The applications submitted to administer a municipal real estate intended for public use shall be referred by the Municipal Council to the Social Affairs Commission, a body that will review and analyze the work plan, verify the requirements, and ensure compliance with the block of legality (bloque de legalidad), as well as the absence of impediments.
The Social Affairs Commission shall issue an opinion, within a maximum period of one month, as established by Article 72 of the Internal Regulations of Order and Direction of the Municipal Council, in which it recommends to the Municipal Council one of the applicant organizations. The selection process shall take into consideration that the social organizations are up to date in the payment of their obligations for public services, such as water, electricity, and telecommunications, among others.
Said opinion must indicate the assessments of attention to the general interest that mediated to support the recommendation, the criterion regarding the proposed use submitted, and make respective agreement must be established, which may not exceed three years.
Likewise, it shall contain the recommendation for authorization to the Mayor's Office for the respective signing of the agreement with the interested organization.
For the selection process described in this article, organizations affiliated with the site of the real estate shall have priority, and in the event that no application exists from these, comprehensive development associations shall have priority in administration.
