Technical Regulation for the Registration of Invertebrate Organisms of Agricultural UseReglamento Técnico para el Registro de Organismos Invertebrados de Uso Agrícola

This Regulation establishes the rules for the import, research, marketing, use and quality, of invertebrate organisms for agricultural use for the control of agricultural pests so that they do not cause damage to agriculture and the environment.

This Regulation does not include genetically modified beneficial organisms.

For the purposes of applying this Regulation, the following definitions are established:

1. Biological Control Agent: Natural enemy, antagonist, or competitor or other organism, used for pest control.

2. Environment: It is the surroundings, including water, air, soil and their interrelation, as well as the relationships between these elements and living organisms.

3. Risk Analysis: Process of evaluation and analysis of biological, scientific and economic evidence to determine the phytosanitary measures to be adopted.

4. Arthropod: Term applied to invertebrate animals equipped with an external skeleton and jointed appendages.

5. Product Class: Acaricide, insecticide, nematicide, herbicide, fungicide, biological pollinator based on invertebrate organisms for agricultural use.

6. Marketing: The process of distribution and sale of invertebrate organisms for agricultural use.

7. Biological Control: Control strategy against pests in which natural enemies, antagonists, or competitors, or other biotic entities capable of reproducing are used.

8. Quality Control: Application of procedures to verify that the invertebrate organism for agricultural use complies with the provisions of the respective standards.

9. Container: The recipient that contains invertebrate organisms for agricultural use.

10. Specificity: Measure of the host range of a biological control agent on a scale ranging from the extraordinarily specialized, which can only complete development on a single species or strain of its host (monophagous) to the generalist, with many hosts comprising several groups of organisms (polyphagous).

11. Label: Printed or graphic material that accompanies the container, with the information of the registered product.

12. Host: Any organic substrate that serves as food for a living organism.

13. Importer: Natural or legal person registered with the SFE(*), who introduces invertebrate organisms for agricultural use into the country.

Introduction: Release of a biological control agent into an ecosystem where it did not exist previously.

15. Legislation: Set of laws that make up the positive law of a State.

16. Trade Name: Name with which the registrant company identifies, registers and markets an invertebrate organism for agricultural use.

17. Invertebrate Organism: Arthropods and nematodes for agricultural use used by man in the fight against pests.

18. Absent Invertebrate Organisms: Arthropods and nematodes for agricultural use not present in a country.

19. Present Invertebrate Organisms: Arthropods and nematodes for agricultural use present in a country.

20. Origin: Native geographic territory of the invertebrate 21. Import Permit: Official document that authorizes the import of invertebrate organisms for agricultural use in accordance with specific phytosanitary requirements.

22. Pest: Any species, race or biotype of plant or animal or pathogenic agent harmful to plants or plant products.

23. Producer: Natural or legal person responsible for reproducing invertebrate organisms for agricultural use for marketing purposes.

24. Registrant: Natural or legal person who requests the registration service for a phytosanitary product or invertebrate organism before the SFE(*).

Registration: Legal procedure by which all invertebrate organisms for agricultural use are authorized by the Ministry for their sale and use, in accordance with the provisions of this Regulation.

26. Type of action: Mode of action of the invertebrate organism for agricultural use (parasitoid, predator, pollinator and mutualist) on the different pests.

27. Registration Holder: Natural or legal person who owns the registration of an invertebrate organism for agricultural use at the SFE(*).

The following abbreviations shall be used in this Regulation:

SFE(*): State Phytosanitary Service.

IPM: Integrated Pest Management.

4.1. On the registration of a natural or legal person:

4.1.1. Any natural or legal person who wishes to import, export, re-export, produce, repack, refill and market, invertebrate organisms for agricultural use, or to carry out research for product registration purposes, must be registered with the SFE(*) according to the provisions of this Regulation.

For the registration process, the interested party must fill out the registration form (Annex 1) and submit it to the Registration Program of the SFE(*) with the following information and/or documentation:

• b)Original for comparison or certified copy of the current legal identification card.
• c)Express indication and qualifications of the authorized technical manager and his/her registration with the College of Engineers, indicating the membership number and a photocopy of the technical manager's identity card.
• d)Information or data on the company's registration with the College of Agronomic Engineers.
• e)Authorized signatures for procedures in the Registry.

4.1.3. The SFE(*) shall have a maximum period of ten business days to approve or reject the application.

On the registration of the commercial product:

4.2.1. Every commercial product of an invertebrate organism for agricultural use that is marketed and/or produced in the country must be registered with the SFE(*).

For the registration process of invertebrate organisms for agricultural use, the natural or legal person must submit a written application to the SFE(*) and the following information:

Registrant data a) Name of the natural or legal person requesting the registration.

• b)Qualifications and generalities of the company representative.
• c)Qualifications and generalities of the agricultural technical manager, indicating the membership number.
• d)Place to hear notifications.
• e)Signatures of the legal representative and agricultural technical manager endorsing the information.

4.2.2.2. Commercial product data a) Trade name of the product.

• b)Scientific name of the Invertebrate Organism for Agricultural Use.
• c)Name of the manufacturer and country of origin.
• d)Type of action and class (parasitoid, predator, pollinator, mutualist/ nematicide, acaricide, insecticide, fungicide, herbicide).
• e)Phase of the life cycle in which the product is marketed (egg, larva, pupa, nymph or adult).
• f)Phase of the life cycle in which the product acts (egg, larva, pupa, nymph or adult).
• g)Type and characteristics of the inert ingredients.
• h)Quality certificate issued by an institution recognized by the SFE(*).

4.2.2.3. Information for the Identification of the Invertebrate Organism a) Taxonomic classification of the invertebrate organism for agricultural use.

• b)Information and data for its identification and institutions specialized in the subject.
• c)Life cycle and general description of all the developmental stages of the invertebrate organism.

4.2.2.4. Information on the Use of the Invertebrate Organism a) Common name and taxonomic classification of the pest or pests to be controlled.

• b)Host range of the pest(s).
• c)Specificity of the invertebrate organism for agricultural use.
• d)Information on natural enemies.
• e)Indications for its use in the field, interval between applications and recommended doses.
• f)Compatibility with chemical products, and other beneficial organisms.
• g)Phytosanitary and environmental conditions for its use.

4.2.2.5. Label Draft a) Trade name.

• b)Scientific name.
• c)Presentation (quantity).
• d)Producer.
• e)Registrant.
• f)Country of origin.
• g)Registration number and date.
• h)Agronomic use.
• i)Storage conditions.

4.2.3. When dealing with invertebrate organisms for agricultural use present in the country and that are not considered a pest, the SFE(*) must issue a decision within a period of thirty business days following the date of submission of the application and other complete requirements, approving or rejecting the registration.

When dealing with invertebrate organisms for agricultural use absent from the country, the SFE(*) shall carry out the corresponding risk analysis and supervise the Adaptability and Effectiveness Trial of Absent Invertebrate Organisms in the country if applicable.

In the case of registration applications for invertebrate organisms for agricultural use absent from the country, the SFE(*) must issue a decision approving or rejecting the registration within a period of sixty business days following the date of submission of the information required for the risk analysis and/or the results of the Adaptability and Effectiveness Trial of Absent Invertebrate Organisms in the country, as applicable.

The interested party must submit a written application to the SFE(*) for it to carry out the corresponding risk analysis, providing the following information (issued by an authority recognized by the SFE(*) in the Spanish language):

• b)Experiences in countries where the invertebrate organism has been released.
• c)Means of dispersal.
• d)Documentation provided by the company indicating the benefits related to the effectiveness and biological specificity with the introduction (introducción) of the invertebrate organism.

4.2.7 When the SFE(*) determines that the risk level is acceptable and that the registration process can continue, the natural or legal person must submit a written application to the SFE(*) to carry out a biological efficacy test and provide the Protocol for the Adaptability and Effectiveness Trial of Absent Invertebrate Organisms in the country.

The protocol for the Adaptability and Effectiveness Trial of Invertebrate Organisms for Agricultural Use must be prepared and published by the SFE(*) on its Web page within a period of thirty days after the entry into force of this regulation.

Resolutions issued by the SFE(*) are subject to appeals for reconsideration before the Head of the Department of Agricultural Inputs, appeal before the Director of the SFE(*) and review before the Minister of Agriculture and Livestock as established in the General Law of Public Administration.

Any registration application must be published in the official gazette for three consecutive days, providing a brief description of the same and granting third parties a period of ten business days from the third publication, to present oppositions.

4.2.11. If an opposition is presented, the registrant shall be notified, who must offer their exculpatory evidence within a term of 3 business days counting from the moment in which they were notified. Once this period has elapsed, the SFE(*) must resolve within a period of 8 business days.

4.2.12. Submit proof of payment of fee 3.a established in Executive Decree N° 27763 Fixing of tariffs for the services of the Ministry of Agriculture and Livestock, of March 10, 1999.

On the validity, modification, suspension and cancellation of the registration 4.3.1. The Registration of invertebrate organisms for agricultural use shall have a validity of ten years, without prejudice to the power that the SFE(*) has to carry out studies based on post-registration monitoring and surveillance programs, adopting the pertinent provisions in accordance with the law.

The Registration of Invertebrate Organisms for Agricultural Use may be modified by the registrant, by submitting a written application in the form of a sworn statement in the following cases:

• a)When the registration holder changes, attaching the data and credentials of the new holder.
• b)When the country of origin is expanded or changed, attaching certification from the producing laboratory, demonstrating that the production process is the same as the one originally registered.
• c)When the trade name changes, attaching certification from the Trademark and Trade Name Registry to be designated.
• d)When the presentation is modified, attaching presentations, security seals and type of packaging.
• e)When new pests are added for which the product was registered, providing the corresponding documentation.
• f)When the format or content of the label changes, for which the interested party shall supply the new label draft with the proposed changes.

4.3.3. Modifications to the registration of a specific invertebrate organism shall be made by technical administrative resolution of the SFE(*). Said modification shall retain the corresponding registration number and date.

The suspension, restriction of use and/or cancellation of the registration of invertebrate organisms for agricultural use is applicable, as the case may be:

• a)When requested by the registration holder.
• b)When the SFE(*) determines it under technical scientific or legal justification.

The cancellation of the registration of invertebrate organisms for agricultural use is not an obstacle to the application of other applicable civil, criminal or administrative sanctions or reparations that may apply, in accordance with applicable national legislation.

4.4. On the rights and obligations of the registration holder 4.4.1. The holder of the registration of a commercial product based on invertebrate organisms for agricultural use must request in writing the renewal of the registration before the SFE(*) six months before expiry. If the registration is not renewed, it is automatically cancelled.

The holder of a registration, by means of an authorization notification, may empower one or several persons to carry out the activities of import, export, re-export, production, repacking, refilling or marketing, according to the registration made before the SFE(*).

The registration holder of invertebrate organisms for agricultural use must facilitate the supervision work of the SFE(*).

5.1. Import of Invertebrate Organisms for Agricultural Use for research for registration purposes.

5.1.1. The SFE(*) shall be responsible for regulating and supervising the introduction (introducción) and research for registration purposes and for establishing post-entry quarantine procedures for invertebrate organisms for agricultural use.

Any invertebrate organism for agricultural use that is to be imported must be registered with the Registration Program of the SFE(*), except when the SFE(*) authorizes it in the case of research for registration purposes or emergency and following the provisions described in this regulation.

The interested party in importing an invertebrate organism for agricultural use for research for registration purposes, must request it in writing before the SFE(*) and provide the following information:

• b)Name of the commercial product.
• c)Scientific and common name of the species.
• d)Scientific and common name of the pests it controls.
• e)Provide technical information on the origin of the organism.
• f)Risk analysis approved by the SFE(*).

• h)Quantity of product required to be imported.
• i)Research proposal for invertebrate organisms for agricultural use present in the country without being registered.
• j)Protocol for the Adaptability and Effectiveness Trial of Absent Invertebrate Organisms approved by the SFE(*).

The SFE(*) shall have ten calendar days from receipt of the application and the complete information to grant or deny the import permit for research for registration purposes. In case of rejection of the application, the SFE(*) must document and explain its decision.

The import permit for research for registration purposes shall have the validity approved according to what is proposed in the research protocols and may be extended, with a justified application submitted thirty business days before its expiry and attaching a report of the data obtained during the first investigation.

5.1.6. Any import of invertebrate organisms for agricultural use, not authorized by the SFE(*), must be returned to its place of origin or destroyed. The cost shall be borne by the importer.

6.1. It shall be the responsibility of the SFE(*) to exercise Quality Control over Invertebrate Organisms for Agricultural Use, establishing the corresponding standards.

7.1. In cases of officially declared phytosanitary emergency, the SFE(*) may authorize the import and use of invertebrate organisms for agricultural use present in the country and not registered, for as long as this situation prevails.

8.1. Every label shall contain the information stipulated in section 4.2.2.5.

9.1. The SFE(*) shall create and administer a database containing information on invertebrate organisms of agricultural use to provide informatics support for the management of the registry (registro).

9.2. The registrant (registrante) of invertebrate organisms of agricultural use may indicate which data correspond to industrial or commercial secrets. The SFE(*), by resolution (resolución), shall declare as confidential information all that which it considers in accordance with the provisions of current legislation.

9.3. The technical data and results of efficacy trials (ensayos de eficacia) used for the registration (registro) of invertebrate organisms of agricultural use may not be used for the registration of another product, except when involving the same registration holder (titular del registro) or a third party authorized by the registration holder.

10.1. Legal documents, as well as certifications issued outside the country for registration purposes, must not be more than one year past consularization (consularizadas), and national certifications not more than three months.

10.2. The SFE(*) must train personnel involved in the importation of invertebrate organisms of agricultural use in order to streamline the process, considering their highly perishable nature.

10.3. The SFE(*) may request further information from the registrant should it be required, which must be duly justified.

10.4. The SFE(*) may authorize the production and release of invertebrate organisms of agricultural use by State institutions for research and development of their non-profit activities. These shall inform the SFE(*) of their activities in order to exercise the corresponding quality controls.

I.—The Holder (Titular) of a Registration for Invertebrate Organisms of Agricultural Use who was registered under Decreto Ejecutivo Nº 24337-MAG-S shall have a period of one calendar year, counted from the publication of this Decree, to update the information supplied in the previous registration, in accordance with the provisions of this Regulation.

II.—Every national producer of Invertebrate Organisms of Agricultural Use shall have a period of one year to register their products from the publication of this Regulation.

El presente Reglamento establece las regulaciones para la importación, investigación, comercialización, uso y calidad, de organismos invertebrados de uso agrícola para el control de plagas agrícolas a fin de que no causen perjuicios a la agricultura y al ambiente.

Este Reglamento no incluye los organismos benéficos genéticamente modificados.

Para efectos de la aplicación del presente Reglamento, se establecen las siguientes definiciones:

1. Agente de Control Biológico: Enemigo natural, antagonista, o competidor u otro organismo, utilizado para el control de plagas.

2. Ambiente: Es el entorno, incluyendo el agua, el aire, el suelo y su interrelación, así como las relaciones entre estos elementos y los organismos vivos.

3. Análisis de Riesgo: Proceso de evaluación y análisis, de las evidencias biológicas, científicas y económicas para determinar las medidas fitosanitarias que han de adoptarse.

4. Artrópodo: Término que se aplica a animales invertebrados dotados de un esqueleto externo y apéndices articulados.

5. Clase de Producto: Acaricida, insecticida, nematicida, herbicida, fungicida, polinizador biológico a base de organismos invertebrados de uso agrícola.

6. Comercialización: El proceso de la distribución y venta de organismos invertebrados de uso agrícola.

7. Control Biológico: Estrategia de control contra plagas en que se utilizan enemigos naturales, antagonistas, o competidores vivos, u otras entidades bióticas capaces de reproducirse.

8. Control de Calidad: Aplicación de procedimientos para verificar que el organismo invertebrado de uso agrícola, cumple con lo establecido en las normas respectivas.

9. Envase: El recipiente que contiene organismos invertebrados de uso agrícola.

10. Especificidad: Medida del rango de hospederos de un agente de control biológico bajo una escala que va desde el especializado extraordinariamente, que sólo puede completar el desarrollo en una especie o cepa única de su huésped (monófago) hasta el general, con muchos hospederos que comprenden varios grupos de organismos (polífago).

11. Etiqueta: Material impreso o gráfico que acompaña al envase, con la información del producto registrado.

12. Hospedero: Cualquier sustrato orgánico que sirva de alimento a un organismo vivo.

13. Importador: Persona física o jurídica registrado en el SFE(*), que introduce al país organismos invertebrados de uso agrícola.

Introducción: Liberación de un agente de control biológico en un ecosistema donde no existía anteriormente.

15. Legislación: Conjunto de leyes que integran el derecho positivo de un Estado.

16. Nombre Comercial: Nombre con el cual la empresa registrante identifica, registra y comercializa un organismo invertebrado de uso agrícola.

17. Organismo Invertebrado: Artrópodos y nemátodos de uso agrícola utilizados por el hombre en el combate de plagas.

18. Organismos Invertebrados Ausentes: Artrópodos y nemátodos de uso agrícola no presentes en un país.

19. Organismo Invertebrados Presentes: Artrópodos y nemátodos de uso agrícola presentes en un país.

20. Origen: Territorio geográfico nativo del invertebrado 21. Permiso de Importación: Documento oficial que autoriza la importación de organismos invertebrados de uso agrícola de conformidad con requisitos fitosanitarios específicos.

22. Plaga: Cualquier especie, raza o biotipo vegetal o animal o agente patógeno dañino para las plantas o productos vegetales.

23. Productor: Persona física o jurídica encargada de reproducir organismos invertebrados de uso agrícola con fines de comercialización.

24. Registrante: Persona física o jurídica que solicite el servicio de registro de un producto fitosanitario u organismo invertebrado ante el SFE(*).

Registro: Procedimiento legal mediante el cual todos los organismos invertebrados de uso agrícola son autorizados por el Ministerio para su venta y uso, de acuerdo a lo establecido en el presente Reglamento.

26. Tipo de acción: Modo de acción del organismo invertebrado de uso agrícola (parasitoide, depredador, polinizador y mutualista) sobre las distintas plagas.

27. Titular del Registro: Persona física o jurídica propietaria del registro de un organismo invertebrado de uso agrícola en el SFE(*).

En el presente Reglamento se utilizarán las siguientes abreviaturas:

SFE(*): Servicio Fitosanitario del Estado.

4.1. Sobre el registro de persona física o jurídica:

4.1.1. Toda persona física o jurídica que desee importar, exportar, reexportar, producir, reempacar, reenvasar y comercializar, organismos invertebrados de uso agrícola, o realizar investigaciones con fines de registro de productos, deberá estar inscrita ante el SFE(*) según las disposiciones de este Reglamento.

Para el proceso de registro el interesado debe llenar el formulario de inscripción (anexo 1) y presentarlo ante el Programa de Registro del SFE(*) con la siguiente información y/o documentación:

• b)Original para ser confrontada o copia certificada de la cédula jurídica vigente.
• c)Indicación expresa y calidades del regente autorizado y su inscripción en el Colegio de Ingenieros, indicando el número de colegiado y fotocopia de la cédula de identidad del regente.
• d)Información o datos de la inscripción de la empresa en el Colegio de Ingenieros Agrónomos.
• e)Firmas autorizadas para trámites en el Registro.

4.1.3. El SFE(*) tendrá un plazo máximo de diez días hábiles para aprobar o rechazar la solicitud.

Sobre el registro del producto comercial:

4.2.1. Todo producto comercial de un organismo invertebrado de uso agrícola que se comercialice y/o produzca en el país, debe estar registrado ante el SFE(*).

Para el proceso de registro de organismos invertebrados de uso agrícola, la persona física o jurídica deberá presentar una solicitud escrita al SFE(*) y la siguiente información:

Datos del registrante a) Nombre de la persona física o jurídica que solicita el registro.

• b)Calidades y generalidades del representante de la compañía.
• c)Calidades y generalidades del regente agrícola indicando el número de colegiado.
• d)Lugar para oír notificaciones.
• e)Firmas del representante legal y regente agrícola avalando la información.

4.2.2.2. Datos del producto comercial a) Nombre comercial del producto.

• b)Nombre científico del Organismo Invertebrado de Uso Agrícola.
• c)Nombre del fabricante y país de origen.
• d)Tipo de acción y clase (parasitoide, depredador, polinizador, mutualista/ nematicida, acaricida, insecticida, fungicida, herbicida).
• e)Fase del ciclo biológico en la cual se comercializa el producto (huevo, larva, pupa, ninfa o adulto).
• f)Fase del ciclo biológico en el que actúa el producto (huevo, larva, pupa, ninfa o adulto).
• g)Tipo y características de los ingredientes inertes.
• h)Certificado de calidad emitido por una institución reconocida por el SFE(*).

4.2.2.3. Información para la identificación del Organismo Invertebrado a) Clasificación taxonómica del organismo invertebrado de uso agrícola.

• b)Información y datos para su identificación e instituciones especializadas en el tema.
• c)Ciclo de vida y descripción general de todos los estadíos de desarrollo del organismo invertebrado.

4.2.2.4. Información Sobre el Uso del Organismo Invertebrado a) Nombre común y clasificación taxonómica de la o las plagas a controlar.

• b)Rango de hospederos de la(s) plaga(s).
• c)Especificidad del organismo invertebrado de uso agrícola.
• d)Información sobre enemigos naturales.
• e)Indicaciones sobre su uso en campo, intervalo entre aplicaciones y dosis recomendadas.
• f)Compatibilidad con productos químicos, y otros organismos benéficos.
• g)Condiciones fitosanitarias y ambientales para su uso.

4.2.2.5. Proyecto de Etiqueta a) Nombre comercial.

• b)Nombre científico.
• c)Presentación (cantidad).
• d)Productor.
• e)Registrante.
• f)País de origen.
• g)Número y fecha de Registro.
• h)Uso agronómico.
• i)Condiciones de almacenamiento.

4.2.3. Cuando se trate de organismos invertebrados de uso agrícola presentes en el país y que no se consideren plaga, el SFE(*) deberá pronunciarse en un plazo de treinta días hábiles siguientes a la fecha de presentación de la solicitud y demás requisitos completos, aprobando o rechazando el registro.

Cuando se trate de organismos invertebrados de uso agrícola ausentes en el país, el SFE(*) realizará el análisis de riesgo correspondiente y supervisará el Ensayo de Adaptabilidad y Efectividad de Organismos Invertebrados Ausentes en el país si corresponde.

En caso de solicitudes de registro de organismos invertebrados de uso agrícola ausentes en el país, el SFE(*) deberá pronunciarse aprobando o rechazando el registro en un plazo de sesenta días hábiles siguientes a la fecha de presentación de la información requerida para el análisis de riesgo y/o de los resultados del Ensayo de Adaptabilidad y Efectividad de Organismos Invertebrados Ausentes en el país según corresponda.

El interesado deberá presentar solicitud por escrito al SFE(*) para que realice el análisis de riesgo correspondiente aportando la siguiente información (emitida por una autoridad reconocida por el SFE(*) en idioma español):

• b)Experiencias en países donde se haya liberado el organismo invertebrado.
• c)Medios de dispersión.
• d)Documentación aportada por la empresa que indique los beneficios relacionados a la efectividad y especificidad biológica con la introducción del organismo invertebrado.

4.2.7 Cuando el SFE(*) determine que el nivel de riesgo es aceptable y que se puede continuar con el proceso de registro, la persona física o jurídica deberá presentar solicitud por escrito al SFE(*) para realizar una prueba de eficacia biológica y aportar el Protocolo para el Ensayo de Adaptabilidad Y Efectividad de Organismos Invertebrados Ausentes en el país.

El protocolo de Ensayo de Adaptabilidad y Efectividad de Organismos Invertebrados de Uso Agrícola deberá ser elaborado y publicado por el SFE(*) en su página Web en un plazo de treinta días posteriores a la entrada en vigencia del presente reglamento.

A las resoluciones emitidas por el SFE(*) les caben recursos de revocatoria ante el Jefe del Departamento de Insumos Agrícolas, apelación ante el Director del SFE(*) y revisión ante el Ministro de Agricultura y Ganadería según lo establecido en la Ley General de la Administración Pública.

Toda solicitud de inscripción deberá publicarse en el diario oficial por tres días consecutivos, haciendo una breve descripción de la misma y confiriendo a terceros un plazo de diez días hábiles a partir de la tercera publicación, para presentar oposiciones.

4.2.11. De presentarse una oposición se notificará al registrante, quien deberá ofrecer sus pruebas de descargo dentro del término de 3 días hábiles contando a partir del momento en que fue notificado. Transcurrido este plazo, el SFE(*) debe resolver en el período de 8 días hábiles.

4.2.12. Presentar el comprobante de pago de la tarifa 3.a establecida en el Decreto Ejecutivo N° 27763 Fijación de tarifas de los servicios del Ministerio de Agricultura y Ganadería, del 10 de marzo de 1999.

De la vigencia, modificación, suspensión y cancelación del registro 4.3.1. El Registro de organismos invertebrados de uso agrícola tendrá una vigencia de diez años, sin perjuicio de la potestad que tiene el SFE(*) para realizar estudios sobre la base de los programas de seguimiento y vigilancia post registro, adoptando las disposiciones pertinentes conforme a la ley.

El Registro de Organismos Invertebrados de Uso Agrícola podrá ser modificado por el registrante, presentando solicitud por escrito con carácter de declaración jurada en los siguientes casos:

• a)Cuando cambie el titular del registro, adjuntando los datos y credenciales del nuevo titular.
• b)Cuando se amplíe o cambie el país de origen, adjuntando certificación del laboratorio productor, demostrando que el proceso de producción es igual al registrado originalmente.
• c)Cuando cambie el nombre comercial, adjuntando certificación del Registro de Marcas y nombre comercial a designar.
• d)Cuando se modifique la presentación, adjuntando presentaciones, sellos de seguridad y clase de empaque.
• e)Cuando se adicionen nuevas plagas para los cuales se registró el producto aportando la documentación correspondiente.
• f)Cuando cambie el formato o el contenido de la etiqueta, para lo cual el interesado suministrará el nuevo proyecto de etiqueta con los cambios propuestos.

4.3.3. Las modificaciones al registro de un determinado organismo invertebrado, se realizarán mediante resolución técnica administrativa del SFE(*). Dicha modificación conservará el número y fecha de registro correspondiente.

La suspensión, restricción de uso y/o cancelación del registro de organismos invertebrados de uso agrícola procede, según sea el caso:

• a)Cuando lo solicite el titular del registro.
• b)Cuando el SFE(*) lo determine bajo justificación técnica científica o legal.

La cancelación del registro de organismos invertebrados de uso agrícola no es obstáculo para la aplicación de las demás sanciones o reparaciones civiles, penales o administrativas que correspondan, de conformidad con la legislación nacional aplicable.

4.4. De los derechos y obligaciones del titular de registro 4.4.1. El titular del registro de un producto comercial a base de organismos invertebrados de uso agrícola debe solicitar por escrito la reinscripción del registro ante el SFE(*) con seis meses de antelación al vencimiento. Si no se renueva el registro, automáticamente es cancelado.

El titular de un registro, mediante una notificación de autorización, podrá facultar a una o varias personas a ejercer las actividades de importación, exportación, reexportación, producción, reempaque, reenvasado o comercialización, según la inscripción realizada ante el SFE(*).

El titular del registro de organismos invertebrados de uso agrícola debe facilitar la labor de supervisión del SFE(*).

5.1. Importación de Organismos Invertebrados de Uso Agrícola para la investigación con fines de registro.

5.1.1. El SFE(*) será el responsable de regular y supervisar la introducción e investigación con fines de registro y de establecer los procedimientos de cuarentena post entrada de organismos invertebrados de uso agrícola.

Todo organismo invertebrado de uso agrícola que se quiera importar debe estar registrado ante el Programa de Registro del SFE(*), excepto cuando el SFE(*) lo autorice en caso de investigación con fines de registro o emergencia y siguiendo las disposiciones descritas en este reglamento.

El interesado en importar un organismo invertebrado de uso agrícola con fines de investigación para registro, deberá solicitarlo por escrito ante el SFE(*) y aportar la siguiente información:

• b)Nombre del producto comercial.
• c)Nombre científico y común de la especie.
• d)Nombre científico y común de las plagas que controla.
• e)Aportar información técnica de la procedencia del organismo.
• f)Análisis del riesgo aprobado por el SFE(*).

• h)Cantidad de producto requerido a importarse.
• i)Propuesta de investigación para organismos invertebrados de uso agrícola presentes en el país sin estar registrados.
• j)Protocolo para Ensayo de Adaptabilidad Y Efectividad de Organismos Invertebrados Ausentes aprobado por el SFE(*).

El SFE(*) contará con diez días naturales a partir del recibo de la solicitud y de la información completa para otorgar o denegar el permiso de importación para investigación con fines de registro. En caso de rechazo de la solicitud el SFE(*) deberá documentar y explicar su decisión.

El permiso de importación para la investigación con fines de registro tendrá la vigencia aprobada según lo propuesto en los protocolos de investigación y podrá ser ampliado, debiendo presentar solicitud justificada treinta días hábiles antes de su vencimiento y adjuntando un informe de los datos obtenidos durante la primera investigación.

5.1.6. Toda importación de organismos invertebrados de uso agrícola, no autorizada por el SFE(*), debe ser devuelta a su lugar de origen o destruida. El costo correrá por parte del importador.

6.1. Le corresponderá al SFE(*) ejercer el Control de Calidad sobre los Organismos Invertebrados de Uso Agrícola estableciendo las normas que correspondan.

7.1. En los casos de emergencia fitosanitaria declarada oficialmente, el SFE(*) podrá autorizar la importación y utilización de organismos invertebrados de uso agrícola presentes en el país y no registrados, mientras prevalezca dicha situación.

8.1. Toda etiqueta contendrá la información estipulada en el punto 4.2.2.5.

9.1. El SFE(*) creará y administrará una base de datos con información de organismos invertebrados de uso agrícola para darle soporte informático a la gestión del registro.

9.2. El registrante de organismos invertebrados de uso agrícola podrá indicar cuáles datos corresponden a secretos industriales o comerciales. El SFE(*) mediante resolución declarará como información confidencial toda aquella que considere según lo establecido por la legislación vigente.

9.3. Los datos técnicos y los resultados de los ensayos de eficacia empleados para el registro de organismos invertebrados de uso agrícola, no pueden ser utilizados para el registro de otro producto, salvo que se trate del mismo titular del registro o un tercero autorizado por el titular del registro.

10.1. Los documentos legales, así como las certificaciones emitidas fuera del país con fines de registro no deben de tener más de un año de consularizadas y las certificaciones nacionales más de tres meses.

10.2. El SFE(*) debe capacitar al personal involucrado en la importación de organismos invertebrados de uso agrícola a fin de agilizar el proceso, considerando su naturaleza altamente perecedera.

10.3. El SFE(*) podrá solicitar mayor información al registrante en caso de ser requerida, lo cual deberá justificarse debidamente.

10.4. El SFE(*) podrá autorizar la producción y liberación de organismos invertebrados de uso agrícola de instituciones del Estado para la investigación y desarrollo de sus acciones sin fines de lucro. Estas deberán informar al SFE(*) de sus actividades a fin de ejercer los controles de calidad correspondientes.

I.-El Titular de un Registro de Organismos Invertebrados de Uso Agrícola que se haya registrado amparado al Decreto Ejecutivo Nº 24337-MAG-S, tendrá un plazo de un año calendario, contado a partir de la publicación del presente Decreto, para actualizar la información suministrada en el registro anterior, conforme a lo dispuesto en este Reglamento.

II.-Todo productor nacional de Organismos Invertebrados de Uso Agrícola contará con un plazo de un año para registrar sus productos a partir de la publicación del presente Reglamento.
