Decreto 29279 — Creation of the Advisory Commission on Land Degradation (CADETI)

THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF ENVIRONMENT AND ENERGY(*) AND OF AGRICULTURE AND LIVESTOCK (*)(Its name amended by Article 11 of Law "Transfer of the Telecommunications Sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology", No. 9046 of June 25, 2012) In exercise of the powers conferred upon them by Article 140, subsection 3) of the Political Constitution.

1That both the government and the various segments of Costa Rican society have committed to jointly promoting the implementation of the Rio de Janeiro Declaration, as well as Agenda 21 and the Central American Alliance for Sustainable Development.
2That Agenda 21 indicates that it is essential to establish a dialogue in countries, at all levels of society, to foster a national consensus around Programme 21, as well as to promote joint cooperative activities between the public and private sectors, in order to seek coherence and compatibility in the measures taken.
3That it is of unavoidable importance that Costa Rica's sustainable development, in accordance with the policy set forth by the President of the Republic, be capable of responding to the urgent needs of the present, without this meaning compromising the right of future generations to meet their own needs.
4That through Law No. 7699 published in La Gaceta No. 211 of November 3, 1997, which approves the "United Nations Convention to Combat Desertification in Countries Experiencing Serious Drought and/or Desertification, Particularly in Africa," the importance of the problem of land degradation (degradación de las tierras) and the need for joint work between the various sectors of civil society and the government to execute action programs to combat this problem is recognized.
5That through Decree No. 27258-MINAE published in Alcance No. 60 to La Gaceta No. 178 of Friday, September 11, 1998, the Advisory Commission on Land Degradation (Comisión Asesora sobre Degradación de Tierras, CADETI) was created.
6That in order to develop the activities entrusted to CADETI, an adaptation of its regulatory framework established in the aforementioned Decree is required, in order to adjust it to the level of its functions.
7That the Law on the Use, Management, and Conservation of Soils No. 7779 establishes in its Article five a task led by MAG in coordination with MINAE for the fulfillment of the provisions and purposes of the Law regarding the management, conservation, and recovery of soils.

Considering:

Decree:

a. Participate in, coordinate, and follow up on the process of defining policies, agreements, plans, and programs related to the fight against land degradation, within the framework of the Convention. Likewise, facilitate and participate in the integration of activities carried out at the national level regarding land degradation.

b. Advise the Government's Focal Point to the Convention. The Focal Point shall be one of the members of CADETI and shall be designated by the Minister of Environment and Energy(*).

c. Collaborate with national and international organizations existing in the country related to this topic, in order to carry out workshops, symposia, talks, and other activities to train the Costa Rican population on the problem of land degradation, recovery of watersheds (cuencas hidrográficas), erosion, and other activities.

d. Facilitate the formulation and execution of projects for the rehabilitation, recovery, and prevention of land degradation.

e. Request support and logistical collaboration from public and private entities.

f. Propose the signing of cooperation agreements for carrying out projects related to the goals of the Convention.

g—Promote and facilitate scientific research in the country on this topic.

a. Two representatives from the University of Costa Rica, one from the Research Program in Synecology and Restoration of Terrestrial Ecosystems (SIRECO) and another from the Observatory of Development (ODD) as a collaborating center for Central America of the United Nations Environment Programme (UNEP).

b. One representative from non-governmental organizations that carry out activities related to the objectives of the Convention, appointed by the Office of the Minister of Environment and Energy(*).

c. One representative from the National System of Conservation Areas (Sistema Nacional de Areas de Conservación, SINAC) of the Ministry of Environment.

d—One representative from the Office of the Minister of Environment and Energy(*).

(Thus amended by Article 2 of Executive Decree No. 30231 of February 6, 2002) e. One representative from the National Meteorological Institute.

f. Two representatives from the Ministry of Agriculture and Livestock: one from the Department of Soils and Land Evaluation and the other from the Department of Conservationist Agriculture.

Each full member shall have an alternate, who shall participate with voice and vote in the absence of the former. The alternate may also participate alongside the full member in sessions, but with voice only.

Agreements shall be made by vote and shall require a simple majority of those present for approval.

They may be re-elected for consecutive periods.

a. Preside over sessions and direct debates; b. Convene ordinary and extraordinary sessions; c. Officially represent the Commission; d. Decide with a casting vote in the event of a tie; e. Other duties assigned by this Decree and the Commission.

They shall also be responsible for the files of the Commission and shall have the other powers assigned to them by it.

If the permanent absence, for any reason, is of the President or Vice President, the Commission shall proceed to immediately designate their replacement for the remainder of the term.

It must be read and approved at the following session, thus making the agreements contained therein final. Likewise, it must be signed by the President and the Secretary at the session in which it was read and approved.

The record shall state the result of the votes as well as any dissenting votes if there are any.

The review shall be resolved at the same session in which it was raised.

EL PRESIDENTE DE LA REPÚBLICA Y LOS MINISTROS DE AMBIENTE Y ENERGÍA(*) Y DE AGRICULTURA Y GANADERÍA (*)(Modificada su denominación por el artículo 11 de la Ley "Traslado del sector Telecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al Ministerio de Ciencia y Tecnología", N° 9046 del 25 de junio de 2012) En el ejercicio de las facultades que les confiere el artículo 140, inciso 3) de la Constitución Política.

1Que tanto el gobierno como los diversos segmentos de la sociedad costarricense se han comprometido a promover en forma conjunta la puesta en marcha de la Declaración de Río de Janeiro, así como la Agenda 21 y la Alianza Centroamericana para el Desarrollo Sostenible.
2Que la Agenda 21 indica que es fundamental establecer en los países un diálogo, a todos los niveles de la sociedad, para propiciar un consenso nacional en torno al Programa 21, así como promover actividades conjuntas de cooperación entre el sector público y el privado, con el fin de buscar coherencia y compatibilidad en las medidas que se tomen.
3Que es de importancia insoslayable que el desarrollo sostenible de Costa Rica, de acuerdo con la política planteada por el Presidente de la República, sea capaz de responder a las urgentes necesidades del presente, sin que esto signifique atentar contra el derecho de las generaciones futuras de satisfacer sus propias necesidades.
4Que mediante la Ley Nº 7699 publicada en La Gaceta Nº 211 del 3 de noviembre de 1997, que aprueba la "Convención de las Naciones Unidas de lucha contra la desertificación en los países afectados por sequía grave o desertificación, en particular en África" se reconoce la importancia del problema de la degradación de las tierras y la necesidad de un trabajo conjunto entre los diversos sectores de la sociedad civil y el gobierno para ejecutar programas de acción de lucha contra esta problemática.
5Que mediante Decreto Nº 27258-MINAE publicado en el Alcance Nº 60 a La Gaceta Nº 178 del viernes 11 de setiembre de 1998 se creó la Comisión Asesora sobre Degradación de Tierras (CADETI).
6Que a fin de desarrollar las actividades encomendadas a CADETI se impone una adecuación de su marco regulatorio establecido en Decreto mencionado, con el fin de ajustarlo al nivel de sus funciones.
7Que la Ley de Uso, Manejo y Conservación de Suelos Nº 7779, establece en su artículo cinco una labor liderada por el MAG en coordinación con el MINAE para el cumplimiento de las disposiciones y fines de la Ley en materia de manejo, conservación y recuperación de suelos.

Considerando:

Decretan:

a. Participar, coordinar y dar seguimiento al proceso de definición de políticas, acuerdos planes y programas relacionados con la lucha contra la degradación de las tierras, en el marco de la Convención. Asimismo, facilitar y participar en la integración de las actividades que se realizan en el ámbito nacional referentes a la degradación de tierras.

b. Asesorar al Punto Focal del Gobierno ante la Convención. El Punto Focal será uno de los miembros de CADETI y será designado por el Ministro de Ambiente y Energía(*).

c. Colaborar con los organismos nacionales e internacionales existentes en el país relacionados con esta temática, con el fin de realizar talleres, simposios, charlas y demás para capacitar a la población costarricense sobre el problema de la degradación de tierras, recuperación de cuencas hidrográficas, erosión y demás actividades.

d. Facilitar la formulación y ejecución de proyectos de rehabilitación, recuperación y prevención de degradación de tierras.

e. Solicitar el apoyo y colaboración logística de entes públicos y privados.

f. Proponer la firma de acuerdos de cooperación para la realización de proyectos relativos a las metas de la Convención.

g-Promover y facilitar la investigación científica en el país sobre esta temática.

a. Dos representantes de la Universidad de Costa Rica, uno del Programa de Investigación en Sinecología y Restauración de Ecosistemas terrestres (SIRECO) y otro del Observatorio del Desarrollo (ODD) como centro colaborador para Centroamérica del Programa de las Naciones Unidas para el Medio Ambiente (PNUMA).

b. Un representante de las organizaciones no gubernamentales que desarrollen actividades afines a los objetivos de la Convención, nombrados por el Despacho del Ministro de Ambiente y Energía(*).

c. Un representante del Sistema Nacional de Areas de Conservación (SINAC) del Ministerio del Ambiente.

d- Un representante del Despacho del Ministerio de Ambiente y Energía(*).

(Así reformado por el artículo 2 del Decreto Ejecutivo N° 30231 de 6 de febrero del 2002) e. Un representante del Instituto Meteorológico Nacional.

f. Dos representantes del Ministerio de Agricultura y Ganadería: uno del Departamento de Suelos y Evaluación de Tierras y el otro del Departamento de Agricultura Conservacionista.

Cada miembro propietario tendrá un suplente, el cual participará con voz y voto en ausencia del primero. El suplente también podrá participar junto con el propietario en las sesiones, pero sólo con voz.

Los acuerdos se tomarán por votación y requerirán de la mayoría simple de los presentes para su aprobación.

Podrán ser reelectos por períodos consecutivos.

a. Presidir las sesiones y dirigir los debates; b. Convocar a sesiones ordinarias y extraordinarias; c. Representar oficialmente a la Comisión; d. Decidir con voto doble en caso de empate; e. Las demás que este Decreto y la Comisión le asignen.

Será además responsable de los expedientes de la Comisión y tendrá las demás atribuciones que esta le asigne.

Si la ausencia permanente por cualquier causa fuese del Presidente o del Vicepresidente, la Comisión procederá a designar inmediatamente su sustitución por el resto del período.

Deberá ser leída y aprobada en la sesión siguiente, quedando así firmes los acuerdos contenidos en ella. Asimismo, deberá ser firmada por el Presidente y el Secretario en la sesión en que fue leída y aprobada.

En el acta se consignará el resultado de las votaciones así como los votos salvados si los hubiere.

La revisión se resolverá en la misma sesión en que fue planteada.

Artículo 2 — —The Advisory Commission on Land Degradation shall have the following functions:

Artículo 3 — —The Commission shall be composed of members from the academic, governmental, and non-governmental sectors of the country, distributed as follows:

Artículo 4 — —For the sessions of this Commission to be valid, the presence of a simple majority of its members shall be required.

Artículo 5 — —For greater effectiveness in its work, the Commission may create within its core the permanent and ad hoc subcommittees that are necessary, ensuring the participation of the various sectors in each one of them.

Artículo 6 — —The Commission shall meet ordinarily once a month, or extraordinarily when requested by the President or two of its members.

Artículo 7 — —Once the Commission is formed, it shall appoint from its core, by vote and for a period of one year, the President, Vice President, and Secretary.

Artículo 8 — —The powers of the President of the Commission shall be:

Artículo 9 — —The focal point of the Commission shall be the one designated by the Head of the Ministry of Environment and Energy(*), who must be chosen from the members indicated in subsections c, d, e, and f of Article 3.

Artículo 10 — —The functions of the Secretary shall be to prepare the agenda for each session, take the minutes, draft the respective records, and answer correspondence.

Artículo 11 — —In the temporary absence of the Secretary, another member of the Commission shall assume their functions.

Artículo 12 — —If one or more members of the Commission becomes incapacitated, resigns, or is absent without justification for more than three consecutive sessions, the President shall proceed to request their immediate replacement.

Artículo 13 — —A record shall be kept of each session.

Artículo 14 — —Any member of the Commission may request the review of an agreement made at the previous session, with the exception of final agreements.

Artículo 15 — —Decree No.

Artículo 16 — —It shall enter into force upon its publication.

Artículo 2 — La Comisión Asesora sobre Degradación de Tierras tendrá las siguientes funciones:

Artículo 3 — La Comisión estará integrada por miembros de los sectores académico, gubernamental y no gubernamental del país, distribuidos de la siguiente manera:

Artículo 4 — —Para que las sesiones de esta Comisión sean válidas se requerirá la presencia de la mayoría simple de sus miembros.

Artículo 5 — —Para mayor efectividad en su labor, la Comisión podrá crear en su seno subcomisiones permanentes y ad hoc que sean necesarias, cuidando la participación de los diversos sectores en cada una de ellas.

Artículo 6 — —La Comisión se reunirá en forma ordinaria una vez al mes, o en forma extraordinaria cuando lo solicite el Presidente o dos de sus miembros.

Artículo 7 — —Una vez integrada la Comisión, ésta nombrará de su seno, mediante votación y por lapso de un año, al Presidente, Vicepresidente y Secretario.

Artículo 8 — —Serán atribuciones del Presidente de la Comisión:

Artículo 9 — El punto focal de la Comisión será el que designe la o el Jerarca del Ministerio de Ambiente y Energía(*), el cual debe ser escogido de los miembros indicados en los incisos c, d, e, y f, del artículo 3.

Artículo 10 — —Serán funciones del Secretario preparar la agenda de cada sesión, tomar la minuta, redactar las actas respectivas y contestar la correspondencia.

Artículo 11 — —En ausencias temporales del Secretario asumirá sus funciones otro de los miembros de la Comisión.

Artículo 12 — —Si uno o más integrantes de la Comisión se incapacita, renuncia o ausenta injustificadamente por más de tres sesiones consecutivas, el Presidente procederá a solicitar su inmediata sustitución.

Artículo 13 — —De cada unas de las sesiones se levantará un acta.

Artículo 14 — —Cualquier miembro de la Comisión podrá solicitar la revisión de un acuerdo que se hubiere tomado en la sesión anterior con excepción de los acuerdos firmes.

Artículo 15 — —Deróguese el Decreto Nº 27258-MINAE, de 20 de mayo de mil novecientos noventa y ocho, publicado en el Alcance 60-A a La Gaceta Nº 178, del 11 de setiembre de 1998.

Artículo 16 — —Rige a partir de su publicación.
