I.-That the Ministry of Public Education has incorporated as part of the curricular proposal the cross-cutting theme, called "Environmental Culture for Sustainable Development." II.-That it is a fundamental function of the Ministry of Public Education, Ministry of Environment and Energy(*), Health and Tourism, to promote initiatives among the different sectors of Costa Rican society so that they actively participate in the development of actions aimed at promoting the country's sustainable development and the improvement of the quality of life.

III.-That it is necessary to instill in student populations the culture of environmental protection and the continuous improvement of the hygienic-sanitary conditions of educational facilities.

IV.-That through Executive Decree Nº 31610-S-MINAETUR, the Ecological Blue Flag Program was created, which has the objective of promoting community participation in the protection of water resources and the environment in general. As well as readjusting or adapting the objectives and evaluation criteria, to incentivize the organization of academic centers and recreation facilities, with the purpose of seeking their hygienic-sanitary excellence. Therefore:

Considering:

DECREE:

(NOTE: Through executive decree N° 33604 of January 31, 2007, the scope of the Ecological Blue Flag Program is expanded, including a new category called Protected Natural Spaces (private), with the purpose of recognizing the managers of these spaces for the efforts made in the promotion and adoption of practices, sustainable and friendly with the environment, through conservation of the primary forest, ecotourism and mixed (areas destined for forest conservation combined with agricultural and tourism activities) (*)(Name modified by article 11 of the Law “Transfer of the Telecommunications Sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology”, N° 9046 of June 25, 2012)

At the same time, it contemplates the following specific objectives:

a- Promote spaces of participation in public and private educational institutions through the alliance of students, educators and parents, with the purpose of executing projects for the adequate management of natural resources.

b- Understand the environmental issues of public and private educational institutions, through the application of environmental diagnostics.

c- Promote the excellence of hygienic-sanitary conditions in public and private educational institutions with the active participation of all actors in the educational process.

d- Promote educational processes that foster the development of knowledge in the student population of public and private educational institutions, through the development of training activities related to the theme environmental culture for sustainable development.

e- Foster environmental awareness in the actors of the educational process, through their involvement in environmental education programs, administration and surveillance of natural resources, among others, according to needs identified in the environmental diagnostics.

f- Foster the spirit of healthy competition among the student population of the different public and private educational institutions for obtaining the Ecological Blue Flag, as a way to reward and recognize the efforts of the actors of the educational process, for protecting and conserving the quality of the environment.

The Ministry of Education will provide the necessary officials to support the work of the technical work team, indicated in the aforementioned decree.

Likewise, representatives of other sectors of the community to which the educational center belongs may participate.

Then, in the month of October, it will present a report to the National Commission on the work carried out in the corresponding period.

a)One star (A): Minimum score of 90% of the points indicated in the previous article.
b)Two stars (AA): Score of 100% plus environmental protection campaigns, such as reforestation in parks, rivers or streams with native species, or all those campaigns that promote sustainable and sustainable development of the environment, where the educational center is located.
c)Three stars (AAA): That obtained with the flag with two stars, plus an environmental emergency response program and a campaign for classification and recycling of solid waste.

I.-Que el Ministerio de Educación Pública ha incorporado como parte de la propuesta curricular el tema transversal, denominado "Cultura Ambiental para el Desarrollo Sostenible".

II.-Que es función primordial del Ministerio de Educación Pública, Ministerio de Ambiente y Energía(*), Salud y Turismo, promover iniciativas entre los distintos sectores de la sociedad costarricense para que participen activamente en el desarrollo de acciones orientadas a impulsar el desarrollo sostenible del país y el mejoramiento de la calidad de vida.

III.-Que es necesario inculcar en las poblaciones estudiantiles la cultura de la protección ambiental y el mejoramiento continuo de las condiciones higiénico sanitarias de las instalaciones educativas.

IV.-Que mediante el Decreto Ejecutivo Nº 31610-S-MINAETUR, se creó el Programa Bandera Azul Ecológica, el cual tiene como objetivo fomentar la participación comunitaria en la protección de los recursos hídricos y del ambiente en general. Así como readecuar o adaptar los objetivos y criterios de evaluación, para incentivar la organización de centros académicos e instalaciones para recreación, con el propósito de buscar la excelencia higiénico sanitaria de los mismos. Por tanto:

Considerando:

DECRETAN:

(NOTA: Mediante decreto ejecutivo N° 33604 del 31 de enero de 2007, se amplían los alcances del Programa Bandera Azul Ecológica, incluyendo una nueva categoría denominada Espacios Naturales Protegidos (privados), con la finalidad de reconocer a los gestores de estos espacios los esfuerzos realizados en la promoción y adopción de prácticas, sostenibles y amigables con el ambiente, mediante conservación del bosque primario, ecoturismo y mixtos (zonas destinadas a conservación boscosa combinadas con actividades agropecuarias y turísticas) (*)(Modificada su denominación por el artículo 11 de la Ley "Traslado del sector Telecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al Ministerio de Ciencia y Tecnología", N° 9046 del 25 de junio de 2012)

A la vez contempla como objetivos específicos:

a- Promover espacios de participación en las instituciones educativas públicas y privadas mediante la alianza de los estudiantes, educadores y padres de familia, con el fin de ejecutar proyectos para el manejo adecuado de los recursos naturales.

b- Conocer la problemática ambiental de las instituciones educativas públicas y privadas, mediante la aplicación de diagnósticos ambientales.

c- Fomentar la excelencia de las condiciones higiénico sanitarias en las instituciones educativas públicas y privadas con la participación activa de todos los actores del proceso educativo.

d- Impulsar procesos educativos que promuevan el desarrollo de conocimientos en la población estudiantil de las instituciones educativas públicas y privadas, mediante el desarrollo de actividades de capacitación relacionadas con el tema cultura ambiental para el desarrollo sostenible.

e- Fomentar la conciencia ambiental en los actores del proceso educativo, mediante su involucramiento en programas de educación ambiental, administración y vigilancia de los recursos naturales, entre otros, según necesidades identificadas en los diagnósticos ambientales.

f- Fomentar el espíritu de la sana competencia entre la población estudiantil de las diferentes instituciones educativas públicas y privadas para la obtención de la Bandera Azul Ecológica, como una forma de premiar y reconocer los esfuerzos de los actores del proceso educativo, por proteger y conservar la calidad del ambiente.

El Ministerio de Educación facilitará los funcionarios necesarios para apoyar la labor del equipo técnico de trabajo, señalado en el citado decreto.

De igual forma podrán participar representantes de otros sectores de la comunidad a la que pertenece el centro educativo

Luego, en el mes de octubre presentará un informe ante la Comisión Nacional de la labor realizada en el período correspondiente.

a)Una estrella (A): Puntaje mínimo 90% de los puntos indicados en elartículo anterior.
b)Dos estrellas (AA): Puntaje del 100% más campañas de protección del ambiente, tales como de reforestación en parques, ríos o quebradas con especies nativas, o todas aquellas campañas que promuevan un desarrollo sostenible y sustentable del ambiente, donde se ubica el centro educativo.
c)Tres estrellas (AAA): Lo obtenido en la bandera con dos estrellas, más un programa de atención de emergencias ambientales y campaña de clasificación y reciclaje de desechos sólidos.

Expansion of the Blue Flag Ecological Program to educational centersAmpliación del Programa Bandera Azul Ecológica a centros educativos

Artículo 5 — The institutional committee of the educational center must prepare a work plan or program covering the evaluation criteria indicated in article 10 of this decree; said program or plan must be delivered to the National Commission at the time of registration.

Artículo 6 — The National Water Laboratory will carry out the physical-chemical and microbiological analyses of the water for human consumption available at the educational center.

Artículo 7 — The National Commission of the Ecological Blue Flag Program will carry out, through the technical work team, environmental audits with the purpose of evaluating the development of the work plan presented by each participating educational center.

Artículo 9 — The Ministry of Education, as well as the other institutions participating in the National Commission of the Ecological Blue Flag Program, must include in their work plans and likewise allocate the resources that would give it substance for its effective execution.

Artículo 10 — The educational centers registered in the program will have to present for their evaluation in the month of October, the evidence of compliance with the parameters described below, having to achieve a minimum of 90%, according to the following parameters:

Artículo 11 — The participating educational center will obtain the Ecological Blue Flag award with:

Artículo 12 — Effective from its publication.

Artículo 5 — El comité institucional del centro educativo tiene que preparar un plan o programa de trabajo que abarque los criterios de evaluación indicados en el artículo 10 del presente decreto; dicho programa o plan debe entregarse a la Comisión Nacional en el momento de la inscripción.

Artículo 6 — El Laboratorio Nacional de Aguas realizará los análisis físico-químicos y microbiológicos del agua de consumo humano disponible en el centro educativo.

Artículo 7 — La Comisión Nacional del Programa-Bandera Azul Ecológica, realizará a través del equipo técnico de trabajo, auditorías ambientales con el propósito de evaluar el desarrollo del plan de trabajo presentado por cada centro educativo participante.

Artículo 9 — El Ministerio de Educación, al igual que las otras instituciones participantes en la Comisión Nacional del Programa Bandera Azul Ecológica, deberá incluir en sus planes de trabajo y de igual forma asignar los recursos que le darían contenido para su efectiva ejecución.

Artículo 10 — Los centros educativos inscritos en el programa, tendrán que presentar para su evaluación en el mes de octubre, las pruebas del cumplimiento sobre los parámetros que a continuación se describen, teniendo que alcanzar un mínimo del 90%, conforme a los siguientes parámetros:
