1.-That Law No. 7384, of March 16, 1994, published in the Official Gazette La Gaceta No. 62 of March 29, 1994, the Law Creating the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA), in its Article 45 establishes that:
a. The fishing sector shall acquire from RECOPE the fuel (gasoline and diesel), for non-sport fishing activity at a price competitive with the international price based on the average import cost of the previous month and considering the CIF cost (cost, insurance, and freight) Refinery, as well as the costs of pipeline distribution and distribution at depots, such that the price is FOB (free on board) depot.
b. That the price shall be set by the Regulatory Authority for Public Services (Autoridad Reguladora de los Servicios Públicos, ARESEP), which RECOPE must previously request it from, according to the provisions of Law No. 7593 of August 9, 1996, or INCOPESCA.
c. That the Institute shall be responsible for the administration and control of the efficient use of fuel destined for non-sport fishing activity.
2.-That for the purpose of complying with the cited regulations, INCOPESCA, through agreement AJDIP/009-2002, dated January 11, 2002, agreed to issue the Regulation for the Regulation and Control of the Efficient Use of Fuel Destined for the National Non-Sport Fishing Fleet in Jurisdictional Waters or Outside of Them.
3.-That the Fuel Commission requested a three-month period from the Board of Directors in order to present a technical and scientific study on the calculation tables established in that Regulation, so that beneficiaries can be granted the fuel they actually require to carry out fishing activity, a request that was accepted through agreement AJDIP/359-2001, dated December 7, 2001.
4.-That in order not to cause any harm to the Fishing Sector, the appropriate course of action is to suspend the application of Article 12 of the aforementioned Regulation, referring to the calculation tables, until such time as the final Report from the aforementioned Commission is available.
5.-That according to statements by Regional Directors and officials involved in the procedure for obtaining fuel at a preferential price, the preparation and execution of the contracts mentioned in Articles 16 and 17 of the cited Regulation indispensably requires the granting of a reasonable period so that the parties involved in the procedure may adjust and carry out the respective actions in order to comply with what is requested, therefore it is appropriate to suspend for a determined period the application of Articles 16 and 17 of the aforementioned Regulation, referring to the signing of contracts for obtaining fuel at a preferential price. Therefore, THE BOARD OF DIRECTORS OF THE COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE, AGREES:

1Que la Ley Nº 7384, del 16 de marzo de 1994, publicada en el Diario Oficial La Gaceta Nº 62 del 29 de marzo de 1994, Ley de Creación del Instituto Costarricense de Pesca y Acuacultura (INCOPESCA), en su artículo 45 establece que:
a. El sector pesquero adquirirá de RECOPE el combustible (gasolina y diesel), para la actividad de pesa no deportiva a un precio competitivo con el precio internacional basado en el costo promedio de importación del mes anterior y considerando el costo CIF (costo, seguro y flete) Refinería, así como los costos de distribución por oleoducto y distribución en planteles, de tal forma que el precio sea FOB (libre a bordo), plantel.
b. Que el precio será fijado por la Autoridad Reguladora de los Servicios Públicos (ARESEP), a la cual deberá solicitarlo previamente RECOPE, segun lo dispuesto en la Ley Nº 7593 del 9 de agosto de 1996 o el INCOPESCA.
c. Que el Instituto se encargará de la administración y el control del uso eficiente del combustible destinado a la actividad pesquera no deportiva.
2Que a los efectos de dar cumplimiento a la normativa citada, el INCOPESCA por medio del acuerdo AJDIP/009-2002, de fecha 11 de enero del 2002, acordó emitir el Reglamento para la Regulación y Control del Uso Eficiente del Combustible Destinado a la Flota Pesquera Nacional No Deportiva en Aguas Jurisdiccionales o fuera de ellas.
3Que la Comisión de Combustible solicito a la Junta Directiva un plazo de tres meses a efectos de presentar un estudio técnico y científico sobre las tablas de calculo establecidas en ese Reglamento, de forma tal que pueda otorgarse a los beneficiarios el combustible que realmente requieren para ejercer la actividad pesquera, petición que fue acogida mediante acuerdo AJDIP/359-2001, de fecha 7 de diciembre 2001.
4Que a los efectos de no causar perjuicio alguno al Sector Pesquero, lo procedente es suspender la aplicación del artículo 12 del mencionado Reglamento, referente a las tablas de calculo, hasta tanto no se cuente con el Informe final por parte de la Comisión precitada.
5Que según manifestaciones por parte de Directores Regionales y funcionarios involucrados en el tramite de obtención de combustible a precio preferencial, la elaboración y ejecución de los contratos mencionados en los artículos 16 y 17 del citado Reglamento, requiere indispensablemente el otorgamiento de un plazo prudencial para que las partes inmersas dentro del procedimiento, ajusten y realicen las acciones respectivas a efecto de cumplir con lo solicitado, por lo que resulta procedente suspender por un plazo determinado la aplicación de los artículos 16 y 17 del mencionado Reglamento, referente a la suscripción de los contratos para la obtención del combustible a precio preferencial. Por tanto,
LA JUNTA DIRECTIVA DEL INSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA, ACUERDA:
Considerando:
