in the entirety of the text - Full Text of Norm 29571 Repeals the decree establishing a Total Ban on the Extraction and Commercialization of Bivalve Mollusks throughout the Country Full Text record: 3EC51 No. 29571-MAG-S No. 29571-MAG-S THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF AGRICULTURE AND LIVESTOCK, AND OF HEALTH In exercise of the powers established in Article 140, subsections 3) and 18) of the Political Constitution, Law No. 6227 of May 2, 1978, General Law of Public Administration, Law No. 7064 of April 29, 1987, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, Law No. 7384 of March 16, 1994, Law Creating the Costa Rican Institute of Fisheries and Aquaculture, and Law No. 5395 of October 30, 1973, General Health Law.
1st—That through Executive Decree No. 29184-S-MAG of December 12, 2000, published in La Gaceta No. 247 of December 26, 2000, a total ban was established on the extraction and commercialization of bivalve mollusks, due to the presence of the red tide phenomenon (fenómeno de la marea roja) in the coastal waters of the Costa Rican Pacific and the risk to human life.
2nd—That in accordance with the laboratory analyses of waters and meat samples and the monitoring carried out by the competent technical bodies, regarding the tracking of the phenomenon's behavior, it has been determined that to date, the causes that gave rise to the establishment of said ban have significantly decreased in the case of the species affected by the regulation, with the exception of the bivalve mollusk Spondylus Calcifer (Ostión Vaca).
3rd—That the commercialization of bivalve mollusks, due to their consumption and importance in the market, has a significant impact on the fishing subsector dedicated to their extraction, for which reason it is neither convenient nor opportune to maintain said restriction, if technically it is not justified today, while maintaining the regulation regarding the mollusk in which the red tide phenomenon (fenómeno de la marea roja) maintains its incidence and risk to human health and life.
