Law for the Protection, Conservation, and Recovery of Sea Turtle Populations
All public institutions that possess scientific information related to sea turtles shall be obliged to provide it, at no cost, to the Ministry of Environment and Energy (Ministerio del Ambiente y Energía, MINAE), when so requested, in order to rationally manage these species.
Private organizations that possess information related to this subject may provide it to MINAE when requested.

National or foreign trawlers that do not use the Turtle Excluder Device (DET) in the areas designated by INCOPESCA shall be sanctioned with a fine of three to five base salaries, as defined in Article 2 of Law No. 7337, of May 5, 1993.
Likewise, vessels that do not use the Turtle Excluder Device (DET) shall have their fishing license revoked.

Every project must have the reasoned authorization of MINAE, duly supported by technical impact criteria that guarantee the protection of these marine species.

To this end, this Ministry shall organize training programs for local residents on the subject of sea turtles and sustainable tourism. For residents who pass the training programs, the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación) of MINAE shall provide them with an official ID card accrediting them as guides for tourist groups on beaches of ecotourism interest. Likewise, persons conducting group activities for turtle observation outside the areas of MINAE's competence must obtain the respective tourism guide license issued by the ICT, in accordance with Law No. 7472, Promotion of Competition and Effective Consumer Defense, of December 20, 1994.
Lodging companies, as well as tour operator agencies for tourist groups located in the zones where the beaches declared to be of ecotourism interest are found, or that carry out activities in said zones, shall have priority for the ICT to affiliate them with the Certification Program for Tourism Sustainability (Programa de Certificación para la Sostenibilidad Turística).

Ley de Protección, Conservación y Recuperación de las Poblaciones de Tortugas Marinas
Todas las instituciones públicas que posean información científica relacionada con las tortugas marinas, estarán obligadas a facilitarla, sin costo alguno, al Ministerio del Ambiente y Energía (MINAE), cuando así se les solicite, con el fin de manejar racionalmente estas especies.
Las organizaciones privadas que posean información relacionada con esta materia, podrán facilitársela al MINAE, cuando les sea requerida.
Las embarcaciones de arrastre, nacionales o extranjeras, que no utilicen el Dispositivo Excluidor de Tortugas (DET) en las áreas señaladas por el INCOPESCA, serán sancionadas con multa de tres a cinco salarios base, definidos en el artículo 2 de la Ley N° 7337, de 5 de mayo de 1993.
Asimismo, a las embarcaciones que no utilicen el Dispositivo Excluidor de Tortugas (DET) se les revocará la licencia de pesca.
Todo proyecto deberá contar con la autorización razonada del MINAE, debidamente sustentada en criterios técnicos de impacto que garanticen la protección de estas especies marinas.
A tal efecto, este Ministerio organizará programas de capacitación para los pobladores locales en materia de tortugas marinas y turismo sostenible. A los pobladores que aprueben los programas de capacitación, el Sistema Nacional de Áreas de Conservación del MINAE los dotará de un carné oficial que los acredite como guías de grupos de turistas en las playas de interés ecoturístico. Igualmente, las personas que realicen actividades con grupos para la observación de tortugas fuera de las áreas de competencia del MINAE deberán obtener la respectiva licencia de guía de turismo otorgada por el ICT, de conformidad con la Ley N° 7472, Promoción de la competencia y defensa efectiva del consumidor, de 20 de diciembre de 1994.
Las empresas de hospedaje, al igual que las agencias operadoras de grupos de turistas ubicadas en las zonas donde se encuentren las playas declaradas de interés ecoturístico, o que realicen actividades en dichas zonas, tendrán prioridad para que el ICT las afilie al Programa de Certificación para la Sostenibilidad Turística.
La pena será de tres meses a dos años de prisión para quien retenga con fines comerciales tortugas marinas, o comercie productos o subproductos de estas especies.
No será punible la recolección de huevos de tortuga lora en el Refugio de Vida Silvestre de Ostional, siempre que se realice con apego a las disposiciones reglamentarias que emita el MINAE.
