Full Text Record: 91CF5 No. 32517 No. 32517 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Using the powers conferred in articles 140, subsections 3), 8), 18) and 20) and 146 of the Political Constitution, articles 25, 27.1, 28.2b of Law No. 6227 of May 2, 1978, General Law of Public Administration, and article 18 of Law No. 6877 of July 18, 1983, Law for the Creation of the National Groundwater, Irrigation, and Drainage Service.
1st—That in accordance with the provisions of the SENARA Creation Law (Law No. 6877), through Executive Decree No. 19628-MAG of April 20, 1990, the Irrigation and Drainage and Soil Conservation Zone District of Osa-Golfito and Corredores of the Province of Puntarenas was created.
2nd—That the excessive territorial dimension with which said District was created has not allowed for the materialization of an integrated development plan for the irrigation and drainage areas, and instead, what has been carried out are isolated actions, executed to meet the needs of some associations or cooperatives that have managed the resources for their projects.
3rd—That added to the above are factors related to the banana market, low international prices, high financial costs, and the adverse effect of various natural phenomena, which have caused the banana activity to disappear as the main productive activity of the zone and with it the consequent irrigation service by SENARA, which has remained suspended since 2001.
4th—That the occurrence of natural phenomena, the viability of productive projects, and the scale of the required investments have hindered the generation of productive activities requiring irrigation or drainage that justify the cost of rehabilitating and maintaining the network, and such characteristics of agricultural development make the provision of the public service through the figure of the Irrigation, Drainage, and Soil Conservation District and the consequent charging of the users of that service poorly functional.
5th—That institutional plans, programs, and projects must be designed based on the organization, planning, and execution of actions regarding the protection and management of water resources within the definition of a hydrographic basin and sub-basin (cuenca y subcuenca hidrográfica), with coordination and integration with sectoral, municipal, and civil society organizational bodies, strategies towards which State action, and particularly that of SENARA, must be reoriented. Therefore:

19628-MAG, of April 20, 1990, published in La Gaceta No. 93 of May 17 of the same year, by which the Irrigation, Drainage, and Soil Conservation Zone District of Osa, Golfito, and Corredores of the Province of Puntarenas was created, is hereby repealed.
6877, shall make technical recommendations to Minae, so that the available public waters with which irrigation service was provided are given in concession (concesión) in a rational and democratic manner to the organized users who, for such purposes, submit the concession request through the established legal means.
