Resolution No. 153 -2005 (COMIECO XXXIII) THE COUNCIL OF MINISTERS FOR ECONOMIC INTEGRATION
That in accordance with the provisions of Article 17.7 (Communications Relating to the Enforcement of Environmental Legislation) of the Free Trade Agreement signed among Central America, the Dominican Republic, and the United States, the Parties shall designate a Secretariat or other appropriate body.
That in order to comply with the provisions of the Agreement, on February 18, 2005, the Parties to the Agreement signed an Understanding regarding the Establishment of the Secretariat for Environmental Affairs, in which it was agreed to request the Secretariat for Central American Economic Integration (SIECA) to establish a unit to handle matters relating to Articles 17.7 and 17.8 of the Agreement.
That to make said decision effective, the signing of an appropriate arrangement or agreement is required between the Government Parties to the Agreement and SIECA in order to define the conditions, requirements, procedures, and guidelines for the development of the Secretariat's functions, guaranteeing its operability with the necessary independence; for which the authorization of the Council of Ministers for Economic Integration is required, since SIECA is the technical and administrative body of the Economic Integration Subsystem;
Based on Articles 1, 36, 37, 38, and 55 of the Protocol to the General Treaty on Central American Economic Integration - Guatemala Protocol,
1. To authorize SIECA to establish the Secretariat for Environmental Affairs, which shall serve as the "secretariat or other appropriate body" referred to in Article 17.7.1 of the Agreement and to undertake the functions established in Articles 17.7 and 17.8 of the Agreement.
2. The authorization referred to in the preceding paragraph grants SIECA the power to sign an appropriate arrangement or agreement with the Government Parties to the Agreement, establishing the conditions, requirements, and financial resources for the establishment of the aforementioned Secretariat.
3. This Resolution shall enter into force immediately and shall be published by the States Parties.
