Complete Text of record: 75787 No. 31879-H No. 31879-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on Articles 140, subsection 18), and 146 of the Political Constitution, and Articles 25 subsection 1), and 28 subsection 2.b), of the General Law of Public Administration, Law No. 6227 of May 2, 1978.

I.—That through deed number one thousand five hundred seven, granted at nine o'clock on the twenty-ninth of January of nineteen ninety-three, before the State Notary, there appeared Mr. Alberto Terán Victory, in his capacity as Secretary, with powers of unlimited general agent without limit of sum of the company Peréz Góngora S. A., and Mr. Farid Beirute Brenes, in his capacity as Deputy Attorney, representing the State, to formalize the dation in payment (dación en pago) and the transfer free of mortgage encumbrances and debts of any kind, in favor of the State, of the property registered in the San José party, Real Folio registration number eighty-four thousand three hundred five - zero zero zero, which is uncultivated land, located in the fourth district Catedral, first canton of the province of San José, because said company owed the Ministry of Finance tax obligations and surcharges calculated as of March thirty-first, nineteen ninety-two.

II.—That according to the information recorded in the Public Registry, the property of the San José Party, real folio registration number eighty-four thousand three hundred five - zero zero zero, is property of the State.

III.—That the Ministry of Environment and Energy requested authorization from this Ministry, for the aforementioned real property to be assigned to it for its use.

IV.—That the Ministry of Environment and Energy is a strategic institution in sustainable development, therefore, in environmental matters, it must promote and support research, conservation, and the rational use of natural resources, hydrocarbons, mining, and energy developments, with a modern and agile organizational structure, that guarantees community participation, includes an equitable gender perspective, and actively participates in the fulfillment of internationally acquired commitments.

V.—That based on the foregoing, in the preceding considering clause, adequate physical space is needed so that, in a process of institutional modernization, greater efficiency and quality in the services provided to society may be achieved.

VI.—That the National System of Conservation Areas (SINAC), as the General Directorate of the Ministry of Environment and Energy, is a decentralized and participatory institutional management system that integrates competencies in forestry, wildlife, and protected areas matters, in order to plan and execute processes aimed at achieving sustainability in the management of the country's natural resources.

VII.—That the National Environmental Technical Secretariat (SETENA) is a body of maximum deconcentration of the Ministry of Environment and Energy, whose fundamental purpose is to harmonize environmental impact with productive processes, and therefore must respond to the needs for efficiency and effectiveness in the analysis of environmental impact assessments (evaluaciones de impacto ambiental).

VIII.—That the Ministry of Environment and Energy, in order to fulfill its functions efficiently, requires a building to house the offices of the National System of Conservation Areas (SINAC), the National Environmental Technical Secretariat (SETENA), and the Water Directorate.

IX.—That it is undeniably in the public interest to provide the Ministry of Environment and Energy with the necessary real property, so that it can timely fulfill the functions that have been attributed to it. Therefore:

Texto Completo acta: 75787 Nº 31879-H Nº 31879-H EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en los artículos 140, inciso 18), y 146 de la Constitución Política, y artículos 25 inciso 1), y 28 inciso 2.b), de la Ley General de la Administración Pública, Ley N° 6227 del 2 de mayo de 1978.

I.—Que mediante escritura número mil quinientos siete otorgada a las nueve horas del veintinueve de enero de mil novecientos noventa y tres, ante la notaría del Estado, comparecieron los señores Alberto Terán Victory, en su carácter de Secretario, con facultades de apoderado generalísimo sin límite de suma de la empresa Peréz Góngora S. A., y el señor Farid Beirute Brenes, en su carácter de Procurador Adjunto, en representación del Estado, para formalizar la dación en pago y el traspaso libre de gravámenes hipotecarios y deudas de toda índole, a favor del Estado, de la finca inscrita en el partido de San José, matrícula Folio Real número ochenta y cuatro mil trescientos cinco - cero cero cero, que es terreno inculto, sito en el distrito cuarto catedral, cantón primero de la provincia de San José, en razón de que dicha empresa le adeudaba al Ministerio de Hacienda obligaciones tributarias y recargos calculados al treinta y uno de marzo de mil novecientos noventa y dos. II.—Que de conformidad con la información que consta en el Registro Público la finca del Partido de San José, matrícula folio real número ochenta y cuatro mil trescientos cinco - cero cero cero, es propiedad del Estado. III.—Que el Ministerio del Ambiente y Energía solicitó la autorización de este Ministerio, para que se le asigne para su utilización el inmueble supracitado. IV.—Que el Ministerio del Ambiente y Energía es una institución estratégica en el desarrollo sostenible, por lo que en materia ambiental debe impulsar y apoyar la investigación, la conservación y el uso racional de los recursos naturales, los hidrocarburos, la minería y los desarrollos energéticos, con una estructura orgánica moderna y ágil, que garantice la participación comunitaria, que incluya una equitativa perspectiva de género y participe activamente en el cumplimiento de los compromisos adquiridos internacionalmente. V.—Que por lo expuesto, en el considerando precedente, se necesita de espacio físico adecuado para que en un proceso de modernización institucional, se logre una mayor eficiencia y calidad en los servicios que se prestan a la sociedad. VI.—Que el Sistema Nacional de Áreas de Conservación (SINAC) como Dirección General del Ministerio del Ambiente y Energía, es un sistema de gestión institucional descentralizado y participativo que integra las competencias en materia forestal, de vida silvestre y áreas protegidas, con el fin de planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales del país. VII.—Que la Secretaría Técnica Nacional Ambiental (SETENA) es un órgano de desconcentración máxima del Ministerio del Ambiente y Energía, cuyo propósito fundamental es armonizar el impacto ambiental con los procesos productivos, por lo que deberá responder a las necesidades de eficiencia y eficacia en el análisis de las evaluaciones de impacto ambiental. VIII.—Que el Ministerio del Ambiente y Energía, en aras de cumplir con sus funciones de una manera eficiente requiere un edificio para albergar las oficinas del Sistema Nacional de Áreas de Conservación (SINAC), la Secretaría Técnica Nacional Ambiental (SETENA) y la Dirección de Aguas. IX.—Que deviene de innegable interés público dotar al Ministerio del Ambiente y Energía de los inmuebles necesarios, a los efectos de que pueda dar oportuno cumplimiento a las funciones que le han sido atribuidas. Por tanto:
