in the entirety of the text - Complete Text of Norm 43488 Declares of public utility for the interests of the State the Association Aves de Osa Investigación y Conservación No. 43488-MJP (This executive decree was rendered void by Article 1 of executive decree No. 45259 of September 17, 2025) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Pursuant to the provisions of Articles 140, subsection 18) and 146 of the Political Constitution, Article 32 of the Law of Associations No. 218 of August 8, 1939, and Articles 27 and following of the Regulation to the Law of Associations No. 29496-J, published in La Gaceta No. 96 of May 21, 2001, as well as the provisions of Article 3, subsection ch) of the Income Tax Law No. 7092 and Articles 103 and 104 of the Code of Tax Norms and Procedures No. 4755.
I.-That Article 32 of the Law of Associations No. 218 of August 8, 1939 and its amendments, grants the Executive Power the authority to declare of public utility simple, federated, or confederated associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to addressing a social need.
II.-That the Administering Association Aves de Osa Investigación y Conservación, legal entity identification number 3-002-683144, was registered in the Registry of Associations of the National Public Registry since June 16, 2014, volume 2013, entry 304107.
III.-That the purposes pursued by the association, according to its bylaws, are: "a) Promote the conservation of birds on the Península de Osa. b) Make all necessary efforts to achieve the conservation of native and migratory bird species on the Península de Osa. c) Protect birds from poachers and from diseases that by the hand of man may affect their habitat. d) Create habitats for birds through the acquisition of properties that allow observation, care, transit, and permanence of birds in areas of the Península de Osa. e) Carry out an annual bird count that allows maintaining detailed information about bird populations and migratory conditions, in the zone of influence of Parque Nacional Corcovado".
IV.-That such purposes address a social need of the highest order, for which they deserve the support of the Costa Rican State.

en la totalidad del texto - Texto Completo Norma 43488 Declara de utilidad pública para los intereses del Estado la Asociación Aves de Osa Investigación y Conservación N° 43488-MJP (Este decreto ejecutivo se dejó sin efecto por el artículo 1° del decreto ejecutivo N° 45259 del 17 de setiembre de 2025) EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DE JUSTICIA Y PAZ Con fundamento en lo dispuesto en los artículos 140, inciso 18) y 146 de la Constitución Política, en el artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones N° 29496-J, publicado en La Gaceta N° 96 del 21 de mayo del 2001, así como lo establecido en el artículo 3, inciso ch) de la Ley de Impuesto sobre la Renta N° 7092 y en los artículos 103 y 104 de Código de Normas y Procedimientos Tributarios N° 4755.
I.-Que el artículo 32 de la Ley de Asociaciones N° 218 de 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-Que la Asociación Administradora Aves de Osa Investigación y Conservación, cédula de persona jurídica número 3-002-683144, se inscribió en el Registro de Asociaciones del Registro Público Nacional desde el 16 de junio del 2014, tomo 2013, asiento 304107.
III.-Que los fines que persigue la asociación, según sus estatutos son: "a) Promover la conservación de las aves en la Península de Osa. b) Realizar todos los esfuerzos necesarios para lograr la conservación de las especies nativas y migrantes de aves en la Península de Osa. c) proteger las aves de cazadores furtivos y de enfermedades que por mano de hombre puedan afectar su hábitat. d) Crear hábitats para las aves mediante la adquisición de propiedades que permitan la observación, el cuido, el tránsito y permanencia de las aves en zonas de la Península de Osa. e) Realizar un conteo de aves anual que permita mantener información detallada acerca de las poblaciones y condiciones migratorias de las aves, en la zona de influencia del Parque Nacional Corcovado".
IV.-Que tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado costarricense.
