No. 135 The Embassy of the United States of America presents its compliments to the Ministry of Foreign Relations of the Republic of Costa Rica, and wishes to refer to the Screwworm Eradication Cooperative Agreement made between the United States Department of Agriculture (USDA) and the Ministry of Agriculture and Livestock of Costa Rica (MAG), dated October 29, 1993 (hereinafter, the "Agreement"). The Embassy also wishes to refer to the conversations that have taken place between representatives of the USDA and the MAG in recent months regarding the possibility of amending the Agreement for the purpose of carrying out an adequate distribution of the program costs contemplated in Article 12 of the Agreement.
The Embassy proposes adding the following in Article 12 of the Agreement at the end of the third paragraph, so that it reads as follows: "...For the described purposes, the contribution to the Program made by the MAG, the local counterpart, will be used for the payment of salaries and per diems of the Program officials, as well as for the purchase of fuel and equipment to carry out the prevention and epidemiological surveillance efforts in the eradication of the screwworm." Furthermore, the Embassy proposes eliminating the two amendments made to Article 9 of the Agreement through note No. 59 from the Embassy dated June 30, 1998 and note No. 831- 98DGPE/STI from the Ministry of Foreign Relations, dated October 1, 1998; likewise, the words: "assistance from the MAG" in the title of the Article and the phrase: "The MAG may assist the USDA in achieving the objectives of Article 8, from letter A to C", are deleted from the end of the article.
This amendment empowers the MAG to provide epidemiological surveillance resources, including the maintenance of Costa Rica's screwworm-free status, at a level of 15 percent of the funds originally committed in the Agreement.
If the Government is in agreement with said proposals, the Embassy proposes that this Note and the Note in response from the Ministry should constitute an agreement to amend the Agreement; according to Article 15 of the Agreement, which will enter into force on the date of the Ministry's note.

Embassy of the United States of America San José, August 3, 2005" The Ministry of Foreign Relations and Worship has the honor to communicate to the Honorable Embassy of the United States of America, the acceptance of the Government of the Republic of Costa Rica, of the Note transcribed above, for which reason this and the present affirmative response note shall constitute an Agreement on the matter between the two Governments, on the understanding that it shall enter into force on the date on which the Government of the Republic of Costa Rica communicates through diplomatic channels to the Government of the United States of America, the fulfillment of the formalities of its legal system.
