in the entirety of the text - Complete Text of Regulation 29328 Creates an Interinstitutional Commission for the Prevention and Control of Red Tide in Costa Rica Complete Text record: 10D470 EXECUTIVE BRANCH Nº 29328-MAG-S (This executive decree was repealed by Article 11 of Executive Decree N° 39669 of February 17, 2016, "Commission for the Epidemiological Surveillance of Red Tide") THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF AGRICULTURE AND LIVESTOCK AND OF HEALTH In exercise of the powers established in Article 140, subsections 3) and 18) of the Political Constitution, Law Nº 6227 of May 2, 1978, General Law of Public Administration, Law Nº 7064 of April 29, 1987, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, Law Nº 7384 of March 16, 1994, Law Creating the Costa Rican Institute of Fisheries and Aquaculture, and Law Nº 5395 of October 30, 1973, General Health Law.
They decree:
Considering:
1º To propose a permanent national system for the prevention and control of red tide, allowing for rapid and effective communication of this phenomenon.
2º To coordinate and promote education, dissemination, and awareness campaigns regarding toxic red tides aimed at the entire population.
3º To incentivize, encourage, and coordinate the research carried out in this field.
4º To recommend to the competent authorities the joint actions necessary to address the problem and manage the phenomenon.
5º To propose the necessary legislation or regulations that contribute to maintaining a monitoring and early warning program for red tide.
6º Any others related to its fulfillment and purposes.
1. The Executive President of INCOPESCA or his representative, who shall preside over it.
2. The Technical Director General of INCOPESCA or his representative.
3. A representative of the Health Surveillance Directorate of the Ministry of Health.
4. A representative of the Registries and Controls Directorate of the Ministry of Health.
5. A representative of the Medical Management of the Costa Rican Social Security Fund.
6. A representative of the Marine Phytoplankton Laboratory of the National University.
7. A representative of the Animal Health Directorate of the MAG-National Laboratory of Veterinary Services.
8. The Director of the Center for Research in Limnology and Marine Sciences (CIMAR) of the University of Costa Rica.

When there are indications of non-compliance with the regulations issued in relation to that activity, the authorities vested by this act shall communicate and coordinate with the corresponding authorities of the Ministry of Health, for the purposes of executing the subsequent corresponding actions, such as the adoption of a special sanitary measure, provided for in the General Health Law.

Considerando:
Decretan:
1º Proponer un sistema nacional permanente de prevención y control de la marea roja, que permita la comunicación rápida y efectiva de este fenómeno.
2º Coordinar y promover campañas de educación, divulgación y conocimiento de las mareas rojas tóxicas dirigidas a toda la población.
3º Incentivar, fomentar y coordinar las investigaciones que se realicen en este campo.
4º Recomendar ante las autoridades competentes las acciones conjuntas necesarias para abordar el problema y la atención del fenómeno.
5º Proponer la legislación o normativa necesaria que contribuya a mantener un programa de monitoreo y dé alerta temprana de la marea roja.
6º Cualesquiera otras relacionadas con el cumplimiento y fines de la misma.
1. El Presidente Ejecutivo del INCOPESCA o su representante, quien la presidirá.
2. El Director General Técnico del INCOPESCA o su representante.
3. Un representante de la Dirección de Vigilancia de la Salud del Ministerio de Salud.
4. Un representante de la Dirección de Registros y Controles del Ministerio de Salud.
5. Un representante de la Gerencia Médica de la Caja Costarricense del Seguro Social.
6. Un representante del Laboratorio de Fitoplancton Marino de la Universidad Nacional.
7. Un representante de la Dirección de Salud Animal del MAG-Laboratorio Nacional de Servicios Veterinarios.
8. El Director del Centro de Investigaciones en Limnología y Ciencias del Mar (CIMAR) de la Universidad de Costa Rica.

Cuando existan indicios de incumplimiento de la normativa emitida en relación con esa actividad, las autoridades por este acto investidas lo comunicarán y coordinarán con las autoridades correspondientes del Ministerio de Salud, a los efectos de la ejecución de las acciones ulteriores que correspondan, tales como la adopción de alguna medida sanitaria especial, prevista en la Ley General de Salud.
