"Article 39.—Every project for the sanitary disposal of trash or solid waste in ordinary service must be submitted to the Ministry of Health, attaching an environmental impact assessment (estudio de impacto ambiental) for its evaluation, duly approved by the Secretaría Técnica Nacional del Ambiente (SETENA) of the Ministerio del Ambiente y Energía.
Final solid waste disposal projects using the Manual Sanitary Landfills (Rellenos Sanitarios Manuales) technique, with a design population equal to or less than 75,000 inhabitants, are exempt from submitting the environmental impact assessment referred to in the preceding paragraph, provided that the following conditions are met:
1. That throughout the entire construction process of the sanitary landfill, both the health authorities and those of the Secretaría Técnica del Ambiente, or the Ministerio del Ambiente y Energía, conduct weekly visits to supervise that the respective health and environmental regulations are met during the construction process.
2. That the responsible municipal authorities in charge of the construction process and operation of the sanitary landfill undertake and obligate themselves to comply with the current health and environmental regulations, as well as with all directives issued by both the environmental authorities and the Ministerio del Ambiente y Energía.
3. That the respective municipal authorities undertake and obligate themselves to submit the respective environmental impact assessment (Estudio de Impacto Ambiental) whenever requested by the health authorities, and at any time.
