in the entirety of the text - Complete Text of Norm 29391 Additions to the Regulation for the Control and Review of Gases and Polluting Emissions Vehicles Complete Text of Act: 3CC91 Nº 29391-MOPT-MINAE-S Nº 29391-MOPT-MINAE-S THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF PUBLIC WORKS AND TRANSPORT, ENVIRONMENT AND ENERGY, AND HEALTH Exercising the powers conferred by Articles 140, subsections 3 and 18 of the Political Constitution; Article 27 of the General Law of Public Administration; Articles 34, 35, 36, subsequent and related articles of the Law of Transit on Public Land Routes, Nº 7331 of April 13, 1993 and its amendments.

1st—That given the global concern over environmental deterioration, in recent years the country has undertaken the task of enacting legal instruments that guarantee its real and effective protection.

2nd—That by reason of the foregoing, since the enactment of the current Law of Transit on Public Land Routes, the Ministries of Public Works and Transport, of Health, and of Environment and Energy, have undertaken with greater impetus the regulation of all aspects related to environmental contamination produced by motor vehicles.

3rd—That within this situation, the Executive Branch issued Executive Decree Nº 28280-MOPT-MINAE-S, "Regulation for the Control and Technical Review of Polluting Gas Emissions Produced by Motor Vehicles." 4th—That Article 2 of the cited regulatory body provides, as is of interest, that the compliance certificates for new and used vehicles referred to in Article 36 of the Law of Transit on Public Land Routes and its amendments must be certified by the vehicle manufacturer or by a competent authority, in matters of vehicular emissions, of the country from which the importation is made.

5th—That pursuant to the provisions of Article 36, subsequent and related articles of the Vienna Convention on Diplomatic Relations, Embassies may import vehicles for the official use of the mission and of the officials stationed there.

6th—That in some countries there is no legal provision establishing a regulation for the control of emissions regarding vehicles, which makes it materially and legally impossible for some diplomats to provide the respective certificate, in accordance with the provisions of Article 2 of the aforementioned Regulation.

7th—That for reasons of public interest and in order to harmonize the current regulations with the Principle of Reciprocity, a fundamental pillar of international relations, it is essential to add a final paragraph to Article 2 of the "Regulation for the Control and Technical Review of the Emissions of Polluting Gases Produced by Motor Vehicles," to address the particular situation of vehicles imported for the use of diplomatic missions. Therefore, They decree:

1. 1Que ante la preocupación mundial por el deterioro del medio ambiente, durante los últimos años el país se ha abocado a la tarea de poner en vigencia instrumentos jurídicos que garanticen una protección real y efectiva del mismo.
2. 2Que en razón de lo anterior, desde la promulgación de la actual Ley de Tránsito por Vías Públicas Terrestres, los Ministerios de Obras Públicas y Transportes, de Salud y del Ambiente y Energía, se han abocado con mayor impulso a la regulación de todos los aspectos relacionados con la contaminación ambiental producida por los vehículos automotores.
3. 3Que dentro de esa coyuntura el Poder Ejecutivo emitió el Decreto Ejecutivo Nº 28280-MOPT-MINAE-S, "Reglamento para el Control y Revisión Técnica de las Emisiones de Gases Contaminantes Producidas por Vehículos Automotores".
4. 4Que el artículo 2 del citado cuerpo normativo dispone, en lo que es de interés, que los certificados de cumplimiento para vehículos nuevos y usados a que se refiere el artículo 36 de la Ley de Tránsito por Vías Públicas y Terrestres y sus reformas, deberán ser certificados por el fabricante del vehículo o por una autoridad competente, en materia de emisiones vehiculares, del país del cual se realice la importación.
5. 5Que a tenor de lo dispuesto en el artículo 36, siguientes y concordantes de la Convención de Viena sobre Relaciones Diplomáticas, las Embajadas pueden importar vehículos para el uso oficial de la misión y de los funcionarios allí destacados.
6. 6Que en algunos países no existe disposición legal que establezca una regulación de control de emisiones en materia de vehículos, por lo que resulta material y legalmente imposible para algunos diplomáticos, aportar el certificado respectivo, de conformidad con lo dispuesto en el artículo 2 del Reglamento antes citado.
7. 7Que por razones de interés público y a efecto de armonizar la normativa vigente con el Principio de Reciprocidad, pilar fundamental de las relaciones internacionales, resulta primordial adicionar un último párrafo al artículo 2 del "Reglamento para el Control y Revisión Técnica de las Emisiones de Gases Contaminantes Producidas por Vehículos Automotores", para contemplar la situación particular de los vehículos que se importen para el uso de las representaciones diplomáticas. Por tanto,

Decretan:
