All institutions and bodies of the Public Administration, both centralized and decentralized, as well as public enterprises, are authorized to contribute all kinds of financial, human, material, and any other resources toward the achievement of the installation and operation of the Park.
The Pacific Marine Park and the Foundation are empowered to receive donations and contributions from any kind of private organizations, non-governmental bodies, friendly governments, and international institutions.
Said contributions shall be channeled directly to the Foundation referred to in this Law. In the case of financial resources, the Foundation shall administer them in separate accounts according to their public or private origin, with its own financial structure, or by entering into a trust agreement (fideicomiso) with one of the banks of the Sistema Bancario Nacional.
The contracting by the Foundation charged to the public resources it receives shall be carried out in accordance with the principles of the Ley de la Contratación Administrativa.
(Sinalevi Note: In accordance with Opinion C-391-2020 of October 8, 2020, the budgets of deconcentrated bodies with instrumental legal personality, being subject to approval by the Legislative Assembly, are fully subject to the Ley de Administración Financiera de la República y Presupuestos Públicos, Law No. 8131 of 09/18/2001, even when another provision with legal rank had previously excluded them partially or totally from the application of said normative text. The Ley de Fortalecimiento del control presupuestario de los órganos desconcentrados del Gobierno Central, No. 9524 of March 7, 2018, prevails over the provisions of the constituent laws of ministerial deconcentrated bodies with their own budget that predate its enactment and that provide for the partial or total exclusion from the Ley de Administración Financiera de la República y Presupuestos Públicos, Law No. 8131 of September 18, 2001, it being understood that they have been tacitly repealed.)
