Each office belonging to a body of the Administration must coordinate internally, in order to prevent the administered party from having to go to more than one office to request a procedure or requirement.
The entities and bodies of the Public Administration must act among themselves in a coordinated manner, exchanging the information necessary for the resolution of the procedures raised before their instances. In order to comply with the principles of institutional and inter-institutional coordination, the Administration must create databases and lists, to which the offices of the same institution and other institutions may have access; additionally, agreements must be implemented at the inter-institutional level for these purposes. In cases where the Administration does not have databases or defined digital forms, other alternative means must be implemented so that other offices or institutions can have access to the information. [.]" IV.-That article 9 of Law 8220 establishes that no administered party must go to more than one instance, entity, or public body to request the same procedure or requirement that pursues the same purpose. The different entities or bodies of the Public Administration that by law are responsible for knowing about a procedure or requirement whose purpose is common, complementary, or identical, must reach an agreement to establish a single and shared procedure, as well as the origin and institutional competence.
V.-That Executive Decree No. 27967-MP-MIVAH-S-MEIC of July 1, 1999, and its amendments, establishes in its article 3 that prior to the procedure for the approval (visado) of any construction plan by the competent Institutions, it must be approved (visado) by the Federated College of Engineers and Architects of Costa Rica.
VI.-That the Federated College of Engineers and Architects of Costa Rica (hereinafter CFIA), a non-state public entity, has developed and implemented the "Construction Project Manager" (Administrador de Proyectos de Construcción, hereinafter APC) System, for the granting of plan approval (visado de planos) by digital means, to comply with article 54 of Law 3663 and its amendments, "Organic Law of the Federated College of Engineers and Architects of Costa Rica." VII.-That with the implementation of the Construction Project Manager (APC) system, the CFIA has achieved the simplification of the administrative procedure for plan approval (visado de planos) that said institution carries out, with which it has achieved regulatory improvement and simplification of procedures, allowing it to improve its effectiveness, relevance, and usefulness, thus achieving greater speed and functionality in processing, and reduction of operational costs, thereby benefiting the administered parties.
VIII.-That the use of the APC system by the bodies and entities of the Administration that provide plan approval (visado de planos) promotes the efficiency and transparency of the administrative procedure, achieving rationalization and better use of public resources and a reduction in paperwork and waiting times for the administered party, which favors project execution and benefits the country's economic and social development.
IX.-That the Federated College of Engineers and Architects of Costa Rica, by agreements of its Board of Directors of March 30, two thousand six, agreement number 15-05-06-G.E., and of May 4, two thousand six, agreement 18-05-06-G.O., has offered the government of the Republic that the institutions that have competence in the processing of approval (visado) of construction plans use the APC system.
X.-That based on said offer, the Federated College of Engineers and Architects of Costa Rica together with the Ministry of Economy, Industry and Commerce proceeded to develop, from the APC, an Official Portal of the Government of Costa Rica for Construction Procedures, in order to implement the digital approval (visado digital) of construction plans, through the APC.
XI.-That in the portal, among other things, one can access "digital maps with information on protection zones, risk zones, national highways, aqueducts, oil pipelines, sewer systems, forms, requirements, and legislation applicable to each procedure, generating legal certainty and clear rules for the administered party." XII.-That the purpose of these provisions is the rationalization and better use of public resources and the waiting times of the administered party, which creates a favorable climate for the country's competitiveness.
