1That in various areas of the country, Refinadora Costarricense de Petróleo S. A. needs to execute projects regarding the importation, refining, transportation, storage, and marketing of hydrocarbons in order to meet the ever-increasing demand for their consumption.
2That the country's development policies planned by the State necessarily entail the improvement of Costa Ricans' quality of life, which depends, among other things, on the efficient and timely supply of fuels.
3That for the purpose of achieving the objectives set by said Refinadora, the construction of investment works must be actively and systematically promoted to develop projects for the importation, refining, fuel transfer, and storage of hydrocarbons, in order to meet the country's needs.
4That in order to carry out such tasks, it is occasionally required, in exceptional cases, to cut trees located within the area designated for carrying out works to meet the national demand for hydrocarbons, as well as for their transportation between their different facilities distributed throughout the length and breadth of the country, given that in some cases these areas are comprised of lands forming part of the State's natural heritage and within protection areas (áreas de protección) of state or private property.

5º-Article 1 of the Forest Law (Ley Forestal), No. 7575 establishes as an essential and priority function of the State to ensure the conservation, protection, and administration of natural forests and the production, utilization, industrialization, and promotion of the country's forest resources destined for that purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources, designating for this purpose the Ministry of Environment and Energy (Ministerio del Ambiente y Energía, MINAE) as the governing body on the matter.

6That in accordance with article 34 of the aforementioned law, the State Forest Administration (Administración Forestal del Estado) may authorize the cutting of trees in protection areas (áreas de protección) in cases of projects declared by the Executive Branch as being of national convenience. Therefore,

THEY DECREE:

Considering:

A., regarding the importation, refining, transportation, storage, and marketing of hydrocarbons, are hereby declared of public interest.

A. shall replace the trees in the affected areas at a ratio of one to ten reforested trees of species native to the area, with the faithful interest of ensuring sustainable development in its development projects.

1Que en diversas zonas del país, la Refinadora Costarricense de Petróleo S. A. requiere ejecutar proyectos en lo referente a importación refinación, transporte, almacenamiento y comercialización de hidrocarburos con el fin de afrontar la demanda cada día mayor en el consumo de los mismos.
2Que las políticas de desarrollo del país proyectadas por el Estado conllevan necesariamente el mejoramiento de la calidad de vida de los costarricenses, lo cual depende, entre otras cosas, del suministro eficiente y oportuno de los combustibles.
3Que con el propósito de alcanzar los objetivos propuestos por dicha Refinadora, se debe promover planificada y activamente la construcción de obras de inversión para desarrollar proyectos de importación, refinación trasiego de combustible y almacenamiento de hidrocarburos, con el fin de satisfacer las necesidades del país.
4Que con el fin de llevar a cabo tales cometidos, se requiere en algunas ocasiones, consideradas de excepciones, la corta de árboles que se encuentren dentro del área determinada para realizar obras que atiendan la demanda nacional de hidrocarburos, así como para su transporte entre sus diferentes planteles distribuidos a lo largo y ancho del país, siendo que en algunos casos estas áreas se encuentran comprendidas por terrenos de patrimonio natural del Estado y en áreas de protección de propiedad estatal o privada.

5º-El artículo 1° de la Ley Forestal, N° 7575 establece como función esencial y prioritaria del Estado, velar por la conservación, protección, administración de los bosques naturales y por la producción, aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado sostenible de los recursos naturales renovables, estableciéndose a ese efecto como órgano rector a la materia al Ministerio del Ambiente y Energía.

6Que de conformidad con el artículo 34 de la supra citada ley, Administración Forestal del Estado puede autorizar la corta de los árboles en las áreas de protección en los casos de proyectos declarados por el Poder Ejecutivo como de conveniencia nacional. Por tanto,

DECRETAN:

A., en lo referente a importación, refinación, transporte, almacenamiento y comercialización de hidrocarburos.

Artículo 3 — The tree-cutting authorizations shall be processed before the Subregional Offices of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) that correspond by jurisdiction in each case.

Artículo 5 — This decree shall be effective as of its publication.
