throughout the entire text - Complete Text of Regulation 45747 Amendment to the Organic Regulation of the Ministry of Environment and Energy and the Regulation for the Organization of the Energy Subsector and repeal of the Declaration of Public Interest for the preparation of the national energy balance N° 45747-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In the exercise of the powers and attributions conferred upon them by Articles 140, subsections 3) and 18), and 146 of the Political Constitution; Article 25, subsection 1), Article 27, subsection 1), and Article 28, subsection 2), subparagraph b) of the General Law on Public Administration, Law N° 6227 of May 2, 1978; Articles 1 and 4 of Law N° 10086 of December 8, 2021, Law for the Promotion and Regulation of Distributed Energy Resources from Renewable Sources; Articles 1, 2, 4, 5, 49, 56, 57, 59, 60, 62, and 63 of the Organic Law of the Environment, Law N° 7554 of October 4, 1995; Article 4 of the Organic Law of the Ministry of Environment and Energy, Law N° 7152 of June 5, 1990; Article 49 of Executive Decree N° 35669-MINAET of December 4, 2009, Organic Regulation of the Ministry of Environment and Energy; and Executive Decree N° 43398-MINAE of January 24, 2022, Declaration of Public Interest for the preparation of the national energy balance.
I.-That the Executive Branch understands that the organizational structure of the Ministry of Environment and Energy (MINAE) is of great relevance for its efficient and effective administrative management.
II.-That the Organic Law of the Ministry of Environment and Energy, Law N° 7152 of June 5, 1990, in its Article 4, indicates that MINAE shall be composed of the Energy Directorate (Dirección de Energía), the Geology and Mining Directorate (Dirección de Geología y Minas), the General Forestry Directorate (Dirección General Forestal), the Wildlife Department which, by virtue of this law, becomes the General Directorate, and the National Parks Service; likewise, it shall have the National Meteorological Institute attached, with the rank of General Directorate.
III.-That, with the objective of strengthening the management and scope of functions in energy matters within the country, it has been deemed necessary to add subsections g), h), i), and j) to Article 49 of Executive Decree N° 35669-MINAET of December 4, 2009, Organic Regulation of the Ministry of Environment and Energy. This addition is based on the need to restructure the competencies of the Energy Directorate to achieve greater efficiency in the administration and monitoring of energy issues of national and international relevance.
IV.-That through Executive Decree N° 35991-MINAET of January 19, 2010, called "Regulation for the Organization of the Energy Subsector," the Planning Secretariat of the Energy Subsector (Secretaría de Planificación del Subsector Energía, SEPSE) and the position of its Director were created in Articles 9 and 10 respectively; however, in current administrative practice, these functions have been effectively assumed by the Sectoral Planning Secretariat for Environment and Energy (Secretaría de Planificación del Sector Ambiente y Energía, SEPLASA). This redistribution of competencies renders the operability of SEPSE and the application of the regulations that support it without effect, making those provisions inapplicable. Consequently, it is necessary to proceed with the repeal of Article 6, subsection c), and Articles 9 and 10 of the cited regulation and to formalize the assignment of these attributions to SEPLASA and, as pertinent, to the Energy Directorate, guaranteeing regulatory coherence and administrative efficiency.
V.-That in accordance with official communication DM-142-2023, of March 1, 2023, issued by the Acting Minister, Ronny Rodríguez Chaves, it was established that the Energy Directorate of the Ministry of Environment and Energy shall assume the topics of: National Energy Balance (Balance Energético Nacional), Annual Report for the updating of the Sustainable Development Goal (SDG) indicators, and the country's representation in international bodies, such as the Central American Integration System (SICA) and the International Renewable Energy Agency (IRENA).
VI.-That in accordance with Article 12 bis of Executive Decree N° 37045-MP-MEIC of February 22, 2012, and its amendments, "Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures," Section I, called Prior Control of Regulatory Improvement, which comprises the Cost-Benefit Evaluation form, has been completed as a first step, and the responses provided in that Section have all been negative, given that this proposal does not contain procedures or requirements that the administered party must fulfill. I.-Que el Poder Ejecutivo entiende que la estructura orgánica del Ministerio de Ambiente y Energía (MINAE) es de gran relevancia para su eficiente y eficaz gestión administrativa.
II.-Que, la Ley Orgánica del Ministerio de Ambiente y Energía, Ley N° 7152 del 05 de junio de 1990, en su artículo 4° indica que el MINAE estará integrado por la Dirección de Energía, la Dirección de Geología y Minas, la Dirección General Forestal, el Departamento de Vida Silvestre que, en virtud de esta ley, pasa a ser la Dirección General, y el Servicio de Parques Nacionales; asimismo, tendrá adscrito el Instituto Meteorológico Nacional, con jerarquía de Dirección General.
III.-Que, con el objetivo de fortalecer la gestión y el alcance de las funciones en materia de energía dentro del país, se ha considerado necesario adicionar los incisos g), h), i) y j) del artículo 49 del Decreto Ejecutivo N° 35669-MINAET del 04 de diciembre del 2009, Reglamento Orgánico del Ministerio de Ambiente y Energía. Esta adición se fundamenta en la necesidad de reestructurar las competencias de la Dirección de Energía para lograr una mayor eficiencia en la administración y seguimiento de temas energéticos de relevancia nacional e internacional.
IV.-Que mediante el Decreto Ejecutivo N° 35991-MINAET del 19 de enero de 2010, denominado "Reglamento de Organización del Subsector Energía", se crearon la Secretaría de Planificación del Subsector Energía (SEPSE) y el cargo de su Director en los artículos 9° y 10 respectivamente; sin embargo, en la práctica administrativa actual, dichas funciones han sido asumidas de forma efectiva por la Secretaría de Planificación del Sector Ambiente y Energía (SEPLASA). Esta redistribución de competencias deja sin efecto la operatividad de la SEPSE y la aplicación de la normativa que la sustenta, tornando dichas disposiciones inaplicables. Por consiguiente, resulta necesario proceder con la derogación de los artículos 6° inciso c), 9° y 10 del citado reglamento y formalizar la asignación de estas atribuciones en la Secretaría de Planificación Sectorial de Ambiente y Energía (SEPLASA) y en lo correspondiente a la Dirección de Energía, garantizando coherencia normativa y eficiencia administrativa.
V.-Que de conformidad con el oficio DM-142-2023, del 01 de marzo del 2023, emitido por el Ministro a.í. Ronny Rodríguez Chaves, se estableció que la Dirección de Energía del Ministerio de Ambiente y Energía asumirá los temas: Balance Energético Nacional, Informe Anual para la actualización de los indicadores del Objetivo de Desarrollo Sostenible (ODS), y la representación del país en organismos internacionales, tales como el Sistema de Integración Centroamericana (SICA) y la Agencia Internacional de Energía Renovable (IRENA).
VI.-Que de conformidad con el artículo 12 bis del Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero de 2012 y sus reformas "Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos" se ha completado como primer paso la Sección I denominada Control Previo de Mejora Regulatoria, que conforma el formulario de Evaluación Costo Beneficio y las respuestas brindadas en esa Sección han sido todas negativas, toda vez que la presente propuesta no contiene trámites ni requisitos que el administrado deba cumplir. Por tanto,
