Reform of water tariff structure for large consumersReforma a estructura tarifaria de acueducto para grandes consumidores

For its part, Law N°7593, in article 5 subsection c), granted the Autoridad Reguladora sufficient powers to exercise the regulation of the public services provided in the country, including the service of "Supply of aqueduct and sewerage service, including potable water, collection, treatment and evacuation of blackwater, residual water and stormwater, as well as the installation, operation and maintenance of the hydrant service".

Likewise, article 25 of Law 7593 prescribes that the Aresep must issue and publish the technical regulations, which specify the conditions of quality, quantity, reliability, continuity, timeliness, and optimal provision, with which public services must be provided, according to the specific standards existing in the country or abroad for each case.

For its part, article 6 subsection d) of Law N°7593 establishes as an obligation of the Autoridad Reguladora "to set tariffs and prices in accordance with technical studies," in relation to the provisions of numerals 3.b), 6.a) and f), 20, 31 to 37 of the same legal body, through which the parameters, criteria, and central elements for setting tariffs are established according to the principle of service at cost, an obligation reiterated via regulation, in article 4, subsection a) point 2) of the Reglamento to the Ley Reguladora de los Servicios Públicos, Decreto Ejecutivo N°29732-MP, which establishes among the functions of the Aresep:

"(.) 2. Set the prices, tariffs, and fees of the public services regulated by law, observing the principle of service at cost, as established in article 31 of the law and subject to the criteria of social equity, environmental sustainability, energy conservation, and economic efficiency, defined in the Plan Nacional de Desarrollo, as well as in pursuit of the financial equilibrium of the company or entity providing the service (.)." In exercise of these powers, the Autoridad Reguladora de los Servicios Públicos, through the Intendencia de Agua, defined in resolution RE-0028-IA-2024, the tariff structure that should be applied for the regulated services, in accordance with the provisions of resolution RE-077-JD-2023, specifically in its section 7 "General Model" which establishes:

"(.) The results of the application of the foregoing concepts will allow the calculation of a total average price or tariff, which is the fundamental basis for the calculation of the tariff structure that the Intendencia de Agua will subsequently define. (.)." In that sense, the general model of the tariff methodology of the public services regulated by the Intendencia de Agua grants the Intendencia the power to define the corresponding tariff structure as well as to modify it when necessary, as a consequence of the express assignment of the original competence, all in accordance with the provisions of resolution RE-0077-JD-2023, issued at 11:56 a.m. on May 11, 2023, and published in Alcance N°101 to La Gaceta N°99 of June 1, 2023, the "TARIFF METHODOLOGY FOR AQUEDUCT, SEWERAGE, AND HYDRANT SERVICES (MTAAH)" was issued, approved by the Junta Directiva of the Autoridad Reguladora de los Servicios Públicos, as can be seen on folios 71, 127, and 130 of the resolution.

In this regard, on page 71 of the mentioned resolution, it is indicated regarding the structure that:

"The results of the application of the previous concepts will allow the calculation of a total average price or tariff, which is the fundamental basis for the calculation of the tariff structure that the Intendencia de Agua will subsequently define." Likewise, in section 7.5., visible on page 127 of the resolution in question, the following is indicated regarding the percentage of adjustment in the tariffs:

"This percentage is distributed among the current tariffs, according to the tariff structure defined by the IA, to guarantee the obtainment of the necessary total revenues." (Emphasis supplied).

In the same sense, section 8.1., related to the determination of the percentage of adjustment in the tariffs for the procedure of extraordinary setting by canon adjustment, visible on folio 130 of the resolution, establishes, as relevant, that "this percentage is distributed among the current tariffs, according to the tariff structure defined by the IA, to guarantee the obtainment of the necessary total revenues." From the foregoing extracts, it is deduced that the current Methodology, approved by the Junta Directiva of the Autoridad Reguladora de los Servicios Públicos, following due process, submitting itself to the participation procedure of all interested parties, established the power (power-duty) of the Intendencia de Agua to establish and adjust, when appropriate, the tariff structure in the terms analyzed herein.

III. ON THE NEED TO ADJUST RESOLUTION RE-0028-IA-2024, OF NOVEMBER 15, 2024

TECHNICAL ANALYSIS In relation to the respective publication and application of the Technical Regulation "Provision of the Supply of Aqueduct, Sanitary Sewerage, and Hydrant Services (AR-RT-SUMAAH-2023)" RE-0013-JD-2023, where the following is defined:

(.)

Consumption unit: Each of the units intended for: dwelling, commerce, industry, or others, including condominiums, that has its own potable water, sanitary sewerage, and stormwater installations, which receive the services provided by the service provider.

(.)

The providers shall charge the tariffs and prices set by the Autoridad Reguladora for the provision of aqueduct, sanitary sewerage system, hydrant, special, and related services, and the tariff for water resource protection (when applicable), and any other determined by the Aresep.

For properties in which there is more than one consumption unit, but with a single meter, the charge for the services shall be made as follows:

a. Quantify the number of consumption units.

b. Each consumption unit must pay the fixed charge for the aqueduct service and the fixed charge for the sewerage service.

c. The variable charge for the aqueduct service, the sewerage service, the hydrant service, and the water resource protection tariff are paid a single time, according to consumption and the established tariffs.

d. The invoice that is issued must contain, separately and itemized, each of these charges and, in the applicable cases, the Impuesto del Valor Agregado (IVA).

e. The total amount of the invoice corresponds to the sum of all the previous amounts.

For properties where there is more than one consumption unit, but the service does not have metering, the charge for the services shall be made as follows:

a. Quantify the number of consumption units.

b. Each consumption unit must pay the fixed charge for the aqueduct service, the fixed charge for the sewerage service, the fixed water resource protection tariff (when applicable), the fixed tariff for the hydrant service, the fixed tariff for the aqueduct service, and the fixed tariff for the sewerage service.

c. The invoice that is issued must contain, separately and itemized, each of these charges.

d. The total amount of the invoice corresponds to the sum of all the previous amounts.

If there are consumption units with different use categories, the highest tariff established by the Aresep shall be charged, corresponding to the use categories observed among the consumption units existing on the property.

It is the responsibility of the subscriber to manage the separation of services so that each consumption unit pays the invoice for the services in accordance with the corresponding tariff.

In the event that the tariff structure varies, for the application of this article, the provider shall apply the corresponding tariff as approved by the Aresep.

(.).

It must be considered that the provisions of the articles detailed above imply the realization of a change in the way consumers of aqueduct and sewerage services located on properties that have more than one consumption unit, but only one meter, are billed.

As a result of the analysis of the effects generated on users, following the application of these articles, the Junta Directiva of the Autoridad Reguladora, through resolution RE-0078-JD-2024, ordered the "Partial and temporary suspension of the effects of articles 5 and 124 of resolution RE-0013-JD-2024, Technical Regulation 'Provision of the supply of Aqueduct, Sanitary Sewerage and Hydrant Services (AR-RT-SUMAAH-2023)'," a resolution published on July 17, 2024, in the official gazette La Gaceta N°131, Alcance N°127.

This resolution came to partially and temporarily suspend, for a period of 12 months, the definition of "Consumption Unit" established in article 5 of Regulation AR-RT-SUMAAH-2023, as well as the application of article 124 of the same Regulation, which explains how to charge the tariffs established by the Autoridad Reguladora for properties in which there is more than one consumption unit, but with a single meter.

In its place, the Junta Directiva indicated in resolution RE-0078-JD-2024, that what is applicable for these cases is that "each consumption unit (understood as each property within the same parent property) contributes to the subscriber's invoice the corresponding proportion, determined by dividing the total consumption registered on the meter by the number of residential units, in order to place the determined consumption within the current tariff structure and charge according to the respective block." In this sense, and in order to adequately apply the guideline issued by the Junta Directiva of the Autoridad Reguladora in the resolution in question, the current tariff structure was established, which has been defined by the Intendencia de Agua through resolution RE-0028-IA-2024 of November 15, 2024, "Tariff Structure of the Regulated Aqueduct Service in Costa Rica" (visible in expedient OT-157-2024).

From the definition of the tariff structure corresponding to the aqueduct and sanitary sewerage (sanitation) services established through resolution RE-0028-IA-2024, the tariff categories of Large Residential Consumers (GCR) and Large Residential Consumers of Social Welfare (GCRBS) were created, the definition of which is detailed below:

"Large Residential Consumers (GCR): applies to all residential subscribers of the aqueduct service (vertical, horizontal condominiums, apartments, small housing clusters, etc.) for whom the measurement of their consumption is carried out through a macro-meter by the service provider, in accordance with the Technical Regulation: 'Provision of the supply of aqueduct, sewerage, and hydrant services' that is in force.

The consumption blocks or consumption ranges for this category are:

. 0 to 519 m3 . 520 to 1315 m3 . More than 1316 m3 Large Residential Consumers of Social Welfare: applies only to those Large Residential Consumers of social welfare duly established as such by the Banco Hipotecario de la Vivienda (Banhvi) or by the State institution that holds that competence.

This category retains the consumption blocks or ranges defined in the large residential consumer tariff, since their behavior and volume of consumption is the same, therefore, they are:

. 0 to 519 m3 . 520 to 1315 m3 . More than 1316 m3 Application: this benefit, and in accordance with the social tariff (population in poverty), will only apply to those consumptions that fall within the first consumption block, which comprises between 0 m3 - 519 m3 per subscriber (condominium). The level of consumption registered above the maximum level (519 m3) must be paid by the benefited subscriber according to the tariffs in force at the time.

The subsidy for residential consumers of social welfare shall be up to 25%." As a consequence of the changes made in the technical regulation for service provision, as well as the definition of the tariff categories and consumption blocks carried out by the Intendencia de Agua, in the exercise corresponding to the billing of this type of user, the providers of the public services regulated by this Intendencia were able to identify the existence of a significant variation at the time of carrying out the respective billing, by virtue of the consumption patterns related to this type of user (GCR and GCRBS).

This situation was brought to the attention of the Autoridad Reguladora, as detailed below, in official letter OF-0245-DGAU-2025:

"(.)

The case of the Social Welfare Condominium La Hoja Dorada, which informed the Autoridad Reguladora that its bill tripled. This condominium registered a consumption of 2491m3 in January. This condominium has 155 houses, which means that, by dividing the registered consumption by the number of dwellings, it represents that each house consumed an average of 16m3, which is within the national average.

Upon analyzing its consumption in relation to the current tariff structure and schedule, we observe that 47.21% of this consumption falls within the highest range, at a cost per cubic meter of ₡1457 colones, as shown below:

Table No. 1 Potable Water Consumption Condominio Hoja Dorada Source: OF-0245-DGAU-2025 The same behavior occurs for the water resource protection and sanitary sewerage items, which is why the final costs to be paid in the billing by the subscribers increase considerably, and likewise for the condominiums that are not considered social welfare (.)." By virtue of this situation, ex officio and always with a view to satisfying the public purpose, in the materialization of the principles of universality, equality, and free access to public services, upon analyzing the example of the Condominio de la Hoja del Aire, which is extrapolated to other condominiums of identical nature and even to those that do not have the condition of being of social interest, an in-depth analysis was carried out regarding the information supplied for resolution RE-0028-IA-2024.

In this, it was identified that, although the proposed blocks are based on a progressive relationship, meaning by this that there is a directly proportional correlation between consumption and the tariff level, or what is the same, the higher the consumption, the higher the tariff.

It must be borne in mind that one of the main objectives of the modification to the tariff structure operated through resolution RE-0028-IA-2024 consisted of promoting changes in consumption patterns in such a way as to incentivize rational and efficient use of water resources.

It is important to point out, always within the regulatory exercise and purpose followed in the resolution in question, that, once the situation evidenced by a group of users was analyzed, subsequent to the implementation of the new structure in a tariff setting, it was determined, according to the consumption data provided by the providing companies, that the application of the structure in the approved form generates an unwanted incremental effect in the billing of a provider at the level of the pre-established blocks, given the structural characteristics of its subscribers and that are not found in the rest of the target population, thereby causing the tariff signal to deviate from the objective pursued by the tariff structure.

Due to the foregoing, and taking into consideration the specific characteristics presented by the users identified in the categories in question (affected by the incremental effect), it is necessary to couple said blocks so that they are more consistent and respond more accurately to the totality of the users involved, with the purpose of reducing the incremental effect originating from the conception of the current blocks, for both categories (GCR and GCRBS).

In fact, the following graph shows the distribution analyzed in resolution RE-0028-IA-2024, which is determined by the separation of the total consumptions contained in the database used, into the respective pre-established consumption blocks. It is important to consider that, according to the criterion used, around 50% of the total consumption falls within the last block, which generates a stronger tariff signal due to the progressivity with which the tariffs are proposed; this despite the fact that around 80% of the subscribers are located in the first two blocks, as shown below.

As a result of the foregoing, and given the differences in the consumption levels registered for these tariff categories separately by the Instituto Costarricense de Acueductos y Alcantarillados and the Empresa de Servicios Públicos de Heredia, given that ESPH has subscribers with consumption levels higher than those of AyA, even though the latter has more subscribers with records of large consumption. As it is, upon obtaining the measures of central tendency (statistics) required in the elaboration of consumption ranges, these yielded a downward trend, directly affecting all ESPH subscribers, who have higher consumption levels for the cited tariff categories, as pointed out by the social welfare Condominium La Hoja Dorada.

In light of the above, it was determined that there is a need to carry out a sensitization of the consumption blocks associated with these tariff categories, namely, "Large Residential Consumers" and "Large Residential Consumers of Social Welfare", so that the economic impact produced at the billing level for all users (of those two categories) responds to the particular conditions of the service these users receive.

What is sought through this adjustment is to guarantee the asset intangibility of the provider, seen as respect for the economic-financial equilibrium thereof, but also to ensure the real possibility of access to the service for the users of these two categories, which, even in the case of social welfare condominiums, have a special condition inherent in their nature; all of this in the exercise of the power (power-duty) that the Autoridad Reguladora has to harmonize the interests of users and providers (article 4 subsection a) of Law 7593), with a view to satisfying the public interest, materialized in this case, in the provision and enjoyment of a public service.

As a result of the sensitization of the consumption blocks of the aforementioned tariff categories, this Intendencia considers it opportune and convenient, in light of the new findings, to proceed with the adjustment of the blocks of the consumption categories (GCR) and (GCR-BS). For which purpose, both the arguments put forth by the users of this category and the information provided by the operators, used in the proposal of resolution RE-0028-IA-2024, are considered.

In this way, for the definition of the blocks, consumption patterns of the users of the aqueduct service regulated by this Intendencia are taken into account. As a starting point, for the case of residential users, the average monthly consumption varies according to the operator and is found in a range between 14 and 18 m3 for the year 2024; likewise, it must be kept in mind that there are also other factors that influence this range, such as the geographical and socioeconomic conditions of the region where the subscribers are located.

*For the case of the Asadas, the average of the sample used in the tariff study of resolution RE-0034-IA-2024 is taken. **Consumption and subscriber data are annual.

The following table shows the distribution of subscribers operated by the large regulated providers of the sector (AyA and ESPH S.A.), according to the corresponding blocks for the residential category. In this, it is observed that if the average consumption of residential subscribers (between 14 m3 and 18 m3) is placed according to the blocks established for the category, this would be registered in the first two consumption blocks; which concentrate approximately 93.1% of the total subscribers of the category.

If the arguments set forth above are considered, it is determined that, for the formation of the consumption blocks, it is appropriate to group the data according to the distribution shown in the previous table, with the first consumption block including the same relative proportion as the first two residential blocks (93.1%); this taking into account ensuring that the necessary consumption for basic subsistence activities is covered according to the real demand associated with average consumption.

For the definition of the first consumption block, it is considered convenient for the purposes already indicated to establish it at the figure of 2500 m3, incorporating within this around 70% of consumption and 92% of the total subscribers in the category. This is based on the maximum consumption reported by operators for 2023, for users classified as Large Residential Consumers and Large Residential Consumers of Social Welfare.

In this way, the first block of the category maintains a proportional relationship with respect to the sum of the first two residential blocks, in which the average consumption is located ("0-15" and "16-30"). Furthermore, incorporating up to 70% of consumption ensures that no distortion is generated, caused by the presence of subscribers who are in this category and whose consumption is lower than the average.

On the other hand, for the second block, 6000 m3 is proposed as the upper limit, as this allows grouping 6.5% of subscribers, maintaining a similar proportion with respect to the third block of the residential category as observed in table number 3. Regarding consumption, this block encompasses 17% of the category total.

Similarly, for the third block, consumption greater than 6001 m3 is included, which groups 1.5% of subscribers and 12% of the consumption of the category in question. All of which is evidenced in the graph below:

Graph No. 3 Distribution of consumption by block Category of Large Residential Consumers Source: Intendencia de Agua As a summary, the categories of large consumers and large consumers of social welfare are defined, which apply to the aqueduct and sewerage service provided by the Instituto Costarricense de Acueductos y Alcantarillados, the Empresa de Servicios Públicos de Heredia, and the Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales (Asadas), with the following detail:

✓ Large Consumers Rate (T-GC): Applies to all large consumers of the aqueduct service (vertical and horizontal condominiums, apartments, multi-unit dwellings for both residential and mixed use) whose consumption is measured via a master meter by the service provider, in accordance with the current Technical Regulation: "Prestación del suministro de los servicios de acueducto, alcantarillado e hidrantes." ✓ Consumption blocks: the consumption blocks or ranges for this category are:

. 0 to 2500 m3 . 2501 to 6000 m3 . More than 6001 m3 ✓ Rate for Large Residential Consumers of Social Welfare (TGCR-BS): This incorporates only those Large Residential Consumers of social welfare duly established as such by the Banco Hipotecario de la Vivienda (Banhvi) or by the State institution that holds that competence.

✓ Application: this benefit, and in accordance with the social rate (population in poverty), will only apply to those consumptions that are located within the first consumption block, which comprises between 1 m3 - 2500 m3 per subscriber (condominium). The level of consumption recorded above the maximum level (2501 m3) must be paid by the beneficiary subscriber according to the rates in effect at the time.

The subsidy for Large Consumers of social welfare will be up to 25% on the rate.

✓ Consumption blocks: the consumption blocks or ranges for this category are:

. 0 to 2500 m3 . 2501 to 6000 m3 . More than 6001 m3

IV. CONCLUSIONS

1. Adjust the descriptions of the proposed rate structure for the aqueduct and sewerage service provided by the Instituto Costarricense de Acueductos y Alcantarillados, the Empresa de Servicios Públicos de Heredia, and the Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales (Asadas) as follows:

✓ Large Consumers Rate (T-GC): Applies to all large consumers of the aqueduct service (vertical and horizontal condominiums, apartments, multi-unit dwellings for both residential and mixed use) whose consumption is measured via a master meter by the service provider, in accordance with the current Technical Regulation: "Prestación del suministro de los servicios de acueducto, alcantarillado e hidrantes." . Rate for Large Residential Consumers of Social Welfare (T-GC-BS): This incorporates only those Large Residential Consumers of social welfare duly established as such by the Banco Hipotecario de la Vivienda (Banhvi) or by the State institution that holds that competence.

. Application: this benefit, and in accordance with the social rate (population in poverty), will only apply to those consumptions that are located within the first consumption block, which comprises between 1 m3 - 2500 m3 per subscriber (condominium). . Define the consumption blocks associated with the rate categories detailed above as follows:

o 0 to 2500 m3 o 2501 to 6000 m3 o More than 6001 m3 2. In accordance with the arguments set forth above, the corresponding adjustments are made to the rate schedules of the services regulated by the IA, as detailed below:

II.That, in accordance with the provisions of Articles 102, subsection d) and 180 of the General Law of Public Administration (LGAP), the Water Superintendency has the authority to reform ex officio the administrative acts previously issued, when necessary to guarantee legality and good administration. In the present case, the adjustment to the tariff block structure is adopted in exercise of this authority, with the objective of correcting unforeseen effects in the application of resolutions RE-0028-IA-2024 of November 15, 2024, RE-0031-IA-2024 of November 15, 2024, RE-033-IA-2024 of December 3, 2024, RE-0034-IA-2024 of December 6, 2024, and RE-004-IA-2025 of February 5, 2025, guaranteeing a more equitable distribution of consumption and minimizing disproportionate impacts on the billing of affected users.

III.That the modification of tariff blocks responds to the need to correct distortions in the previously approved consumption segmentation, so that the tariff brackets reflect more accurately the real patterns of resource use. This fine-tuning of the tariff blocks seeks to guarantee the economic-financial equilibrium of the operator, while ensuring reasonable access conditions for users of the "Large Residential Consumers" (GCR) and "Large Residential Consumers for Social Housing" (GCRBS) categories. The decision is based on the technical analysis of the service operators and the concerns expressed by affected users.

IV.That, in application of the principle of proportionality and efficiency in the regulation of public services (in accordance with Articles 4, 8, 214, 225 and 269 of the LGAP), the restructuring of the tariff blocks does not imply an adjustment or modification of the previously set tariffs, but rather optimizes consumption segmentation in order to improve equity in the distribution of service costs.

V.That by virtue of what is indicated in the preceding findings and considerations, it is appropriate to modify resolution RE-0028-IA-2024, of November 15, 2024, as well as the acts and resolutions related thereto according to the detail contained in report IN-0034-IA-2025, as provided.

Based on the powers conferred in Law No. 7593 and its amendments, in the General Law of Public Administration No. 6227, in Executive Decree 29732-MP, which is the Regulation to Law No. 7593, in the Internal Regulation of Organization and Functions of the Regulatory Authority of Public Services and its Deconcentrated Bodies (RIOF), THE WATER SUPERINTENDENT RESOLVES

I.To partially modify resolutions RE-0028-IA-2024 of November 15, 2024, RE-0031-IA-2024 of November 15, 2024, RE-0033-IA-2024 of December 3, 2024, RE-0034-IA-2024 of December 6, 2024, and RE-004-IA-2025 of February 5, 2025, so as to adjust the tariff structure of the regulated aqueduct service in Costa Rica, as well as the definitions and current tariff schedules of the Costa Rican Institute of Aqueducts and Sewers (AyA), Empresa de Servicios Públicos de Heredia and Asadas in accordance with the following detail:

. Large Consumers Tariff (T-GC):

This is applicable for the aqueduct and sewerage service provided by the Costa Rican Institute of Aqueducts and Sewers, the Empresa de Servicios Públicos de Heredia and the Administrative Associations of Communal Aqueduct and Sewer Systems (Asadas) as follows:

It applies to all large consumers of the aqueduct service (vertical condominiums, horizontal condominiums, apartments, housing clusters for both residential and mixed use) whose consumption is measured via a master meter by the service operator, in accordance with the current Technical Regulation: "Provision of the supply of aqueduct, sewerage and hydrant services".

. Large Residential Consumers for Social Housing Tariff (TGC-BS):

It is only for those Large Residential Consumers for social housing duly established as such by the Mortgage Housing Bank (Banhvi) or by the State institution that has that competence.

Application: this benefit, in accordance with the social tariff (population in poverty), will only apply for those consumption amounts that fall within the first consumption block, which comprises between 0 m3 – 2500 m3 per subscriber (condominium). The level of consumption recorded above the maximum level (2501 m3) must be paid by the beneficiary subscriber according to the tariffs in effect at the time.

The subsidy for Large Residential Consumers for social housing will be up to 25%.

. To define the consumption blocks associated with the tariff categories detailed above as follows:

o 0 to 2500 m3 o 2501 to 6000 m3 o More than 6001 m3 3. In accordance with the arguments set forth above, the corresponding adjustments are made in the tariff schedules for services regulated by the IA, as detailed below:

II. Notify and publish this resolution

In compliance with the provisions of Article 245 in relation to Article 345 of the Ley General de la Administración Pública, it is hereby informed that the ordinary remedies of revocation and appeal, and the extraordinary remedy of review, are available against this resolution. The revocation remedy may be filed before the Intendente de Agua, who is responsible for resolving it; the appeal and review remedies may be filed before the Junta Directiva, which is responsible for resolving them.

In accordance with Article 346 of the Ley General de Administración Pública, the remedies of revocation and appeal must be filed within a period of three days counted from the business day following notification, and the extraordinary review remedy must be filed within the time limits set forth in Article 354 of said Law.
