Minor Infractions shall be sanctioned with five times the corresponding rate, in accordance with the category assigned by the Municipality.

Fines shall be calculated according to the assigned category and the following formula:

FORMULA PUBLIC AND RELIGIOUS RESIDENTIAL SECTOR:

MLVR=TAR*MLP*F . MLVR= Fine amount for a minor infraction in the public and religious residential sector.

TAR= R*4 or TAR: Annualized public and religious residential rate per linear meter of property frontage in effect at the moment of the infraction, or R: amount charged in the quarterly period, or 4: quarters of the year . The foregoing shall apply without prejudice to the obligation of the infractor to compensate and repair the environmental damage (daño ambiental), as well as the payment of the costs incurred by the municipality in correctly collecting and disposing of the waste.

SECOND: In accordance with the provisions of numeral 43 of the current Municipal Code, this amendment to numeral 130 of the regulation was submitted to a non-binding public consultation for a period of ten business days. During the consultation period, published in Gazette No. 217 of 18 November 2025, no observations were received.

THIRD: The proposed reform to Article 130 of the RGIRS of the Municipality of the Central Canton of San José is approved, and in accordance with the preceding normative provision of the Municipal Code, its referral to a second publication is ordered so that this reform may enter into application.

Lo anterior, sin perjuicio de la obligación del infractor de indemnizar y reparar el daño ambiental, así como el pago de los costos en los que haya incurrido la municipalidad en recoger y disponer los residuos correctamente.

SEGUNDO: De conformidad con lo dispuesto en el numeral 43 del Código Municipal vigente, esta modificación al numeral 130 del reglamento se sometió a consulta pública no vinculante, por espacio de diez días hábiles. Durante el plazo de la consulta, publicada en la Gaceta N° 217 del 18 de noviembre del 2025 no se recibieron observaciones.

TERCERO: Se aprueba la reforma propuesta al Artículo 130 del RGIRS de la Municipalidad del Cantón Central de San José y conforme la anterior disposición normativa del Código Municipal, se dispone la remisión a segunda publicación para que esta reforma entre en aplicación.
