Full Text record: 69126 Nº 31286-G Nº 31286-G THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF GOVERNANCE AND POLICE Based on Article 146 of the Political Constitution, Articles 99 and following of Ley de Aguas Nº 276 of August 27, 1942 and its amendments, and Article 383 and following of the Civil Code, and,

1. 1That the Ministry of Environment and Energy, through resolution Nº R-347-Aguas-MINAE, at thirteen hours and thirty minutes on September twenty-fifth, two thousand one, granted a water use concession (aprovechamiento de aguas) to the Municipality of El Guarco, as of that date, and for a term of fifteen years for the use of water for domestic use throughout the year, twenty-four hours a day, in a quantity of 20 liters per second, to be taken from a spring (naciente), with the intake (captación) on property belonging to Messrs. Arnulfo and Gilberto, both with the surnames Navarro Cordero, conveying it by pipeline to the site of use.
2. 2That the Municipality of El Guarco filed a petition for imposition of an aqueduct easement (servidumbre de acueducto) with the Ministry of Governance and Police in accordance with Ley de Aguas Nº 276 of August 27, 1942 and its amendments.
3. 3That through resolution 759-2002 ALG at 9:00 hours on May 5, 2003, issued by the Legal Advisory Directorate of the Ministry of Governance and Police, it proceeded to make known to the interested parties the report rendered by the expert appraiser of the Ministry of Finance, regarding the amount of compensation corresponding to the owners of the servient tenement (fundo sirviente), Messrs. Arnulfo and Gilberto, both with the surnames Navarro Cordero, which was paid through judicial deposits in the checking account of the Civil Court of Greater Amount of Cartago Nº 001-23614-4 of Banco de Costa Rica, slips Nos. 0436579 B and 0436580 B for the exact amount of four hundred thirty-three thousand seven hundred three colones and zero céntimos, for each deposit, the total amount being the sum of eight hundred sixty-seven thousand four hundred six colones exact in favor of the co-owners.
4. 4That in accordance with the studies conducted by this Ministry and the water use concession (concesión de aprovechamiento de aguas) granted through resolution Nº R-347-Aguas-MINAE at 13:30 hours on September 25, 2001, the aforementioned laws, and Article 383 and following of the Civil Code, it is appropriate to decree the constitution of the corresponding aqueduct easement (servidumbre de acueducto).

Texto Completo acta: 69126 Nº 31286-G Nº 31286-G EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE GOBERNACIÓN Y POLICÍA Con fundamento en el artículo 146 de la Constitución Política, los artículos 99 y siguientes de la Ley de Aguas Nº 276 del 27 de agosto de 1942 y sus reformas y el artículo 383 y siguientes del Código Civil y,

1. 1Que el Ministerio del Ambiente y Energía, mediante resolución Nº R-347-Aguas-MINAE, de las trece horas y treinta minutos del veinticinco de setiembre del dos mil uno, otorgó concesión de aprovechamiento de aguas a la Municipalidad de El Guarco, a partir de esa fecha, y por el plazo de quince años para el aprovechamiento de aguas de uso doméstico durante todo el año, las veinticuatro horas del día, en una cantidad de 20 litros por segundo, que se tomarán de una naciente, efectuando la captación en propiedad de los señores Arnulfo y Gilberto ambos de apellidos Navarro Cordero, conduciéndola por medio de tubería hasta el sitio del aprovechamiento.
2. 2Que la Municipalidad de El Guarco presentó solicitud de imposición de servidumbre de acueducto ante el Ministerio de Gobernación y Policía de conformidad con la Ley de Aguas Nº 276 del 27 de agosto de 1942 y sus reformas.
3. 3Que mediante resolución 759-2002 ALG de las 9:00 horas del 5 de mayo del 2003, dictada por la Dirección de Asesoría Jurídica del Ministerio de Gobernación y Policía procedió a poner en conocimiento de las partes interesadas, el informe rendido por el perito valuador del Ministerio de Hacienda, sobre el monto de la indemnización correspondiente a los propietarios del fundo sirviente señores Arnulfo y Gilberto ambos de apellidos Navarro Cordero, el cual fue cancelado mediante depósitos judiciales en la cuenta corriente del Juzgado Civil de Mayor Cuantía de Cartago Nº 001-23614-4 del Banco de Costa Rica, boletas Nos. 0436579 B y 0436580 B por un monto exacto de cuatrocientos treinta y tres mil setecientos tres colones sin céntimos, cada uno de los depósitos, siendo el monto total de la suma de ochocientos sesenta y siete mil cuatrocientos seis colones exactos a favor de los copropietarios.
4. 4Que de conformidad con los estudios realizados por este Ministerio y la concesión de aprovechamiento de aguas otorgada mediante resolución Nº R-347-Aguas-MINAE de las 13:30 horas del 25 de setiembre del 2001, leyes precitadas y artículo 383 y siguientes del Código Civil, procede decretar la constitución de la correspondiente servidumbre de acueducto.
