge necessary for the collection and transport of wastewater (ordinary and special type) to its treatment and discharge point.
Wastewater Treatment System (Sistema de Tratamiento de Aguas Residuales): Is the set of works, equipment, materials, human labor, and technical knowledge necessary for carrying out the physical, chemical, or biological processes, whose purpose is to improve the quality of the wastewater to which they are applied.
Certification of availability of water and/or sanitary sewer services (Certificación de disponibilidad de servicios de agua y/o de alcantarillado sanitario): Document issued by AyA at the request of an interested party, through which the availability of services is certified for the purposes of connection and operation of the services.
Commitment certification (Certificación de compromiso): Document through which AYA attests to the existence of the project, its coverage, approximate cost, and the the purpose of this party managing the corresponding permits for its acceptance before the authorities stipulated in Article 38 of the Urban Planning Law.
Memorandum of Understanding (Carta de Entendimiento): Agreement subscribed between the developer or subdivider as the case may be, through which the cost and term for aqueduct or sanitary sewer works are agreed upon, at the expense of the former and in accordance with the technical specifications supplied by AyA.
Developer, Urbanizer, or Subdivider (Desarrollador, Urbanizador o Fraccionador): Person or persons, individuals or legal entities, interested in enabling, at their own cost, the water supply and sanitary sewer systems, including the treatment of wastewater, in those zones where the provision of such services is under AyA's administration. The developer or Subdivider is the only party legitimated to request from AyA the determination of the cost to be paid for its eventual recovery within the period authorized by law.
Acceptance of works (Recepción de obras): Is the act through which AyA receives to its satisfaction the works, materials, and equipment installed by the developer or subdivider, after a prior technical inspection, completion, and approval of the respective tests, for their operation. This act entails the issuance of a document through which AyA manifests the satisfactory receipt of the works and certifies the nature, quantity, and description of the systems built, both for the water supply and for the sanitary sewer system, including the treatment of wastewater when appropriate; all the foregoing in accordance with current regulations and the memorandum of understanding subscribed between the developer and AyA, which must be in total concordance with the legal and administrative provisions in force.
