in the entirety of the text - Complete Text of Standard 45244 Reform of the Regulation to the Phytosanitary Protection Law No. 45244 -MAG THE PRESIDENT OF THE REPUBLIC, AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Based on the powers and authorities conferred in articles 50, 140 subsections 3) and 18) and 146 of the Political Constitution; articles 27 subsection 1) and article 28 subsection 2) item b) of the General Law of Public Administration, No. 6227 of May 2, 1978; and articles 4, 5 subsection b of the Phytosanitary Protection Law No. 7664 of April 8, 1997, the Law for the Promotion of Agricultural and Organic Production of the Ministry of Agriculture and Livestock, No. 7064 of April 29, 1987 and the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Law No. 8220 of March 4, 2002.

1 º- That, with the growing commercial exchange, due to the opening of markets among countries, the possibilities of importing application equipment (equipos de aplicación) have increased and therefore the respective regulations are required to guarantee the quality standards of the equipment.

1. 2That pursuant to the provisions of the Phytosanitary Protection Law No. 7664 of April 8, 1997, it is an essential function of the State Phytosanitary Service (SFE) to regulate the use and handling of equipment for application in agriculture, as well as its registration, importation, quality and residues, while simultaneously seeking to protect human health and the environment, establishing the phytosanitary requirements and the necessary controls on imports of equipment samples.
2. 3That, pursuant to article No. 4 of the Law for the Protection of Citizens from Excessive Procedures and Administrative Requirements, Law No. 8220 of March 4, 2002, every procedure or requirement that the administered party must fulfill must be set forth in a law, a decree or a regulation and be published in the official gazette La Gaceta.
3. 4That it is convenient and necessary to reform article 93 of Executive Decree No. 26921-MAG of March 20, 1998 and its reforms; Regulation to the Phytosanitary Protection Law, to adjust it to the provisions of Law 8220 and thus give publicity to the instructions that the State Phytosanitary Service must have available for users who intend to make use of an application equipment (equipo de aplicación).
4. 5That, in accordance with the second and third paragraphs of article 12 of the Regulation to the Law of Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012, the present Decree does not create or modify procedures, requirements or procedures, and therefore does not require the regulatory improvement process.

THEY DECREE:

Reform of article 93 of Executive Decree No. 26921 MAG of March 20, 1998 named "Regulation to the Phytosanitary Protection Law"

CONSIDERING:

THEREFORE,

en la totalidad del texto - Texto Completo Norma 45244 Reforma Reglamento a la Ley de Protección Fitosanitaria Nº 45244 -MAG EL PRESIDENTE DE LA REPÚBLICA, Y EL MINISTRO DE AGRICULTURA Y GANADERÍA Con fundamento en las atribuciones y facultades conferidas en los artículos 50, 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 27 inciso 1) y artículo 28 inciso 2) acápite b) de la Ley General de la Administración Pública, Nº 6227 del 2 de mayo de 1978; y los artículos 4, 5 inciso b de la Ley de Protección Fitosanitaria Nº 7664 del 08 de abril de 1997, la Ley de Fomento a la Producción Agropecuaria y Orgánica del Ministerio de Agricultura y Ganadería, Nº 7064 del 29 de abril de 1987 y la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Ley Nº 8220 del 4 de marzo de 2002.

1 º- Que, con el creciente intercambio comercial, por la apertura de mercados entre los países, las posibilidades de importaciones de equipos de aplicación se han incrementado y por ende se requiere de las respectivas regulaciones para garantizar los estándares de calidad del equipo.

1. 2Que conforme a lo dispuesto en la Ley de Protección Fitosanitaria Nº 7664 del 08 de abril de 1997, es función esencial del Servicio Fitosanitario del Estado (SFE) regular el uso y manejo de equipos para aplicar en la agricultura, así mismo su registro, importación, calidad y residuos, procurando al mismo tiempo proteger la salud humana y el ambiente, estableciendo los requisitos fitosanitarios y los controles necesarios a las importaciones de muestras de equipos.
2. 3Que, conforme al artículo Nº 4 de la Ley de Protección al Ciudadano del Exceso de Trámites y Requisitos Administrativos, Ley Nº 8220 del 04 de marzo de 2002, todo trámite o requisitos que el administrado debe cumplir deben constar en una ley, un decreto o un reglamento y estar publicado en el diario oficial La Gaceta.
3. 4Que se hace conveniente y necesario reformar el artículo 93 del Decreto Ejecutivo No. 26921-MAG del 20 de marzo de 1998 y sus reformas; Reglamento a la Ley de Protección Fitosanitaria, para ajustarlo lo establecido en la Ley 8220 y así darle publicidad al instructivo que el Servicio Fitosanitario del Estado deberá tener a disposición de los usuarios que pretendan hacer uso de un equipo de aplicación.
4. 5Que, de conformidad con los párrafos segundo y tercero del artículo 12 del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N.º 37045-MP-MEIC del 22 de febrero de 2012, el presente Decreto no crea ni modifica trámites, requisitos o procedimientos, por lo que no requiere del trámite de mejora regulatoria.
