in the entirety of the text - Complete Text of Regulation 32052 Declaration of National State of Emergency due to the Quarantine Pest Rice Panicle Mite Complete Text of act: E3EC6 No. 32052 No. 32052 (This decree was repealed by Article 6 of Executive Decree No. 36827 of October 4, 2011) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In the exercise of the powers established in Articles 140, subsections 3), 8), 18) and 20) and 146 of the Political Constitution, Articles 25, 27.1, 28.2.b of Law No. 6227 of May 2, 1978, General Law of Public Administration, and Law No. 7664 of April 8, 1997, Phytosanitary Protection Law.

1That preventing and avoiding the spread and dissemination of pests and diseases that threaten food security and the economic activity sustained by agricultural production constitutes one of the essential purposes of the State Phytosanitary Service (Servicio Fitosanitario del Estado).
2That the State Phytosanitary Service has confirmed, within national territory, the presence of the pest called Rice Panicle Mite, (Steneotarsonemus spinki Smiley), which until now was considered exotic, as it had not been detected in the rice plantations of our country.
3That the Rice Panicle Mite constitutes a pest of great quarantine importance, which affects plantations and especially the grain.
4That it is necessary to adopt the technical and legal measures that make it possible to prevent the dissemination of the pest, in order to reduce the damages and losses it causes to rice activity and the national economy.
5That in the presence of pests of quarantine and economic importance that threaten agricultural production, the Executive Branch may decree a National State of Emergency. Therefore:

Considering:

DECREE:

The declaration of obligatory combat imposes upon the owners or occupants of properties the obligation to implement, with their own resources, the technical measures necessary to combat the pest and prevent its dissemination.

Otherwise, action shall be taken in accordance with the provisions of Article 15 of the Phytosanitary Protection Law No. 7664.

For the purposes of detection and control of the pest, the officials of the State Phytosanitary Service shall have free access to the rice plantations.

1Que el evitar y prevenir la propagación y diseminación de las plagas y enfermedades, que amenazan la seguridad alimentaria y la actividad económica sustentada en la producción agrícola, constituye uno de los propósitos esenciales del Servicio Fitosanitario del Estado.
2Que el Servicio Fitosanitario del Estado, ha confirmado en territorio nacional, la presencia de la plaga denominada como Acaro del Vaneo del Arroz, (Steneotarsonemus spinki Smiley), la cual hasta ahora, era considerada exótica pues no había sido detectada en las plantaciones arroceras de nuestro país.
3Que el Acaro del Vaneo del Arroz, constituye una plaga de gran importancia cuarentenaria y que afecta las plantaciones y en especial el grano.
4Que se hace necesario adoptar las medidas técnicas y jurídicas, que permitan evitar la diseminación de la plaga, a efecto de disminuir los daños y perjuicios que ocasiona a la actividad arrocera y a la economía nacional.
5Que ante la presencia de plagas, de importancia cuarentenaria y económica, que amenacen la producción agrícola, el Poder Ejecutivo podrá decretar Estado de Emergencia Nacional. Por tanto:

DECLARATORIA DE ESTADO DE EMERGENCIA NACIONAL POR LA PLAGA CUARENTENARIA ACARO DEL VANEO DEL ARROZ (Steneotarsonemus spinki Smiley)

Considerando:

DECRETAN:

La declaración de combate obligatorio, impone a los propietarios u ocupantes de predios, la obligación de poner en práctica, con recursos propios, las medidas técnicas necesarias para combatir la plaga y prevenir su diseminación.

En caso contrario se procederá conforme a lo dispuesto en el Artículo 15 de la Ley de Protección Fitosanitaria Nº 7664.

Para efectos de detección y control de la plaga, los funcionarios del Servicio Fitosanitario tendrán libre acceso a las plantaciones arroceras.

Dado en la Presidencia de la República.-San José, a los veintisiete días del mes de setiembre del dos mil cuatro.

Artículo 1 — —A national quarantine emergency is officially declared due to the presence within national territory of the pest called Rice Panicle Mite (Steneotarsonemus spinki Smiley).

Artículo 2 — —The fight against said pest is of a particular and obligatory combat nature, and all phytosanitary measures issued by the Executive Branch through the State Phytosanitary Service are of Public Order and mandatory compliance.

Artículo 3 — —Every producer, beneficiary, or public or private entity, involved directly or indirectly in rice production, who has knowledge of the pest, must report it to the State Phytosanitary Service.

Artículo 4 — —The owners of rice plantations affected by the mite must execute all sanitary measures ordered by the State Phytosanitary Service and whomever it designates.

Artículo 5 — —As an immediate effect of the detection of the pest, the affected plantation shall immediately be quarantined.

Artículo 6 — —With the purpose of preventing and combating the pest, the State Phytosanitary Service may restrict and prohibit rice production, pursuant to Article 18 of the Phytosanitary Protection Law No.

Artículo 10 — —It shall be effective as of its publication.

Artículo 4 — Los propietarios de las plantaciones de arroz afectadas por el ácaro, deberán ejecutar todas las medidas sanitarias que se les ordene, por parte del Servicio Fitosanitario del Estado y a quien él designe.

Artículo 5 — Como efecto inmediato de la detección de la plaga, la plantación afectada quedará de inmediato cuarentenada.

Artículo 6 — Con el propósito de prevenir y combatir la plaga, el Servicio Fitosanitario del Estado, podrá restringir y prohibir la producción de arroz, según el Artículo 18 de la Ley de Protección Fitosanitaria Nº 7664.

Artículo 10 — Rige a partir de su publicación.
