in the entirety of the text - Complete Text of Regulation 45028 Renders void the Declaration of public utility for the interests of the State of the Administrative Association of the Aqueduct and Sanitary Sewerage of the District of Puente de Piedra de Grecia de Alajuela Nº 45028-MJP THE PRESIDENT OF THE REPUBLIC The MINISTER OF JUSTICE AND PEACE Based on the provisions of Articles 11, 140, subsection 18) and 146 of the Political Constitution, Articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) paragraph b) of the General Law of Public Administration Nº 6227 of May 2, 1978, Article 32 of the Law of Associations Nº 218 of August 8, 1939 and Articles 27 and following of the Regulation to the Law of Associations Nº 29496-J, published in La Gaceta Nº 96 of May 21, 2001.

I.- That Article 32 of the Law of Associations N°218 of August 8, 1939 and its amendments, grants the Executive Branch the power to declare of public utility simple, federated or confederated associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to solving a social need.

II.- That the Administrative Association of the Aqueduct and Sanitary Sewerage of Puente de Piedra de Grecia de Alajuela, legal identification number three-zero zero two-two hundred four thousand forty-three, was registered in the Associations Registry of the National Public Registry on the fifteenth day of May, one thousand nine hundred ninety-seven.

III.- That Article 32 of the Law of Associations establishes: " ... At any time, the Ministry of Justice and Peace, shall revoke this benefit, if the reasons for which it was granted disappear. (. . .)" . Likewise, ordinal 33 bis of the Regulation to the Law of Associations, adds: "The declaration of public utility shall be revocable at any time, however, in the event of the non-submission or incomplete submission of the work report, the association shall be given notice, one single time, for a period of ten business days. Likewise, the repeal of the public utility shall be carried out by means of a reasoned resolution resulting from the procedure for the repeal of the public utility benefit which shall be governed by the provisions of the General Law of Public Administration (. .. ) ". Finally, numeral 33 ter of the Regulation to the Law of Associations, indicates: "In the event that any association renounces the declaration of public utility, it must submit the corresponding documentation before the Legal Advisory Office of the Ministry of Justice and Peace which, without further procedure, shall proceed with the repeal. " IV.-That the Administrative Association of the Aqueduct and Sanitary Sewerage of the District of Puente de Piedra de Grecia de Alajuela, legal identification number three-zero zero two-two hundred four thousand forty-three, was declared of public utility by the Ministry of Justice and Peace through Executive Decree Nº42380-MPJ dated March sixth, two thousand twenty.

V.- That the Administrative Association of the Aqueduct and Sanitary Sewerage of the District of Puente de Piedra de Grecia de Alajuela, legal identification number three-zero zero two-two hundred four thousand forty-three, through a document submitted by its legal representative, Mr. Jehiner Alfaro Retana on February twentieth, two thousand twenty-five, expressed its desire to formally renounce the benefit of the declaration of public utility

THEY DECREE REPEAL OF THE DECLARATION OF PUBLIC UTILITY OF THE ADMINISTRATIVE ASSOCIATION OF THE AQUEDUCT AND SANITARY SEWERAGE OF THE DISTRICT OF PUENTE DE PIEDRA DE GRECIA DE ALAJUELA

CONSIDERING

Therefore,

en la totalidad del texto - Texto Completo Norma 45028 Deja sin efecto Declaratoria de utilidad pública para los intereses del Estado la Asociación Administradora del Acueducto y Alcantarillado Sanitario del Distrito de Puente de Piedra de Grecia de Alajuela Nº 45028-MJP EL PRESIDENTE DE LA REPÚBLICA El MINISTRO DE JUSTICIA Y PAZ Con fundamento en lo dispuesto en los artículos 11, 140, inciso 18) y 146 de la Constitución Política, en los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de Administración Pública Nº 6227 del 02 de mayo de 1978, en el artículo 32 de la Ley de Asociaciones Nº 218 del 8 de agosto de 1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones Nº 29496-J, publicado en La Gaceta Nº 96 del 21 de mayo del 2001.

I.- Que el artículo 32 de la Ley de Asociaciones N°218 del 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.

II.- Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario de Puente de Piedra de Grecia de Alajuela, cédula jurídica número tres- cero cero dos-doscientos cuatro mil cuarenta y tres, se inscribió en el Registro de Asociaciones del Registro Público Nacional el día quince de mayo de mil novecientos noventa y siete.

III.- Que el artículo 32 de la Ley de Asociaciones establece: " ... En cualquier momento, el Ministerio de Justicia y Paz, revocará este beneficio, si desaparecen los motivos por los cuales fue concedido. (. . .)" . Asimismo, el ordinal 33 bis del Reglamento a la Ley de Asociaciones, agrega: "La declaratoria de utilidad pública será revocable en cualquier momento, no obstante, en caso de la no presentación o presentación incompleta del informe de labores, se prevendrá a la asociación, una única vez, por el plazo de diez días hábiles. Asimismo, la derogatoria de la utilidad pública se realizará mediante resolución razonada resultante del procedimiento de derogatoria del beneficio de utilidad pública el cual, se regirá por lo establecido en la Ley General de Administración Pública (. .. ) ". Finalmente, el numeral 33 ter del Reglamento a la Ley de Asociaciones, indica: "En caso de que·. Alguna asociación renuncie a la declaratoria de utilidad pública, deberá presentar la documentación correspondiente ante la Asesoría Jurídica del Ministerio de Justicia y Paz quien, sin más trámite, procederá a realizar la derogatoria. " IV.-Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario del Distrito de Puente de Piedra de Grecia de Alajuela, cédula jurídica número tres- cero cero dosdoscientos cuatro mil cuarenta y tres, fue declarada de utilidad pública por el Ministerio de Justicia y Paz mediante Decreto Ejecutivo Nº42380-MPJ de fecha seis de marzo del dos mil veinte.

V.- Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario del Distrito de Puente de Piedra de Grecia de Alajuela, cédula jurídica número tres- cero cero dosdoscientos cuatro mil cuarenta y tres, mediante documento presentado por su representante legal, señor Jehiner Alfaro Retana del veinte de febrero del dos mil veinticinco, manifestó su deseo de renunciar formalmente al beneficio de la declaratoria de utilidad pública

DEROGAR LA DECLARATORIA DE UTILI DAD PÚBLICA DE LA ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DEL DISTRITO DE PUENTE DE PIEDRA DE GRECIA DE ALAJUELA

CONSIDERANDO

Por tanto,
