Full Text of record: 70048 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE No. AJDIP/365.—Puntarenas, on the fifth day of September, two thousand three.

1- Based on IATTC Resolution C-03-03, resolution on the Conservation of Tuna in the Pacific Ocean, which states:

" The Inter-American Tropical Tuna Commission (IATTC): Bearing in mind the Resolution on the conservation of yellowfin and bigeye tunas in the Eastern Pacific Ocean approved by the IATTC at its 69th meeting in Manzanillo (Mexico), encourages states and fishing entities with large-scale tuna longline vessels (LSTLV) to undertake initiatives similar to that of Japan, that is, a 20% reduction of its fleet, in accordance with the FAO International Plan of Action.

Aware with serious concern that, despite the aforementioned Resolution, the catch of bigeye by LSTLVs and their fishing capacity continue to grow in the Eastern Pacific Ocean (EPO), defined for the purposes of this Resolution as the area between the coast of the Americas and the meridian 150°W from the parallel 40° N to the parallel 40° S.

Responsible for the scientific study of the tunas and related species of the EPO, and for formulating recommendations to the Parties with respect to said resources, and having maintained since 1950 an uninterrupted scientific program dedicated to the study of said resources.

Observes that the tuna resource in the EPO supports one of the most important surface-gear tuna fisheries in the world.

Recognizes, based on previous experience in these fisheries, that the potential production of the resource could be reduced if the fishing effort is excessive.

Notes that in the years between 1980 and 2002, with the exception of 1987, the Director recommended conservation measures to the Commissioners, who in turn approved said measures for recommendation to their respective governments.

Believing that it is important to follow a precautionary approach when dealing with conservation and management measures for the tuna resource in the EPO, and Considering that the studies of yellowfin and bigeye tunas presented at this meeting demonstrate that the current fishing effort (average of 2000-2001) would be above the level of average maximum sustainable yield for both species if recruitment depends strongly on the spawning level;

1. That this resolution is applicable for 2003, except paragraph 6, which is applicable for 2004 as well; 2. Pole-and-line and sport-fishing vessels are not subject to these measures.

3. That fishing by purse-seine tuna vessels shall be closed in the EPO from 0000 hours on December 1st until 2400 hours on December 31st; 4. Discourage landings and commercial transactions of tuna or derived products stemming from fishing activities prohibited by this resolution. The Director may provide pertinent information to the Parties to support them in this regard.

5. Each IATTC Party, cooperating non-party, fishing entity, or regional economic integration organization (collectively "CPC"), for purse-seine fisheries:

5.1. No later than October 1, 2003, shall inform all stakeholders of its national tuna industry of the closure, and shall send a copy of the notice to the Director.

5.2. Shall ensure that at the time of initiating the closure, and throughout the duration of the same, all purse-seine tuna vessels flying its flag in the EPO are in port, except that vessels carrying an observer from the APICD On-Board Observer Program may be at sea, provided they do not fish.

5.3. Shall take the appropriate measures and inform the Director thereof before October 1, 2003.

6. That each CPC shall take the necessary measures to ensure that its total annual longline catch of bigeye in the EPO during 2003 and 2004 does not exceed the catch in 2001. Each CPC with LSTLFV shall provide monthly catch reports to the Director.

7. This resolution shall not be considered to prejudge any future arrangement by the Commission for the conservation of bigeye tuna.

8. That the Commission shall develop, at its 71st Meeting, a long-term program for the conservation of bigeye and yellowfin tunas in the EPO."

1. 2That Costa Rica, as a country, currently normally lands more than 40,000 MT of tuna from tuna vessels flying a foreign flag that operate in the EPO, all included in the IATTC Regional Vessel Register.

IT IS AGREED:

1. Not to grant tuna fishing licenses with purse-seine nets during the month of December 2003.

2. Those vessels that hold a valid national fishing license in the month of December 2003 are prohibited from carrying out fishing activities in the patrimonial waters of Costa Rica.

3. Tuna processing plants established in Costa Rica, in order to land tuna during the closure period, are obligated to request prior authorization from the national authority of INCOPESCA before the IATTC. The national authority, via email, as promptly as possible, shall send the request to the IATTC Director in which the name of the tuna vessel, flag, tonnage of tuna estimated to be landed, and scheduled date for the landing shall be noted, in order to verify that the tuna in question was caught without violating the closure of December 2003. In the event that the Director of the IATTC Secretariat communicates that the shipment consulted does not comply with the closure or there are substantiated doubts about compliance, the national authority shall communicate to the tuna industry and to the Shipping Agency representing the vessel, the denial of landing the tuna in Costa Rican territory and also the refusal to carry out any transshipment operation in Costa Rican patrimonial waters. The national authority and the IATTC Secretariat are urged to process the consultations on the verification of compliance with the closure as promptly as possible, in order not to complicate, in terms of time, the operations of the Costa Rican tuna industries.

4. This agreement must be communicated officially to the tuna processing companies and to the shipping agencies representing foreign-flag tuna vessels.

5. FINAL AGREEMENT, LET IT BE PUBLISHED.

Note from SINALEVI: By means of Agreement No. 496 of November 21, 2003, this resolution is amended with respect to Article 2, however, as the article does not exist in the cited agreement, the full text of the article of the Agreement indicated above is included.

"Article 2- Fishing is authorized in the patrimonial sea of Costa Rica, except within the territorial sea and in that area included in the closed zone in IATTC resolution C-03-12, established and defined as follows: 'From the intersection of the Meridian 95°W, with the western coast of the American continent southward to the parallel 10° N, then westward to the meridian 120°W, then southward to the parallel 5° S, then eastward to the meridian 100° W, then northward to the parallel 5° N, then eastward to the meridian 85° W, and finally northward to its intersection with the western American coast' Puntarenas, September 17, 2003.

Texto Completo acta: 70048 INSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA Nº AJDIP/365.—Puntarenas, a los cinco días del mes de setiembre del dos mil tres.

1- Con base a la resolución C-03-03 de la CIAT, resolución sobre la Conservación del Atún en el Océano Pacífico, que dice:

" La Comisión Interamericana del Atún Tropical (CIAT): Teniendo presente la Resolución sobre la conservación de los atunes aleta amarilla y patudo en el Océano Pacifico Oriental aprobada por la CIAT en su 69ª reunión en Manzanillo (México), alienta a los estados y entidades pesqueras con buques palangreros a gran escala (LSTLV) a emprender iniciativas similares a la de Japón, o sea, una reducción de 20% de su flota, de conformidad con el Plan Internacional de Acción de la FAO.

Consciente con seria preocupación de que, a pesar de la citada Resolución, la captura de patudo por LSTLV y su capacidad de pesca siguen creciendo en el Océano Pacífico Oriental (OPO), definido para los propósitos de esta Resolución como la zona comprendida entre el litoral de las Américas y el meridiano 150°0 desde el paralelo 40° N hasta el paralelo 40° S.

Responsables del estudio científico de los atunes y especies afines del OPO, y de formular recomendaciones a las Partes con respecto a dichos recursos, y habiendo mantenido desde 1950 un programa científico ininterrumpido dedicado al estudio de dichos recursos.

Observa que el recurso atunero en el OPO sostiene a una de las pesquerías de atunes con artes de superficie más importantes del mundo.

Reconoce, con base en la experiencia previa en estas pesquerías, que existe la posibilidad de reducir la producción potencial del recurso si el esfuerzo de pesca es excesivo.

Nota que en los años entre 1980 y 2002, con la excepción de 1987, el Director recomendó medidas de conservación a los Comisionados, quienes a su vez aprobaron dichas medidas para recomendación a sus gobiernos respectivos.

Creyendo que es importante seguir un enfoque precautorio al tratar medidas de conservación y ordenación para el recurso atunero en el OPO, y Considerando que los estudios de los atunes aleta amarilla y patudo presentados en esta reunión demuestran que el esfuerzo de pesca actual (promedio de 2000-2001) estaría por encima del nivel de rendimiento máximo sostenible promedio para ambas especies si el reclutamiento depende fuertemente del nivel de desove;

1. Que esta resolución es aplicable para 2003, excepto el párrafo 6, que es aplicable para 2004 también; 2. Los buques cañeros y de pesca deportiva no quedan sujetos a estas medidas.

3. Que se vedará la pesca por buques atuneros cerqueros en el OPO a partir de las 0000 horas del 1° de diciembre hasta las 24:00 horas del 31 de diciembre; 4. Desalentar descargas y transacciones comerciales de atún o productos derivados provenientes de actividades de pesca prohibidas por esta resolución. El Director podrá proporcionar información pertinente a las Partes para apoyarles en este respecto.

5. Cada Parte de la CIAT, parte no contratante cooperante, entidad pesquera u organización regional de integración económica (colectivamente "CPC), para las pesquerías de cerco:

5.1. A más tardar el 1º de octubre de 2003, informará a todos los interesados de su industria atunera nacional de la veda, y enviará copia del aviso al Director.

5.2. Asegurará que en el momento de iniciar la veda, y durante toda la duración de la misma, todos los buques atuneros cerqueros que enarbolan su pabellón en el OPO estén en puerto, excepto que buques que lleven un observador del programa de Observadores a Bordo del APICD podrán estar en el mar, siempre que no pesquen.

5.3. Tomará las medidas del caso e informará al Director de las mismas antes del 1º de octubre de 2003.

6. Que cada CPC tomará las medidas necesarias para asegurar que su captura palangrera anual total de patudo en el OPO durante 2003 y 2004 no supere la captura en 2001. Cada CPC con LSTLFV proveerá informes mensuales de captura al Director.

7. No se considerará que esta resolución prejuzgue cualquier arreglo futuro por la Comisión para la conservación del atún patudo.

8. Que la Comisión desarrollará, en su 71ª Reunión, un programa a largo plazo para la conservación de los atunes patudo y aleta amarilla en el OPO."

1. 2Que Costa Rica como país actualmente descarga normalmente más de 40.000 TM de atún proveniente de barcos atuneros con bandera extranjera que faenan en el OPO, todos incluidos en el Registro General de Buques de la CIAT.

SE ACUERDA:

1. No otorgar licencias de pesca de atún con red de cerco durante el mes de diciembre del 2003.

2. Aquellas embarcaciones que cuenten con licencia de pesca nacional vigente en el mes de diciembre del 2003, les queda prohibida la realización de actividades de pesca en las aguas patrimoniales de Costa Rica.

3. Las plantas procesadoras de atún, establecidas en Costa Rica, para realizar un desembarque de atún durante el período de veda, quedan obligadas a solicitar una autorización previa a la autoridad nacional del INCOPESCA ante la CIAT. La autoridad nacional vía correo electrónico, a la mayor brevedad posible, enviará la solicitud al Director de la CIAT en la cual se anotará el nombre del barco atunero, bandera, tonelaje de atún que se estima descargar y fecha programada para la descarga, a fin de verificar que el atún en cuestión fue capturado sin violar la veda del mes de diciembre del 2003. En caso de que el Director de la Secretaría de la CIAT comunique que el embarque consultado no cumple con la veda o existen dudas fundamentadas sobre el cumplimiento, la autoridad nacional comunicará a la industria atunera y a la Agencia de Vapores representante del barco, la negativa de desembarcar el atún en territorio costarricense y la denegatoria también de que se realice ninguna operación de trasbordo en aguas patrimoniales costarricenses. Se insta a la autoridad nacional y a la Secretaría de la CIAT a evacuar a la mayor brevedad posible, las consultas sobre la verificación del cumplimiento con la veda, a fin de no dificultar en tiempo, las operaciones de las industrias atuneras costarricenses.

4. El presente acuerdo debe de comunicarse oficialmente a las empresas procesadoras de atún y a las Agencias de vapores representantes de barcos atuneros de bandera extranjera.

5. ACUERDO FIRME, PUBLÍQUESE.

Nota de SINALEVI: Mediante Acuerdo N° 496 del 21 de noviembre de 2003, se modifica la presente resolución en lo concerniente al Artículo 2°, sin embargo, por no existir el mismo en el acuerdo citado se incluye en forma total el texto del artículo del Acuerdo indicado supra.

"Artículo 2º-Se autoriza la pesca en el mar patrimonial de Costa Rica, excepto dentro del mar territorial y en aquella área incluida en la zona vedada en la resolución de la CIAT C-03-12, establecida y definida de la siguiente manera: "Desde la intersección del Meridiano de 95°O, con el litoral occidental del continente americano hacia el sur hasta el paralelo 10° N, luego hacia el oeste hasta el meridiano de 120°O , luego hacia el sur hasta el paralelo de 5° S, luego hacia el este hasta el meridiano de 100° O, luego hacia el norte hasta el paralelo de 5° N, luego hacia el este hasta el meridiano de 85° O y finalmente hacia el norte hasta su intersección con el litoral occidental americano Puntarenas, 17 de setiembre del 2003.
