throughout the entire text - Full Text of Norm 45030 Renders Without Effect the Declaration of Public Utility for the interests of the State of the Administrative Association for the Aqueduct and Sanitary Sewer of Matapalo No. 45030-MJP THE PRESIDENT OF THE REPUBLIC THE MINISTER OF JUSTICE AND PEACE Pursuant to the provisions of Articles 11, 140, subsection 18) and 146 of the Political Constitution, in Articles 25 subsection 1), 27 subsection 1), and 28 subsection 2) paragraph b) of the General Public Administration Law No. 6627 of May 2, 1978, in Article 32 of the Associations Law No. 218 of August 8, 1939 and Articles 27 and following of the Regulations to the Associations Law No. 29496-J, published in La Gaceta No. 96 of May 21, 2001.
I.- That Article 32 of the Associations Law No. 218 of August 8, 1939 and its amendments, grants the Executive Branch the power to declare of public utility simple, federated, or confederated associations, whose development and activities are particularly useful for the interests of the State, and that therefore contribute to solving a social need.
II.- That the Administrative Association for the Aqueduct and Sanitary Sewer of Matapalo Savegre District Quepos Canton Puntarenas Province, legal identification number three-zero zero two- three hundred fifty-seven thousand five hundred ninety-seven, was registered in the Associations Registry of the Public Registry on the thirteenth day of January of two thousand six, file 15891, volume 524 and entry 32.
III.- That Article 32 of the Associations Law establishes: " ... At any time, the Ministry of Justice and Peace, will revoke this benefit, if the reasons for which it was granted disappear. (. . .)". Likewise, ordinal 33 bis of the Regulations to the Associations Law, adds: "The declaration of public utility will be revocable at any moment, notwithstanding, in the event of non-representation or incomplete presentation of the work report, the association will be warned, a single time, for a period of ten business days. Likewise, the repeal of public utility will be carried out by means of a reasoned resolution resulting from the procedure for the repeal of the public utility benefit which, will be governed by the provisions of the General Public Administration Law (. . .)".
IV.- That the Administrative Association for the Aqueduct and Sanitary Sewer of Matapalo Savegre District Quepos Canton Puntarenas Province, was declared of public utility by the Ministry of Justice and Peace by means of Executive Decree No. 36773-JP, dated August fourth, two thousand eleven, published in the Official Gazette La Gaceta number 185, dated September twenty-seventh, two thousand eleven.
V.- That the Administrative Association for the Aqueduct and Sanitary Sewer of Matapalo Savegre District Quepos Canton Puntarenas Province, legal identification number three-zero zero two- three hundred fifty-seven thousand five hundred ninety-seven, through its legal representative Mr. Alexander Chinchilla Madrigal, identity card number one·-thousand two hundred ninety-one-zero three hundred thirty-two, failed to comply with the presentation of the annual work report corresponding to the year 2023 and without any elements of value being presented to justify said non-compliance.

en la totalidad del texto - Texto Completo Norma 45030 Deja sin efecto Declara de Utilidad Pública para los intereses del Estado la Asociación Administradora del Acueducto y Alcantarillado Sanitario de Matapalo Nº 45030-MJP EL PRESIDENTE DE LA REPÚBLICA El MINISTRO DE JUSTICIA Y PAZ Con fundamento en lo dispuesto en los artículos 11, 140, inciso 18) y 146 de la Constitución Política, en los artículos 25 inciso 1), 27 inciso 1), y 28 inciso 2) acápite b) de la Ley General de Administración Pública Nº 6627 del 02 de mayo de 1978, en el artículo 32 de la Ley de Asociaciones Nº 218 del 8 de agosto de 1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones Nº 29496-J, publicado en La Gaceta Nº 96 del 21 de mayo del 2001.
I.- Que el artículo 32 de la Ley de Asociaciones Nº 218 del 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
Il.- Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario de Matapalo Distrito Savegre Cantón Quepos Provincia Puntarenas, cédula jurídica número tres-cero cero dos- trescientos cincuenta y siete mil quinientos noventa y siete, se inscribió en el Registro de Asociaciones del Registro Público el día trece de enero del dos mil seis, expediente 15891, tomo 524 y asiento 32.
III.- Que el artículo 32 de la Ley de Asociaciones establece: " ... En cualquier momento, el Ministerio de Justicia y Paz, revocará este beneficio, si desaparecen los motivos por los cuales fue concedido. (. . .)" . Asimismo, el ordinal 33 bis del Reglamento a la Ley de Asociaciones, agrega: "La declaratoria de utilidad pública será revocable en cualquier momento, no obstante, en caso de la no representación o presentación incompleta del informe de labores, se prevendrá a la asociación, una única vez, por el pla;o de dieZ¡ días hábiles. Asimismo, la derogatoria de utilidad pública se realizará mediante resolución razonada resultante del procedimiento de derogatoria del beneficio de utilidad pública el cual, se regirá por lo establecido en la Ley General de la Administración Pública (. . .) ".
IV.- Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario de Matapalo Distrito Savegre Quepos Provincia Puntarenas, fue declarada de utilidad pública por el Ministerio de Justicia y Paz mediante el Decreto Ejecutivo Nº 36773-JP, de fecha cuatro de agosto del dos mil once publicado en el Diario Oficial la Gaceta número 185, de fecha veintisiete de setiembre del dos mil once.
V.- Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario de Matapalo Distrito Savegre Cantón Quepos Provincia Puntarenas, cédula jurídica número tres-cero cero dos- trescientos cincuenta y siete mil quinientos noventa y siete, por medio de su representante legal el señor Alexander Chinchilla Madrigal, cédula de identidad número uno·-mil doscientos noventa y uno-cero trescientos treinta y dos, incumplió con la presentación del informe anual de labores correspondientes al año 2023 y sin que se presentaran elementos de valor que justificar dichos incumplimientos.
