in the entirety of the text - Complete Text of Standard 001 Extends the entry into force of Executive Decree No. 44336-MAG-S-SP-MOPT "Creates the National System for Individual Identification and Traceability of Bovine Cattle" MINISTRY OF AGRICULTURE AND LIVESTOCK Resolution-MAG-SENASA-DM-RA-001-2025.-Ministry of Agriculture and Livestock and the General Directorate of the National Animal Health Service.-San José, at eleven hours thirty minutes on the twenty-sixth of November, two thousand twenty-five.

I.-That pursuant to articles 140 subsections 3) and 18) and 146 of the Political Constitution, and articles 25, 27 and 28 subsection 2) of the General Law of Public Administration, as well as article 6 of Law No. 7064, Law Creating the Ministry of Agriculture and Livestock, the Ministry of Agriculture and Livestock (MAG) is responsible for directing and coordinating public policies for the national agricultural and livestock sector.

II.-That the National Animal Health Service (SENASA), created by Law No. 8495 of April 6, 2006, is the deconcentrated body of MAG responsible for administering, planning, directing, and executing the veterinary and sanitary measures necessary to guarantee animal health, food safety, animal welfare, and the traceability of products and by-products of animal origin.

III.-That by means of Executive Decree No. 44336-MAG-S-SP-MOPT, entitled "Creates the National System for Individual Identification and Traceability of Bovine Cattle," the regulatory framework was established for the individual identification of bovine cattle and the traceability of their movement, with the aim of strengthening national mechanisms for sanitary control, epidemiological surveillance, commercial transparency, and access to international markets.

IV.-That the implementation of the National System for Individual Identification and Traceability of Bovine Cattle requires coordination among different public institutions, training of producers and veterinary doctors, adaptation of institutional computer systems, and timely distribution of official identification devices. Due to the foregoing, and in order to guarantee the continuity of the country's sanitary safety during the transition phase, it is deemed necessary to extend the entry into force of Executive Decree No. 44336-MAG-S-SP-MOPT by three additional months, moving its application from January 26 to April 26 of the year 2026.

V.-That the Veterinary Operation Certificate (CVO), regulated in Executive Decree No. 34859-MAG, constitutes the technical-sanitary instrument through which SENASA authorizes the operation of establishments that carry out productive, commercial, and transformation activities related to animals and products of animal origin, in order to guarantee public and veterinary health and compliance with requirements of sanitation, biosafety, and traceability, among others, required by national regulations.

VI.-That the CVO is an essential and complementary element of the National Bovine Cattle Traceability System, as it allows for the identification and registration of establishments where cattle originate from, are handled, or transported, ensuring the veracity of the information contained in the "Official Movement Guide," a necessary and required document for transporting bovine cattle within the national territory on public roads; therefore, keeping the information of establishments with a CVO in primary production updated is indispensable to guarantee the integrity and reliability of bovine cattle traceability at the national level.

VII.-That it has been verified that many producers involved in primary production, especially in beef and dairy cattle farming, did not update the registration of Establishments with a Veterinary Operation Certificate (CVO) during the years 2023 to 2025 due to technical or logistical limitations or while awaiting the entry into operation of the National System for Individual Identification and Traceability of Bovine Cattle, for which reason their CVO was canceled.

VIII.-That in order to avoid a disruption in the sanitary control chain and in the national traceability of bovine cattle, it is appropriate to grant a grace period of three months to the establishments whose deadline for updating data for the renewal of the CVO has expired, through the submission of a sworn statement of update before SENASA.

IX.-That this measure seeks to preserve the country's sanitary safety, ensuring the continuity of veterinary and administrative controls while the implementation of the bovine cattle traceability system is consolidated, thus avoiding registration gaps or sanitary risks that could affect production, trade, or the country's international sanitary status. Therefore, THE MINISTER OF AGRICULTURE AND LIVESTOCK AND THE GENERAL DIRECTOR OF THE NATIONAL ANIMAL HEALTH SERVICE,

1º-To extend, under the protection of Transitory Provisions III and IV of Executive Decree No. 44336-MAGS-SP-MOPT, entitled "Creates the National System for Individual Identification and Traceability of Bovine Cattle," and for reasons of convenience and timeliness, the entry into force of the indicated Executive Decree, for a period of three additional months, so that its application will begin as of April 26 of the year 2026.

2º-To authorize a three-month grace period so that those primary production establishments for bovine cattle (selection and production of breeding stock, milk production, meat production, dual-purpose production, development of replacements, production of oxen), whose Veterinary Operation Certificate (CVO) or Precarious Veterinary Operation Certificate (CVO) has expired due to lack of updating of the Registry of Establishments with CVO in the period between January 1, 2023, and the effective date of this Resolution, may proceed to carry out said procedure, with the respective CVO remaining in force. The foregoing, provided that the establishments comply with the sanitary, environmental, and administrative requirements, except in cases of grounds for issuing a Precarious CVO. Said grace period shall begin to be counted as of the effective date of this Resolution.

3º-Publish this resolution in the Official Gazette La Gaceta and on the official web pages of MAG and SENASA, for dissemination purposes.

en la totalidad del texto - Texto Completo Norma 001 Prorroga la entrada en vigencia del Decreto Ejecutivo N° 44336-MAG-S-SP-MOPT "Crea el Sistema Nacional de Identificación Individual y Rastreabilidad del ganado bovino" MINISTERIO DE AGRICULTURA Y GANADERÍA Resolución-MAG-SENASA-DM-RA-001-2025.-Ministerio de Agricultura y Ganadería y la Dirección General del Servicio Nacional de Salud Animal.-San José, a las once horas treinta minutos del veintiséis de noviembre del dos mil veinticinco.

I.-Que conforme a los artículos 140 incisos 3) y 18) y 146 de la Constitución Política, y los artículos 25, 27 y 28 inciso 2) de la Ley General de la Administración Pública, así como el artículo 6° de la Ley N° 7064, Ley de Creación del Ministerio de Agricultura y Ganadería, compete al Ministerio de Agricultura y Ganadería (MAG) dirigir y coordinar las políticas públicas del sector agropecuario nacional.

II.-Que el Servicio Nacional de Salud Animal (SENASA), creado mediante la Ley N° 8495 del 6 de abril de 2006, es el órgano desconcentrado del MAG responsable de administrar, planificar, dirigir y ejecutar las medidas veterinarias y sanitarias necesarias para garantizar la salud animal, la inocuidad de los alimentos, el bienestar animal y la trazabilidad de los productos y subproductos de origen animal.

III.-Que mediante el Decreto Ejecutivo N° 44336-MAG-S-SP-MOPT, denominado "Crea el Sistema Nacional de Identificación Individual y Rastreabilidad del Ganado Bovino", se estableció el marco normativo para la identificación individual de los bovinos y la trazabilidad de su desplazamiento, con el fin de fortalecer los mecanismos nacionales de control sanitario, vigilancia epidemiológica, transparencia comercial y acceso a los mercados internacionales.

IV.-Que la implementación del Sistema Nacional de Identificación Individual y Rastreabilidad del Ganado Bovino requiere la coordinación entre distintas instituciones públicas, la capacitación de los productores y médicos veterinarios, la adaptación de los sistemas informáticos institucionales y la distribución oportuna de los dispositivos oficiales de identificación. En razón de lo anterior, y con el fin de garantizar la continuidad de la seguridad sanitaria del país durante la fase de transición, se considera necesario prorrogar por tres meses adicionales la entrada en vigencia del Decreto Ejecutivo N° 44336-MAG-S-SP-MOPT, trasladando su aplicación del 26 de enero al 26 de abril del año 2026.

V.-Que el Certificado Veterinario de Operación (CVO), regulado en el Decreto Ejecutivo N° 34859-MAG, constituye el instrumento técnico-sanitario mediante el cual el SENASA autoriza el funcionamiento de los establecimientos que realizan actividades productivas, comerciales y de transformación relacionadas con animales y productos de origen animal, en función garantizar la salud pública y veterinaria y el cumplimiento de requisitos de sanidad, bioseguridad y trazabilidad, entre otros, exigidos por la normativa nacional.

VI.-Que el CVO es un elemento esencial y complementario del Sistema Nacional de Trazabilidad del Ganado Bovino, en tanto permite identificar y registrar los establecimientos donde se origina, manipula o transporta ganado, asegurando la veracidad de la información que se contiene en la "Guía Oficial de Movilización", documento necesario y exigido para poder transportar dentro del territorio nacional en vías públicas el ganado vacuno, por lo que mantener actualizada la información de los establecimientos con CVO de la producción primaria es indispensable para garantizar la integridad y confiabilidad de la trazabilidad del ganado vacuno a nivel nacional.

VII.-Que se ha constatado que muchas personas productoras insertos en la producción primaria, especialmente en la ganadería de carne y leche, no actualizaron el registro de Establecimientos con Certificado Veterinario de Operación (CVO) durante los años 2023 a 2025 debido a limitaciones técnicas, logísticas o a la espera de la entrada en operación del Sistema Nacional de Identificación Individual y Rastreabilidad del Ganado Bovino, por lo que les fue cancelado el CVO.

VIII.-Que a fin de evitar una disrupción en la cadena de control sanitario y en la trazabilidad nacional del ganado bovino, resulta conveniente otorgar un periodo de gracia de tres meses a los establecimientos a los cuales se les venció el plazo de actualización de datos para la renovación del CVO mediante la presentación de una declaración jurada de actualización ante el SENASA.

IX.-Que esta medida busca preservar la seguridad sanitaria del país, asegurando la continuidad de los controles veterinarios y administrativos mientras se consolida la implementación del sistema de trazabilidad del ganado bovino, evitando así vacíos de registro o riesgo sanitario que pudiesen afectar la producción, el comercio o el estatus sanitario internacional del país. Por tanto, EL MINISTRO DE AGRICULTURA Y GANADERÍA Y EL DIRECTOR GENERAL DEL SERVICIO NACIONAL DE SALUD ANIMAL,

1º-Prorrogar, al amparo del Transitorio III y IV del Decreto Ejecutivo N° 44336-MAGS-SP-MOPT, denominado "Crea el Sistema Nacional de Identificación Individual y Rastreabilidad del Ganado Bovino", y por razones de conveniencia y oportunidad, la entrada en vigencia del Decreto Ejecutivo indicado, por un plazo de tres meses adicionales, de manera que su aplicación iniciará a partir de 26 de abril del año 2026.

2º-Autorizar un período de tres meses de gracia para que aquellos establecimientos de producción primaria de ganado bovino (selección y producción de pie de cría, producción de leche, producción de carne, producción con doble propósito, desarrollo de reemplazos, producción de bueyes), cuyo Certificado Veterinario de Operación (CVO) o Certificado Veterinario de Operación (CVO) en Precario haya vencido por falta de actualización del Registro de Establecimientos con CVO en el período comprendido entre el 01 de enero de 2023 y la fecha de entrada en vigencia de la presente Resolución, procedan a efectuar dicho trámite, manteniéndose vigente el CVO respectivo. Lo anterior, siempre y cuando los establecimientos cumplan con los requisitos sanitarios, ambientales y administrativos, salvo que se trate de las causales para la emisión del CVO en Precario. Dicho plazo de gracia comenzará a computarse a partir de la fecha de vigencia de la presente Resolución.

3º-Publíquese la presente resolución en el Diario Oficial La Gaceta y en las páginas web oficiales del MAG y del SENASA, para efectos de su divulgación.
