throughout the entire text - Full Text of Rule 29278 Modifies Boundaries of the Cerro de la Carpintera Protective Zone No. 29278-MINAE (Note from Sinalevi: By means of Constitutional Chamber resolution No. 16793 of September 4, 2019, it was partially granted and the reduction of the area of the Cerro de la Carpintera Protective Zone, carried out through Decree No. 29278-MINAE of January 15, 2001, published in La Gaceta No. 30 of February 12, 2001, is annulled, leaving this decree in force only with regard to the expansion of the Cerro de la Carpintera Protective Zone. By virtue of the foregoing, the National System of Conservation Areas is ordered to proceed, within a period of twelve months, counted from the full publication of this pronouncement in the Judicial Bulletin, to delimit the aforementioned expanded area. This declaration of unconstitutionality shall have declarative and retroactive effect to the date the rule took effect, all without prejudice to good faith acquired rights.)

THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Using the powers conferred upon them by subsections 3) and 18) of article 140 of the Political Constitution.

1That by Executive Decrees No. 6112-A of June 23, 1976 and No. 21837-MIRENEM of February 5, 1993, the Cerro La Carpintera Protective Zone was created.
2That in this Protective Zone there are duly registered private properties, over which the State, in accordance with article 45 of our Political Constitution, cannot exercise acts that affect the property rights of individuals.
3That properties of great productive value for the country were included within the protected area, which according to studies conducted on them, their environmental value in relation to the Protective Zone would not be diminished if they are used appropriately.
4That what is most convenient for the development and protection of the La Carpintera Protective Zone is to modify its boundaries, in such a way that its surface area and integrity are maintained, incorporating lands of environmental importance and excluding those with productive value. Therefore,

Considering:

Decree:

136 of July 17, 1976; the boundaries of this area being within the limits defined below according to the cartographic sheets Patarrá, Carpintera, Ochomogo Edition 1 IGNCR, Scale 1:10,000, indicated by the description detailed below.

Starting from a point with coordinates 206,000 N, 533,000 E (point 1), the following description is followed:

4,210 meters due east, coordinates 206,000 N 537,210 E (point 2); At this point, the Coris - Patarrá road is intersected. From here, one continues along this road with a general northwest heading towards Patarrá until the intersection with coordinates 206,380 N 536,610 E (point 3). Next, a heading of N 20 W and a distance of 120 meters is followed to the intersection of coordinates 206,490 N 536,570 E (point 4). It continues with a heading of N 33 E and a distance of 119 meters to the intersection of coordinates 206,590 N 536,635 E (point 5) and arrives at the gravel road that comes from Patarrá towards Alto de Coris. It continues along this road following a sharp curve to the intersection of coordinates 206,620 N 536,780 E (point 6). It continues with a heading of N 58 E a distance of 37.7 meters to the intersection of coordinates 206,640 N 536,812 E, which coincides with the upper channel of the left branch of the Quebrada Barahona, (point 7). From this point, one follows downstream the left branch of the Quebrada Barahona to the confluence with the right branch of this same stream, at the intersection of coordinates 206,450 N 537,320 E, (point 8). From this point, one continues in a general southeast direction, downstream of the Quebrada Barahona to the FORD located at the crossing of a gravel road with the stream, at the intersection of coordinates 206,055 N 537,730 E, (point 9). It continues always along the gravel road with a heading of S 61 E and a distance of 62.6 meters to the intersection of coordinates 206,000 N 537,760 E, (point 10). It continues due east along coordinate 206,000 a distance of 1133.13 meters to the intersection with coordinates 206,000 N 538,893.135 E, (point 11). From this point, the following course is followed, which corresponds to the back azimuth, according to the following description:

en la totalidad del texto - Texto Completo Norma 29278 Modifica Límites de la Zona Protectora Cerro de la Carpintera Nº 29278-MINAE (Nota de Sinalevi: Mediante resolución de la Sala Constitucional N° 16793 del 4 de setiembre de 2019, se declaró parcialmente con lugar y se anula la reducción del área de la Zona Protectora Cerro de la Carpintera, realizada mediante el Decreto No. 29278-MINAE del 15 de enero de 2001, publicado en La Gaceta No. 30 del 12 de febrero del 2001, quedando este decreto vigente, únicamente en lo que se refiere a la ampliación de la Zona Protectora Cerro de la Carpintera. En virtud de lo anterior, se ordena al Sistema Nacional de Áreas de Conservación que proceda, dentro del plazo de doce meses, contado a partir de la publicación íntegra de este pronunciamiento en el Boletín Judicial, a delimitar el área ampliada mencionada. Esta declaratoria de inconstitucionalidad tendrá efecto declarativo y retroactivo a la fecha de vigencia de la norma, todo sin perjuicio de derechos adquiridos de buena fe.)

EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DEL AMBIENTE Y ENERGÍA En uso de las facultades que les confieren los incisos 3) y 18) del artículo 140 de la Constitución Política.

1Que mediante Decretos Ejecutivos Nº 6112-A del 23 de junio de 1976 y Nº 21837-MIRENEM del 5 de febrero de 1993, se creó la Zona Protectora Cerro La Carpintera.
2Que en esta Zona Protectora hay inmuebles propiedad privada debidamente inscritos, sobre los que el Estado, de conformidad con el artículo 45 de nuestra Constitución Política, no puede ejercer actos que afecten los derechos de propiedad de los particulares.
3Que dentro de área protegida se incluyeron inmuebles de gran valor productivo para el país, que según estudios efectuados en ellos su valor ambiental en relación con la Zona Protectora no se vería disminuido, si son utilizados adecuadamente.
4Que lo más conveniente para el desarrollo y protección de la Zona Protectora La Carpintera, es modificar sus límites, de forma se mantenga su superficie e integridad, incorporando terrenos de importancia ambiental y excluyendo aquellos con valor productivo. Por tanto,

Considerando:

Decretan:

Partiendo de un punto de coordenadas 206 000 N, 533.000 E (punto 1) se sigue la siguiente descripción:

4 210 metros al este franco, coordenadas 206.000 N 537 210 E (punto 2); En este punto se interseca la carretera Coris - Patarrá. A partir de aquí se continúa por esta carretera con rumbo general noroeste hacia Patarrá hasta la intersección con las coordenadas 206.380 N 536.610 E.(punto 3) A continuación se sigue un rumbo N 20 O y una distancia de 120 metros hasta la intersección de las coordenadas 206.490 N 536.570 E.(punto 4) Continúa con rumbo N 33 E y una distancia de 119 metros hasta la intersección de las coordenadas 206.590 N 536.635 E (punto 5) y se llega al camino de lastre que viene desde Patarrá hacia el Alto de Coris. Se continúa por este camino siguiendo una curva cerrada hasta la intersección de las coordenadas 206.620 N 536.780 E (punto 6) Se continúa con rumbo N 58 E una distancia de 37.7 ,metros hasta la intersección de las coordenadas 206.640 N 536.812 E que coincide con el cauce superior del brazo izquierdo de la Quebrada Barahona, (punto 7) A partir de este punto se sigue aguas abajo del brazo izquierdo de la Quebrada Barahona hasta la confluencia con el brazo derecho de esta misma quebrada, en la intersección de las coordenadas 206.450 N 537.320 E, (punto 8) De este punto se continúa en dirección general sureste, aguas abajo de la Quebrada Barahona hasta el VADO que se ubica en el cruce de un camino lastreado con la quebrada, en la intersección de las coordenadas 206.055 N 537.730 E, (punto 9). Se continúa siempre por el camino de lastre con un rumbo S 61 E y una distancia de 62.6 metros hasta la intersección de las coordenadas 206.000 N 537.760 E, (punto 10). Se continúa hacia el este franco por la coordenada 206.000 una distancia de 1133.13 metros hasta la intersección con las coordenadas 206.000 N 538.893,135 E. (punto 11). A partir de este punto se sigue el siguiente derrotero el cual corresponde al retroazimut, según la descripción siguiente:
