in the entirety of the text - Complete Text of Regulation 33815 Reform of the Regulation to the Forestry Law and Procedures Manual for the Accreditation of Forestry Certifiers Complete Text record: ABA5E Nº 33815 Nº 33815 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred upon them by Articles 140, subsections 3) and 18), and 146 of the Political Constitution and in accordance with the provisions of Forestry Law No. 7575 published in Supplement No. 21 to La Gaceta No. 72 of Tuesday, April 16, 1996.

1That Article 1 of Forestry Law No. 7575, published in Supplement No. 21 to La Gaceta No. 72 of April 16, 1996, establishes as an essential and priority function of the State, to ensure the conservation, protection, and administration of natural forests, the utilization, industrialization, and promotion of the country's forest resources destined for that purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources.
2That Article 6, subsection o) of Forestry Law 7575 establishes that it is the competence of the State Forestry Administration (Administración Forestal del Estado, AFE) to grant forestry certifier licenses, upon the proposal of a commission composed of representatives of recognized national and foreign academic and scientific entities, distinguished in the environmental field. This commission will also be entrusted with regulating and overseeing the system of green seals or forestry certifications. The requirements to qualify as a forestry certifier, the composition of the aforementioned commission, its responsibilities, and its functioning shall be established in the regulation to this law.
3That the same regulation established in Article 20 that forests may only be utilized if they have a management plan that includes the impact they may cause on the environment, with the AFE being empowered to approve them according to sustainability standards.
4That the definition of principles, criteria, and indicators for sustainable forest management aims to cause the least impact in the activities applied in natural forests and forest plantations in order to achieve their sustainability.
5That Article 1 of the Regulation to Forestry Law 7575 in Chapter 1, definitions, establishes "CNCF: National Forestry Certification Commission (Comisión Nacional de Certificación Forestal)".
6That Article 26 of Executive Decree No. 25721-MINAE created the National Forestry Certification Commission (Comisión Nacional de Certificación Forestal), as a body of the AFE, composed of eight members of recognized technical and moral solvency, whose main function is to define the regulation and control mechanisms characteristic of the Forestry Certification System and submit them to the approval of the AFE, in order to recommend to the same the sustainability standards required in natural forest management plans.
7That Article 29 of Executive Decree No. 25721-MINAE established the requirements, both for the application for accreditation and for forestry certifiers.
8That Executive Decree No. 29147-MINAE, published in La Gaceta No. 241 of December 15, 2000, modified the first paragraph of Article 26 of Executive Decree 25721-MINAE, regulating Forestry Law 7575, in order to stagger the appointment and renewal of the National Forestry Certification Commission (Comisión Nacional de Certificación Forestal) with the objective of guaranteeing the follow-up and knowledge of the work of this Commission.
9That Executive Decree No. 30310-MINAE published in La Gaceta No. 88 of May 9, 2002, reformed the third paragraph of Article 26 of Executive Decree 25721-MINAE, regulation to Forestry Law 7575, in relation to the functions of the National Forestry Certification Commission (Comisión Nacional de Certificación Forestal).

10.-That it is in the interest of the AFE to promote sustainable forest management, with the support of scientific and economic promotion institutions, so that they advise and recommend it through a Commission, for which it is necessary to modify and repeal certain legal provisions.

THEY DECREE:

"CNSF: National Commission for Forest Sustainability (Comisión Nacional para la Sostenibilidad Forestal)."

"Article 2º-National Commission for Forest Sustainability (Comisión Nacional para la Sostenibilidad Forestal). Commission composed of representatives of scientific and economic promotion institutions, whose function is to recommend to the A.F.E. the sustainability guidelines for forestry activity that guarantee a viable socioeconomic use of the forest resource, with minimal impact and within an institutional governance framework. Additionally, another of its functions is to advise on the promotion, regulation, and control mechanisms characteristic of sustainable forest management including forestry certification, as stipulated in Article 6, subsection o) of Forestry Law No. 7575."

"Article 26.-The National Commission for Forest Sustainability (Comisión Nacional para la Sostenibilidad Forestal, CNSF) is hereby created, as a body of the AFE. Said commission shall be composed of seven members of recognized technical and moral solvency in the following manner: three representatives of the National Universities with development in higher education programs in the forestry and natural resources area, two representatives of international scientific entities based in the country with a recognized track record in the field of natural and forest resources research and teaching, one representative of the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal), and one representative of the College of Agronomic Engineers (Colegio de Ingenieros Agrónomos). The National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) as the State Forestry Administration shall convene and request a shortlist of three candidates from the Institutions indicated in this article at the end of each representation period in the month of December; the director of the AFE shall select one representative and communicate it to the corresponding institution 15 days after receiving the shortlist.

The appointment shall be for three years, and they may be reelected for equal periods. However, to provide continuity to the work and to have a mechanism for the renewal of the Commission, for the first and only time, the following representatives shall serve in their positions for a period of four years: one from the universities, two from the international scientific Institutions, and the one from the College of Agronomic Engineers (Colegio de Ingenieros Agrónomos).

The Commission shall define its own internal operating regulations. Each representative shall have the right to propose an alternate from the corresponding institution, and their participation shall be regulated via internal regulations.

In the event of resignation, separation from office, or any other circumstance, the alternate shall assume the representation of the institution. If the representation of the institution is permanently absent, the AFE may appoint the substitute for the remaining period based on the last shortlist sent by the Entity; or alternatively, the AFE may invite another institution of the same category to participate in the Commission.

The functions of the Commission shall be:

a)To recommend to the State Forestry Administration (Administración Forestal del Estado):

1. The forest sustainability guidelines applicable to the activity, both at the management unit level and at the national level.

2. The entities and bodies to which a national forestry certifier license may be granted.

3. The suspension of the license of national forestry certifiers.

4. Recognition of international forestry certification systems, as well as the entities and organizations accredited before them.

b)To advise the State Forestry Administration (Administración Forestal del Estado) on the promotion, regulation, and control mechanisms characteristic of sustainable forest management.
c)To appoint technical subcommittees as support for the tasks it performs.
d)The regulation of the national system of green seals or forestry certification.
e)To support the AFE in training and dissemination of the sustainability guidelines applicable to forestry activity.
f)To support and participate in regional and international initiatives of voluntary international forestry certification systems.
g)To adjust the country's forest sustainability guidelines to the management standards of voluntary international forestry certification systems, h) To establish the internal regulations of the Commission."

"Article 29.-Individuals or legal entities wishing to be accredited as forestry certifiers must comply with the provisions of Executive Decree No. 27695-MINAE published in La Gaceta No. 53 of March 17, 1999."

1Que el artículo 1º Ley Forestal Nº 7575, publicada en el Alcance Nº 21 a La Gaceta Nº 72 del día 16 de abril de 1996, establece como función esencial y prioritaria del Estado, velar por la conservación, protección y administración de los bosques naturales, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables.
2Que el articulo 6º inciso o) de la Ley Forestal 7575 establece que es competencia de la Administración Forestal del Estado (AFE) otorgar las licencias de certificadores forestales, a propuesta de una comisión integrada por representantes de entes académicos y científicos reconocidos, nacionales y extranjeros, destacados en el tema ambiental. A esta comisión, también se le encomendará regular y vigilar el sistema de sellos verdes o certificaciones forestales. Los requisitos para calificar como certificador forestal, la integración de la citada comisión, sus responsabilidades y funcionamiento se establecerán en el reglamento a esta ley.
3Que la misma normativa, estableció en el Artículo 20 que los bosques sólo podrán aprovecharse, sí cuentan con un plan de manejo que contenga el impacto que puedan ocasionar sobre el ambiente, quedando facultada la AFE para aprobarlos según estándares de sostenibilidad.
4Que la definición de los principios, criterios e indicadores para manejo forestal sostenible tienen como finalidad provocar el menor impacto en las labores que se apliquen en los bosques naturales y plantaciones forestales para lograr la sostenibilidad de los mismos.
5Que el artículo 1º del Reglamento a la Ley Forestal 7575 en el Capítulo 1, definiciones, establece "CNCF: Comisión Nacional de Certificación Forestal".
6Que el artículo 26 del Decreto Ejecutivo Nº 25721-MINAE, creó la Comisión Nacional de Certificación Forestal, como un órgano de la AFE, estando integrada por ocho miembros de reconocida solvencia técnica y moral, cuya función principal es definir los mecanismos de regulación y control propios del Sistema de Certificación Forestal y someterlos a la aprobación de la AFE, con el fin de recomendar a la misma los estándares de sostenibilidad exigibles en los planes de manejo de bosque natural.
7Que el artículo 29 del Decreto Ejecutivo Nº 25721-MINAE estableció los requisitos, tanto para la solicitud de acreditación como para certificadores forestales.
8Que el Decreto Ejecutivo Nº 29147-MINAE, publicado en La Gaceta Nº 241 del 15 de diciembre del 2000 modificó el párrafo primero del artículo 26 del Decreto Ejecutivo 25721-MINAE, reglamentó la Ley Forestal 7575, para fraccionar el nombramiento y renovación de la Comisión Nacional de Certificación Forestal con el objetivo de garantizar el seguimiento y conocimiento del trabajo de esta Comisión.
9Que el Decreto Ejecutivo N° 30310-MINAE publicado en La Gaceta Nº 88 del nueve de mayo del 2002 reformó el párrafo tercero del artículo 26 del Decreto Ejecutivo 25721-MINAE reglamento a la Ley Forestal 7575, en relación con las funciones de la Comisión Nacional de Certificación Forestal.

10.-Que es interés de la AFE impulsar el manejo forestal sostenible, con el apoyo de las instituciones de promoción científica y económica, para que le asesoren y recomienden a través de una Comisión, para lo cual, se hace necesario modificar y derogar determinadas disposiciones jurídicas.

Considerando:

Por tanto,

DECRETAN:

"CNSF: Comisión Nacional para la Sostenibilidad Forestal."

"Artículo 2º-Comisión Nacional para la Sostenibilidad Forestal. Comisión integrada por representantes de instituciones de promoción científicas y económicas, cuya función es la de recomendar a la A.F.E. los lineamientos de sostenibilidad para la actividad forestal que garantice un uso socioeconómico viable del recurso forestal, con un impacto mínimo y dentro de un marco institucional de gobernanza. Además, otra de sus funciones es la de asesorar sobre los mecanismos de fomento, regulación y control propios del manejo forestal sostenible incluyendo la certificación forestal, según lo estipulado en el Artículo 6, inciso o) de la Ley Forestal Nº 7575."

"Artículo 26.-Créase la Comisión Nacional para la Sostenibilidad Forestal (CNSF), como órgano de la AFE. Dicha comisión estará integrada por siete miembros de reconocida solvencia técnica y moral de la siguiente manera: tres representantes de las Universidades Nacionales con desarrollo en carreras de educación superior en el área forestal y recursos naturales, dos representantes de las entidades científicas internacionales con sede en el país de reconocida trayectoria en el campo de la investigación y enseñanza en recursos naturales y forestales, un representante del Fondo Nacional de Financiamiento Forestal y un representante del Colegio de Ingenieros Agrónomos. El Sistema Nacional de Áreas de Conservación (SINAC) como Administración Forestal del Estado convocará y solicitará una terna a las Instituciones señaladas en este artículo al final de cada período de representación en el mes de diciembre, el director de la AFE seleccionará un representante y lo comunicará a la institución correspondiente 15 días después de recibida la terna.

El nombramiento regirá por tres años, pudiendo ser reelectos por períodos iguales. Sin embargo, para darle continuidad al trabajo y contar con un mecanismo de renovación de la Comisión, por primera y única vez fungirán en sus cargos por un período de cuatro años los siguientes representantes: uno de las universidades, dos de las Instituciones científicas internacionales y el del Colegio de Ingenieros Agrónomos.

La Comisión definirá su propio reglamento interno de funcionamiento. Cada representante tendrá derecho a proponer un suplente de la institución correspondiente y su participación se regulará vía reglamento interno.

En caso de renuncia, separación del cargo, o cualquier otro supuesto, el suplente asumirá la representación de la institución. Si la representación de la institución se ausenta de forma permanente, la AFE podrá nombrar el sustituto por el período faltante con base a la terna última enviada por la Entidad; o bien la AFE podrá invitar otra institución de la misma categoría a participar en la Comisión.

Las funciones de la Comisión serán:

a)Recomendar a la Administración Forestal del Estado:

1. Los lineamientos de sostenibilidad forestal aplicables a la actividad, tanto a nivel de unidad de manejo, como a nivel nacional.

2. Los entes y organismos a quienes se le puede otorgar licencia de certificadores forestales nacionales.

3. La suspensión de la licencia a los certificadores forestales nacionales.

4. Reconocimiento de los sistemas de certificación forestal internacional, así como las entidades y organizaciones acreditadas ante éstos.

b)Asesorar a la Administración Forestal del Estado sobre los mecanismos de fomento, regulación y control propios del manejo forestal sostenible.
c)Nombrar subcomisiones técnicas como apoyo a las labores que realiza.
d)La regulación del sistema nacional de sellos verdes o certificación forestal.
e)Apoyar a la AFE en la capacitación y divulgación de los lineamientos de sostenibilidad aplicables a la actividad forestal.
f)Apoyar y participar en iniciativas regionales e internacionales de sistemas internacionales de certificación forestal voluntaria g) Ajustar los lineamientos de sostenibilidad forestal del país a los estándares de manejo de los sistemas internacionales de certificación forestal voluntaria, h) Establecer el reglamento interno de la Comisión.

"Artículo 29.-Las personas físicas o jurídicas que quieran acreditarse como certificadores forestales, deberán cumplir con lo estipulado en el Decreto Ejecutivo Nº 27695-MINAE publicado en La Gaceta Nº 53 del 17 de marzo de 1999."
