throughout the entire text - Complete Text of Norm 33164 Reform of the Executing Office of the Physical Infrastructure Investment Plan of the Ministry of Environment and Energy, as a technical and administrative support office Complete Text of record: CC533 Nº 33164-MINAE Nº 33164-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Using the powers conferred upon them by article 140, subsections 2), 3), 8) and 18), of the Political Constitution and Law Nº 7152 of June 5, 1990, "Ley Orgánica del Ministerio del Ambiente y Energía", and
I.—That through Decreto Ejecutivo N° 29735-MINAE published in La Gaceta Nº 166 of August 30, 2001, the Executing Office of the Physical Infrastructure Investment Plan of MINAE was created, defining its functions.
II.—That through report Nº FOE-AM-17/2001, the Contraloría General de la República directed MINAE to take internal control measures regarding the development of its physical infrastructure.
III.—That expressly, through official communication Nº DM-047-2002, the Ministerial Office of MINAE informed the Contraloría General de la República that: "In relation to the recommendation aimed at taking internal control measures regarding the follow-up of public works projects, as has been established in this communication, this Office considers that the Ministry already took those required control measures by creating the Executing Office of the Physical Infrastructure Investment Plan of the Ministry of Environment and Energy, through Decreto Ejecutivo Nº 29735-MINAE, published in La Gaceta of August 30 last".
IV.—That additionally, through reports Nos. DFOE-AM- 2/2003 and DFOE-AM-38/2005, the Contraloría General de la República points out the importance of the cited Executing Office as a support body for the Ministerial Office for taking internal control measures regarding the development of MINAE's physical infrastructure.
V.—That since January 15, 2003, the cited Executing Office was forced to suspend engineering and architecture drawing work, due to the fact that the Architectural Draftsperson was withdrawn and, to date, despite the efforts made by MINAE, the corresponding position has not been filled or the transfer to that Executing Office of a suitable official to cover those functions has not been achieved.
VI.—That Decreto Ejecutivo N° 29735-MINAE defines for the cited Executing Office a series of functions that involve the preparation of plans or Engineering or Architecture drawing and that given the lack of an Architectural Draftsperson, their fulfillment is materially impossible, a situation that in turn affects the adequate fulfillment of other related functions.
VII.—That given the noted reality and in attention to the sense of responsibility that should characterize the Administration, a modification of the cited Decreto Ejecutivo N° 29735-MINAE is binding, so that the functions that it stipulates for MINAE are consistent with its capacity to fulfill them. Therefore:
THEY DECREE:

Said Advisory Office shall depend directly on the (*)Sistema Nacional de Áreas de Conservación and shall be governed by the provisions that it issues regarding investment in physical infrastructure.

"c) To oversee (Fiscalizar) the development of physical infrastructure carried out through international cooperation projects"; "g) To prepare the technical documents necessary to carry out the contracting procedures for preliminary studies, site plans (planos de conjunto), preliminary project plans and construction plans of the Ministry's physical plant projects"; "h) To oversee (Fiscalizar) the deadlines and priorities established in the development of the physical infrastructure of the Ministry"; "i) To oversee (Fiscalizar) the progress of projects and monitor compliance with the corresponding technical specifications, general standards and other contractual documents established for the development of the Ministry's physical infrastructure".

I.—Que mediante Decreto Ejecutivo N° 29735-MINAE publicado en La Gaceta Nº 166 del 30 de agosto del 2001, se creó la Oficina Ejecutora del Plan de Inversiones en Infraestructura Física del MINAE, definiéndose sus funciones.
II.—Que mediante informe Nº FOE-AM-17/2001, la Contraloría General de la República dispuso al MINAE que tomara medidas de control interno en materia de desarrollo de su infraestructura física.
III.—Que expresamente, mediante oficio Nº DM-047-2002, el Despacho Ministerial del MINAE informó a la Contraloría General de la República que: "En relación con la recomendación dirigida a que se tomen las medidas de control interno en materia de seguimiento a los proyectos de obra pública, según se ha establecido en el presente oficio, considera este Despacho que el Ministerio ya tomó esas medidas de control que se requerían al crear la Oficina Ejecutora del Plan de Inversiones en Infraestructura Física del Ministerio del Ambiente y Energía, mediante Decreto Ejecutivo Nº 29735-MINAE, publicado en La Gaceta del 30 de agosto anterior".
IV.—Que adicionalmente, mediante informes Nos. DFOE-AM- 2/2003 y DFOE-AM-38/2005, la Contraloría General de la República señala la importancia de la citada Oficina Ejecutora como instancia de apoyo al Despacho Ministerial para la toma de medidas de control interno en materia de desarrollo de infraestructura física del MINAE.
V.—Que desde el 15 de enero del 2003, la citada Oficina Ejecutora se vio obligada a suspender los trabajos de dibujo de ingeniería y arquitectura, con motivo de que se retiró el Dibujante Arquitectónico y, a la fecha, no obstante los esfuerzos efectuados por el MINAE, no se ha logrado la consecución de la plaza correspondiente o bien el traslado a esa Oficina Ejecutora de algún funcionario idóneo para cubrir esas funciones.
VI.—Que el Decreto Ejecutivo N° 29735-MINAE le define a la citada Oficina Ejecutora una serie de funciones que implican la elaboración de planos o dibujo de Ingeniería o Arquitectura y que ante la falta de Dibujante Arquitectónico resulta materialmente imposible su cumplimiento, situación que a su vez afecta el adecuado cumplimiento de otras funciones conexas.
VII.—Que ante la realidad apuntada y en atención al sentido de responsabilidad que debe caracterizar a la Administración, resulta obligante una modificación del citado Decreto Ejecutivo N° 29735-MINAE, de manera que las funciones que éste estipula al MINAE sean concordantes con su capacidad de cumplirlas. Por tanto:
Considerando:
DECRETAN:
Dicha Oficina Asesora dependerá directamente del (*)Sistema Nacional de Áreas de Conservación y se regirá por las disposiciones que éste emita en materia de inversión en infraestructura física.

"c) Fiscalizar el desarrollo de infraestructura física que se realice a través de proyectos de cooperación internacional"; "g) Elaborar los documentos técnicos necesarios para efectuar los procedimientos de contratación de estudios preliminares, planos de conjunto, planos de anteproyecto y planos constructivos de los proyectos de planta física del Ministerio"; "h) "Fiscalizar los plazos y prioridades establecidas en el desarrollo de la infraestructura física del Ministerio"; "i) Fiscalizar el avance de los proyectos y vigilar que se cumplan las correspondientes especificaciones técnicas, las normas generales y demás documentos contractuales que se establezcan para el desarrollo de la infraestructura física del Ministerio".
"c) Establecer mecanismos tendientes a lograr la mayor eficacia y eficiencia para la fiscalización del desarrollo de la infraestructura física del Ministerio"; " d) Vigilar que se cumplan con eficacia y dentro de los plazos establecidos, todos los aspectos técnicos, administrativos y financieros relativos a los proyectos de desarrollo de infraestructura física del Ministerio".
