in the entirety of the text - Complete Text of Norm 45259 Renders without effect Declares of public utility for the interests of the State the Asociación Aves de Osa Investigación y Conservación N° 45259-MJP THE PRESIDENT OF THE REPUBLIC THE MINISTER OF JUSTICE AND PEACE Based on the provisions of Articles 140, subsection 18) and 146 of the Political Constitution, Article 32 of the Associations Law (Ley de Asociaciones) N° 218 of August 8, 1939, and Articles 27 and following of the Regulation to the Associations Law (Reglamento a la Ley de Asociaciones) N° 29496-J, published in La Gaceta N° 96 of May 21, 2001, Articles 25 subsection 1), Article 27 subsection 1), and 28 subsection 2) item b) of the General Public Administration Law (Ley General de Administración Pública) N° 6227 of May 2, 1978, as well as the provisions of Article 3, subsection ch), of the Income Tax Law (Ley de Impuesto sobre la Renta) N° 7092 and Articles 103 and 104 of the Code of Tax Rules and Procedures (Código de Normas y Procedimientos Tributarios) N° 4755.

I.-That Article 32 of the Associations Law (Ley de Asociaciones) N° 218 of August 8, 1939, and its amendments, grants the Executive Branch the power to declare of public utility simple, federated, or confederated associations whose development and activities are particularly useful for the interests of the State, and which thereby contribute to meeting a social need.

II.-The Asociación Aves de Osa Investigación y Conservación, legal identification number three-zero zero two-six hundred eighty-three thousand one hundred forty-four, was registered in the Registry of Associations (Registro de Asociaciones) of the Public Registry on the sixteenth day of June of two thousand fourteen, in volume two thousand thirteen, entry three hundred four thousand one hundred seven.

III.-That Article 33 ter of the Regulation to the Associations Law (Reglamento a la Ley de Asociaciones) states: "In the event that any association renounces the public utility declaration (declaratoria de utilidad pública), it must submit the corresponding documentation to the Legal Advisory Office (Asesoría Jurídica) of the Ministry of Justice and Peace which, without further procedure, will proceed with the repeal." IV.-That the Asociación Aves de Osa Investigación y Conservación, legal identification number three-zero zero two-six hundred eighty-three thousand one hundred forty-four, by official communication dated the fourteenth of March of two thousand twenty-five, submitted by its legal representative, Ms. Karen Marie Leavelle, with passport number six four two four one seven nine five two, formally communicated the renunciation of the benefit of the public utility declaration (declaratoria de utilidad pública). Therefore, They Decree:

REPEAL THE DECLARATION OF PUBLIC UTILITY OF THE ASOCIACIÓN AVES DE OSA INVESTIGACIÓN Y CONSERVACIÓN

Considering:

en la totalidad del texto - Texto Completo Norma 45259 Deja sin efecto Declara de utilidad pública para los intereses del Estado la Asociación Aves de Osa Investigación y Conservación N° 45259-MJP EL PRESIDENTE DE LA REPÚBLICA EL MINISTRO DE JUSTICIA Y PAZ Con fundamento en lo dispuesto en los artículos 140, inciso 18) y 146 de la Constitución Política, en el artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones N° 29496-J, publicado en La Gaceta N° 96 del 21 de mayo del 2001, en los artículos 25 inciso 1), artículo 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de Administración Pública N° 6227 del 02 de mayo de 1978, así como lo establecido en el artículo 3°, inciso ch), de la Ley de Impuesto sobre la Renta N° 7092 y el los artículos 103 y 104 del Código de Normas y Procedimientos Tributarios N° 4755.

I.-Que el artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.

II.-La Asociación Aves de Osa Investigación y Conservación, cédula jurídica número tres-cero cero dos-seiscientos ochenta y tres mil ciento cuarenta y cuatro, se inscribió en el Registro de Asociaciones del Registro Público el día dieciséis de junio del dos mil catorce, al tomo dos mil trece, asiento trescientos cuatro mil ciento siete.

III.-Que el artículo 33 ter del Reglamento a la Ley de Asociaciones indica: "En caso de que alguna asociación renuncie a la declaratoria de utilidad pública, deberá presentar la documentación correspondiente ante la Asesoría Jurídica del Ministerio de Justicia y Paz quien, sin más trámite, procederá a realizar la derogatoria." IV.-Que la Asociación Aves de Osa Investigación y Conservación, cédula jurídica número tres-cero cero dos-seiscientos ochenta y tres mil ciento cuarenta y cuatro, mediante oficio de fecha catorce de marzo del dos mil veinticinco, presentado por su representante legal, la señora Karen Marie Leavelle, con pasaporte número seis cuatro dos cuatro uno siete nueve cinco dos, comunicó formalmente la renuncia al beneficio de la declaratoria de utilidad pública. Por tanto,

DEROGAR LA DECLARATORIA DE UTILIDAD PÚBLICA DE LA ASOCIACIÓN AVES DE OSA INVESTIGACIÓN Y CONSERVACIÓN
