Decreto 45197 — Reform to temporary assistance for cyclical poverty in the fishing sector due to closures

In exercise of the provisions and powers established in Articles 50, 51, 140 subsections 3) and 18) and 146 of the Political Constitution; Articles 25, subsection 1 ), 27, subsection 1) and 28, paragraph 2), subsection b) of the General Law of Public Administration, Law Nº. 6227, of May 2, 1978; Article 36 of the Fisheries and Aquaculture Law, Law Nº. 8436, of March 1, 2005; and the Law Creating the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA), Law Nº. 7384, of March 16, 1994.

I.That in accordance with Article 50 of the Political Constitution, the State must orient its actions toward procuring the greatest well-being of the country's population, for which it is pertinent to provide greater coherence to the public services and benefits available to the social sector to address the needs of the population.

II.That the aforementioned constitutional norm states that every person has the right to a healthy and ecologically balanced environment.

III.That the closure period (período de veda) causes a situation of circumstantial poverty among fishers due to the lack of income from this source, which pursues a public purpose and interest aimed at the protection, conservation, and sustainability of hydrological resources, for which it is necessary to ensure the effective compliance thereof, by defining temporary assistance for said fishers that adequately covers their basic needs, nutrition, health, and housing.

IV.That Article 5 subsection i) of Law Nº. 7384, Law Creating Incopesca, and section 34 of Law Nº 8436, Fisheries and Aquaculture Law, indicate as a power and competence of Incopesca to establish, in accordance with technical, scientific, economic, and social criteria, the closure zones or seasons (zonas o épocas de veda), whether by areas or by specific species, in order to protect and utilize hydrobiological resources sustainably.

V.That in Article 36 of Law 8436, Fisheries and Aquaculture Law, it is stated: " ... The Executive Branch may authorize the allocation of funds from the National Budget in favor of Incopesca for conducting studies on closures (vedas), and in favor of the Joint Institute for Social Assistance (IMAS), with the purpose of developing socioeconomic assistance programs designed especially for this purpose, in favor of fishers affected during closure periods (períodos de veda), provided that it is proven that they have no other sources of income and are in a condition of poverty. These programs will necessarily involve community work services by the beneficiaries, in accordance with the corresponding regulations or for conducting studies on the matter"

VI.That in compliance with Article 361 of the General Law of Public Administration, a hearing was granted to the Costa Rican Institute of Fisheries and Aquaculture, which through official communication INCOPESCA-1431-2024 indicated having no observations on the draft Executive Decree, by virtue of it being consistent with the Fisheries and Aquaculture Law and the legally assigned competences of the institutions involved in this process.

VII.That the present decree does not create requirements, therefore, in accordance with the second and third paragraphs of Article 12 bis of the Regulation to the Law for the Protection of the Citizen from the Excess of Requirements and Administrative Procedures, Executive Decree Nº 37045-MP-MEIC of February 22, 2012, the completion of the cost-benefit form is not required.

They Decree:

PARTIAL REFORM AND REPEAL OF ARTICLES 5 AND 12 OF EXECUTIVE DECREE Nº. 36043-MAG-SP-MS, PERMANENT REGULATIONS FOR THE IMPLEMENTATION OF TEMPORARY ASSISTANCE FOR CIRCUMSTANTIAL POVERTY IN THE COSTA RICAN FISHING SECTOR DUE TO CLOSURE DECLARATIONS, OF MAY 13, 2010

CONSIDERING

36043-MAG-SP-MS, Permanent regulations for the implementation of temporary assistance for circumstantial poverty in the Costa Rican fishing sector due to closure declarations, of May 13, 2010, are hereby reformed to read as follows:

"Article 2°-Once a closure zone and season (zona y época de veda) is defined, during which the conditions, limits, restrictions, or prohibition on carrying out fishing activity actions are set and the recognition by IMAS of some temporary assistance for the fishers and helpers materializes, their full acceptance of the regulations of this Decree shall be understood. " "Article 3º-Incopesca must certify before IMAS the fishing persons affected by the closure (veda) and their helpers when applicable and insofar as it is determined that the per capita income is reduced to an amount equal to or less than the poverty line defined by the National Institute of Statistics and Censuses, IMAS shall grant them temporary economic assistance for reasons of unemployment and circumstantial poverty, whose maximum monthly amount may be equivalent to 40% of the current legal minimum wage of an unskilled worker, in accordance with the real situation of said Sector and in adherence to the requirements and conditions established for these purposes.

[ . .}" "Article 4°-To receive the economic assistance granted by IMAS, the affected fishing persons and helpers, whether they carry out fishing activities or not, must submit to a Community Work Service Program, which shall consist of the participation of the beneficiaries in: programs, projects, and activities that favor the personal and social development of the person and contribute to the solution of Institutional and Community problems, always under the protection of an insurance policy against accidents paid for by the administration as an indispensable condition for performing the community work.

For the purpose of developing community work service programs, the Joint Institute for Social Assistance may enter into cooperation agreements with Municipal Corporations and other public institutions that have a presence in the cantons affected by the closure (veda), and thereby execute the initiatives proposed by them, without prejudice to those proposed by IMAS itself.

Likewise, the involved institutions may receive proposals from fishers' organizations with the community work service projects to be executed by their members during the established closure period (período de veda). " "Article 6º-The condition of fishers and their helpers affected by closure declarations (declaratorias de veda) who hold a valid Commercial Fishing License or Authorization as of the declaration date is hereby declared to be in a situation of circumstantial poverty, subject to the restrictions and conditions established through agreements issued by the Board of Directors of Incopesca, published in the Official Gazette La Gaceta, and whose per capita income is reduced to an amount equal to or less than the poverty line defined by the National Institute of Statistics and Censuses. " "Article 9º-IMAS shall proceed to assist these persons based on the duly reasoned resolution approved by the respective Regional Directorate, which determines compliance with the requirements established in this Decree, in accordance with the list sent to IMAS by Incopesca." "Article 10.-The temporary assistance will be processed by the IMAS Regional Areas of Social Development. IMAS officials must verify in the National System of Information and Unified Registry of State Beneficiaries (SINIRUBE) that the potential beneficiaries do not have other income different from fishing, coming from salaries, remunerated activities, rent, or other sources that exceed the poverty line defined by the NATIONAL INSTITUTE OF STATISTICS AND CENSUSES (INEC), in which case IMAS shall deny the granting of the benefit. IMAS shall send Incopesca the lists of accepted and denied cases, with the supporting information, after the end of the closures (vedas)." "Article 13. -In the event of detecting non-compliance with any of the requirements of this decree, the following procedure shall be followed:

a)Actions contrary to the closure declaration (declaratoria de veda): In the event that Incopesca detects that a licensed fisher or helpers are performing tasks that contravene the closure declaration, the following procedure shall be followed:

1. IMAS shall be notified so that it revokes the benefit in accordance with due process.

2. If it involves a fisher with a license or authorization, Incopesca shall deduct the equivalent amount of the authorized fuel at a competitive price to which said fisher is entitled, in accordance with the regulations established by INCOPESCA.

3. If it involves a helper, IMAS shall proceed to execute the collection actions to recover the money that had been disbursed.

b)Beneficiary outside the condition of poverty: In the event of detecting that the fisher or helper is not in a condition of poverty, action shall be taken in accordance with the following rules:

1. IMAS shall immediately suspend the benefit and follow due process to revoke the benefit.

2. If it involves a licensed fisher, the provisions of subsection a) sub-subsection 2) of this article shall apply.

3. If it involves a helper, the procedure shall be in accordance with subsection a) sub-subsection 3) of this article. "

Sole Temporary Provision: The execution of the closure subsidy (subsidio de veda) by the Joint Institute for Social Assistance for the year two thousand twenty-five, shall be carried out with the norms that were in force prior to the publication of this Executive Decree.

En ejercicio de las disposiciones y atribuciones establecidas en los artículos 50, 51, 140 incisos 3) y 18) y 146 de la Constitución Política; artículos 25, inciso 1 ), 27, inciso 1) y 28, párrafo 2), inciso b) de la Ley General de la Administración Pública, Ley Nº. 6227, de 2 de mayo de 1978; el a1tículo 36 de la Ley de Pesca y Acuicultura, Ley Nº. 8436, de 1 de marzo de 2005; y la Ley de Creación del Instituto Costarricense de Pesca y Acuicultura (INCOPESCA), Ley Nº. 7384, de 16 de marzo de 1994.

I.Que de conformidad con el artículo 50 de la Constitución Política el Estado debe orientar sus actuaciones a procurar el mayor bienestar de la población del país, por lo cual resulta pertinente dotar de mayor coherencia los servicios públicos y prestaciones con Los que cuenta el sector social para atender las necesidades de la población.

II.Que la norma constitucional de anterior cita señala que toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado.

III.Que el período de veda provoca una situación de pobreza coyuntural en los pescadores por la carencia de ingresos por este concepto, la cual, persigue un fin e interés público dirigido a la protección, conservación y sostenibilidad de los recursos hidrológicos, por lo cual resulta necesario asegurar el cumplimiento efectivo de la misma, mediante la definición de una ayuda temporal a dichos pescadores que cubra en forma adecuada sus necesidades básicas, nutricionales, de salud y vivienda.

IV.Que el artículo 5 inciso i) de la Ley Nº. 7384, Ley de Creación del Incopesca y el ordinal 34 de la Ley Nº 8436, Ley de Pesca y Acuicultura, señalan como atribución y competencia del Incopesca establecer conforme a criterios técnicos, científicos, económicos y sociales, las zonas o épocas de veda, sea por áreas o por especies determinadas, a fin de proteger y aprovechar los recursos hidrobiológicos de manera sostenible.

V.Que en el artículo 36 de la Ley 8436, Ley de Pesca y Acuicultura, se expresa: " ... El Poder Ejecutivo podrá autorizar el destino de fondos del Presupuesto Nacional a favor de lncopesca para la realización de los estudios sobre vedas, y a favor del Instituto Mixto de Ayuda Social (]MAS), con el propósito de desarrollar programas de asistencia socioeconómica diseñados especialmente con tal propósito, a favor de los pescadores que se vean afectados en los períodos de veda, siempre que se compruebe que no tienen otras fuentes de ingresos y se encuentran en condición de pobreza. Estos programas implicarán necesariamente servicios de trabajo comunal por parte de los beneficiarios, conforme al reglamento correspondiente o para la realización de estudios sobre la materia"

VI.Que en cumplimiento del artículo 361 de la Ley General de la Administración Pública, se procedió a brindar audiencia al Instituto Costarricense de Pesca y Acuicultura, el cual mediante oficio INCOPESCA-1431-2024 indicó no tener observaciones sobre el proyecto de Decreto Ejecutivo, en virtud de ser este coherente con la Ley de Pesca y Acuicultura y las competencias asignadas por ley a las instituciones intervinientes en este proceso.

VII.Que el presente decreto no crea requisitos, por lo que de conformidad con los párrafos segundo y tercero del artículo 12 bis del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº 37045-MP-MEIC del 22 de febrero de 2012, no se requiere el llenado del formulario costo beneficio.

REFORMA PARCIAL Y DEROGATORIA DE LOS ARTÍCULOS 5 Y 12 DEL DECRETO EJECUTIVO Nº. 36043-MAG-SP-MS, REGULACIONES PERMANENTES PARA LA IMPLEMENTACIÓN DE UNA AYUDA TEMPORAL POR POBREZA COYUNTURAL EN EL SECTOR PESQUERO COSTARRICENSE POR DECLARATORIAS DE VEDAS, DE 13 DE MAYO DE 2010

CONSIDERANDO

Decretan:

36043-MAG-SP-MS, Regulaciones permanentes para la implementación de una ayuda temporal por pobreza coyuntural en el sector pesquero costarricense por declaratorias de vedas, de 13 de mayo de 2010, para que se lean de la siguiente manera:

"Artículo 2°-Definida una zona y época de veda, durante la cual se fijen las condiciones, límites, restricciones o prohibición de realizar las acciones de la actividad pesquera y se materialice el reconocimiento por parte del IMAS de alguna ayuda temporal para los pescadores y ayudantes, se entenderá el pleno acogimiento de estos a las regulaciones de este Decreto. " "Artículo 3 º-El Incopesca deberá acreditar ante el IMAS a las personas pescadoras afectados por la veda y a sus ayudantes cuando corresponda y en el tanto se determine que el ingreso per cápita se vea reducido a un monto igual o inferior a la línea de pobreza definida por el Instituto Nacional de Estadística y Censos, el IMAS les otorgará una ayuda económica temporal por razones de desempleo y pobreza coyuntural, cuyo monto mensual máximo podrá ser equivalente al 40% del salario mínimo legal vigente de un trabajador no calificado, acorde con la situación real de dicho Sector y en apego a los requisitos y condiciones que se establezcan para estos efectos.

[ . .}" "Artículo 4°-Para recibir la ayuda económica que sea otorgada por el IMAS, las personas pescadoras y ayudantes afectados, sea que realicen actividades de pesca o no, deberán someterse a un Programa de Servicio de Trabajo Comunal, el cual consistirá en la participación de las personas beneficiarias en: programas, proyectos y actividades que favorezcan el desarrollo personal y social de la persona y contribuyan a la solución de problemas Institucionales y Comunales, siempre bajo la protección de una póliza de seguro a cargo de la administración contra accidentes como condición indispensable para efectuar el trabajo comunal.

Con el propósito de desarrollar programas de servicio de trabajo comunal, el Instituto Mixto de Ayuda Social podrá suscribir convenios de cooperación con las Corporaciones Municipales y otras instituciones públicas que tengan presencia en los cantones afectados por la veda, y con ello ejecutar las iniciativas que se propongan por parte de ellas, sin perjuicio de las propias que proponga el IMAS.

Asimismo, las instituciones involucradas podrán recibir propuestas de las organizaciones de pescadores con los proyectos de servicio de trabajo comunal que serán ejecutados por sus asociados durante el período de veda que se establezca. " "Artículo 6º-Declárese en situación de pobreza coyuntural la condición de los pescadores y sus ayudantes afectados con las declaratorias de veda que tengan Licencia o Autorización de Pesca Comercial vigente a la fecha de la declaratoria, sujetos a las restricciones y condiciones establecidas mediante acuerdos emitidos por la Junta Directiva del Incopesca, publicados en el Diario Oficial La Gaceta y cuyo ingreso per cápita se vea reducido a un monto igual o inferior a la línea de pobreza definida por el Instituto Nacional de Estadística y Censos. " "Artículo 9 °-El IMAS, procederá a la atención de estas personas con base en la resolución debidamente fundamentada y aprobada por la Jefatura Regional respectiva, que determine el cumplimiento de los requisitos establecidos en este Decreto, de conformidad con el listado remitido al IMAS por el Incopesca" "Artículo 10.-Las ayudas temporales serán tramitadas por las Áreas Regionales de Desarrollo Social del IMAS. Las personas funcionarias del IMAS deberán verificar en el Sistema Nacional de Información y Registro Único de Beneficiarios del Estado (SJNIRUBE) que los potenciales beneficiarios no cuentan con otros ingresos diferentes a la pesca, provenientes de salarios, actividades remuneradas, renta u otros que superen la línea de pobreza definida por el INSTITUTO NACIONAL DE ESTADISTICA Y CENSOS (INEC), en cuyo caso el IMAS denegará el otorgamiento del beneficio. El IMAS remitirá al lncopesca los listados de los casos aceptados y de los denegados, con la información soporte, posteriormente a la finalización de las vedas." "Artículo 13. -En caso de detectarse el incumplimiento de alguno de los requisitos de este decreto, deberá procederse de la siguiente manera:

a)Acciones contrarias a la declaratoria de veda: En caso de que Incopesca detecte que un pescador con licencia o ayudantes se encuentre ejecutando labores que contravengan la declaratoria de veda, se procederá de la siguiente manera:

1. Se le comunicará al ]MAS para que este revoque el beneficio según el debido proceso.

2. Si se tratara de un pescador con licencia o autorización, lncopesca descontará el monto equivalente del combustible autorizado a precio competitivo a que tenga derecho dicho pescador, de conformidad con la reglamentación establecida por INCOP ESCA.

3. Si se tratara de un ayudante, el IMAS procederá a ejecutar las acciones de cobro para recuperar el dinero que se hubiese girado.

b)Persona beneficiaria fuera de condición de pobreza: En caso de detectarse que el pescador o ayudante no se encuentra en condición de pobreza, se actuará de acuerdo con las siguientes reglas:

1. El IMAS suspenderá inmediatamente el beneficio y seguirá el debido proceso para revocar el beneficio 2. Si se tratara de un pescador con licencia se aplicará lo dispuesto en el inciso a) subinciso 2) de este artículo.

3. Si se tratara de un ayudante se procederá conforme con el inciso a) sub inciso 3) de este artículo. "

Transitorio Único: La ejecución del subsidio de veda por parte del Instituto Mixto de Ayuda Social del año dos mil veinticinco, se realizará con las normas que se encontraban vigentes de previo a la publicación del presente Decreto Ejecutivo.

Artículo 1 — Articles 2, 3 first paragraph, 4, 6, 9, 10 and 13 of Executive Decree Nº.

Artículo 3 — This Decree enters into force upon its publication in the Official Gazette La Gaceta.

Artículo 1 — Refórmense los artículos 2, 3 párrafo primero, 4, 6, 9, 10 y 13 del Decreto Ejecutivo Nº.

Artículo 2 — Deróguense los artículos 5 y 12 del Decreto Ejecutivo Nº.

Artículo 3 — Rige a partir de su publicación en el Diario Oficial La Gaceta.
