a- ARESEP: Regulatory Authority for Public Services.
b- Provisioning (Avituallamiento): Action and effect of supplying oneself with provisions and other necessary inputs for carrying out fishing tasks.
c- Competent authority: National Coast Guard Service, Delegates of the Public Force, Port Captaincies of the General Directorate of Maritime Transport of the Ministry of Public Works and Transport, Directorates and Regional Offices of INCOPESCA.
d- Beneficiary: natural or legal person with a current fishing license, who requests and receives fuel at a preferential price as established by this regulation and whose entire catch from their fishing trips is unloaded in national territory.
e- Catch: Quantity of hydrobiological resources that fishers land on each fishing trip made by a specific vessel.
f- Fuel: Refers to diesel oil and gasoline used for the operation of the authorized engine for carrying out fishing work on commercial non-sport fishing vessels.
g- Reconciliation: Leveling balances of liters of fuel recommended by INCOPESCA through purchase orders with those liters sold by RECOPE for the same period.
h- Contracts: Documents in which the different clauses are recorded expressing the conditions to which the beneficiaries, the organizations, and INCOPESCA are bound with regard to the fuel granted at a preferential price.
j- Days of absence: The days elapsed from the departure of the vessel until its arrival at its base port of operations, as recorded in the respective departure clearance (zarpe). A day of absence shall be considered one in which a vessel remains 12 or more hours outside of any port in fishing tasks from and to the fishing grounds, this for medium and longline vessels, as well as for those belonging to the semi-industrial fleet. For the small-scale artisanal fleet, composed of boats and pangas, the day of absence shall be defined by a minimum of four hours outside the port of operation in fishing tasks.
k- National Fishing Fleet: vessels of national flag and registry owned by Costa Ricans or by foreigners with a current residency card under any title, duly registered and accredited in INCOPESCA, that operate in strict adherence to the legal framework in fishing matters and that are dedicated to: 1- The capture of hydrobiological resources from the sea for commercial purposes. 2- Research and teaching, with prior authorization from the board of directors and as long as the activities are non-profit and of benefit to the country, pursuant to the provisions of Article 4 of this regulation.
l- Semi-industrial fleet: Set of vessels dedicated to the capture of shrimp and sardine.
m- Artisanal fleet: Defined as that set of vessels dedicated to commercial fishing and separated into three subgroups according to the following criteria:
Small-scale artisanal: vessels authorized by the Ministry of Transport to operate at a distance from the coast not exceeding 3 nautical miles.
Medium artisanal: fishing vessels authorized by the Ministry of Transport to operate up to a distance from the coast less than or equal to 40 nautical miles.
Longline Fleet: fishing vessels authorized by the Ministry of Transport to operate at distances greater than 40 nautical miles.
Tuna Fleet: Tuna vessels authorized for the capture of tuna using purse seine fishing gear or pole and line in jurisdictional waters with a prohibition on conducting such fishing on fish aggregating devices (FADs/plantado).
n- INCOPESCA: Costa Rican Institute of Fisheries and Aquaculture.
ñ- The Fuel Control and Administration Section (SCAC): The INCOPESCA unit responsible for the administration, oversight, and control of fuel.
o- Organizations: Chambers, Cooperatives, Associations, Societies, and any other type of Organization of commercial Fishermen with legal personality, legally created.
p- Base port of operation: Port chosen by the fisher to regularly provision their vessel.
q- RECOPE: Costa Rican Petroleum Refinery.
r- Conversion factor: Corresponds to the value required to convert horsepower "hp" to kilowatts of force "kw", for both outboard and inboard engines. Said conversion factor shall be equal to 0.7456.
