throughout the entire text - Complete Text of Norm 44836 Setting of the Amount of the Fees (dietas) for Members of the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) No. 44836-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Exercising the powers granted by Articles 140, subsections 3), 8), 18), and 20), and 146) of the Political Constitution and Articles 25, 27.1, 28.2b of Law 6227 of May 2, 1978, the General Public Administration Act (Ley General de la Administración Pública), Law No. 7138 of November 16, 1989, Law No. 7384 of March 16, 1994, the Law Creating the Costa Rican Institute of Fisheries and Aquaculture (Ley de Creación del Instituto Costarricense de Pesca y Acuicultura), and Law No. 8436 of March 1, 2005, the Fisheries and Aquaculture Law (Ley de Pesca y Acuicultura).
1.-That Article 60 of Law No. 7138 of November 16, 1989, establishes the authority of the Executive Branch to remunerate the fees (dietas) of the members of the Boards of Directors of the Autonomous Institutions and other Boards of Directors appointed by the Executive Branch, in accordance with the inflation index determined by the Central Bank of Costa Rica.
2.-That the fees (dietas) for the members of the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture have not had the annual increases for the periods 2015, 2016, 2017, 2018, 2019, 2020, 2021, and 2022 applied.
3.-That, for the years 2019 and 2020, in accordance with Law No. 9635, the Law for Strengthening Public Finances (Ley de Fortalecimiento de las finanzas públicas), of December 3, 2018, its Transitory Provision XXXIV establishes that the amounts recognized as fees (dietas) to board members of public entities shall not increase for the next two years following the approval of said law; therefore, for all purposes regarding the inflation calculation for those years, it must be considered as a factor of 0 (zero).
4.-That according to the applicable regulatory provisions, in relation to the accumulated variation amounts corresponding to the inflation indices (consumer price index), as of December for the years 2015, 2016, 2017, 2018, 2021, and 2022; data extracted from the website of the Central Bank of Costa Rica, sourced from the National Institute of Statistics and Censuses (INEC); in accordance with the Report rendered by the Financial Administrative Directorate of the Costa Rican Institute of Fisheries and Aquaculture via official letter INCOPESCA-PE-DAFI-012-2024 and adhering to the principles of logic and convenience, it is necessary to adjust the fees (dietas) for the members of the Board of Directors of INCOPESCA, in an effort to compensate for the increase in the cost of living and inflation, therefore, they must be set at the sum of ¢58,840.00 (fifty-eight thousand eight hundred forty exact colones), a sum that includes the inflation for the cited periods 2015, 2016, 2017, 2018, 2021, and 2022.
5.-That by Board of Directors Agreement, AJDIP/060-2024, session 10-2024, they agreed; in accordance with the opinion submitted via official letter INCOPESCA-PE-DAFI-012-2024, signed by Mrs. Betty Valverde Cordero, Financial Administrative Director of INCOPESCA, as well as what was indicated by the Ministry of Agriculture and Livestock in official letter DM-MAG-816-2023, to determine the amount of ¢58,840.00 (fifty-eight thousand eight hundred forty colones) as the possible sum to be received as fees (dietas) by the directors.
6.-That the effective date of the increase to the fees (dietas) established in this Decree shall be from its publication onward, for which INCOPESCA has the necessary and approved budgetary resources to cover the payment thereof.
7.-That in accordance with the second and third paragraphs of Article 12 of the Regulation to the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures (Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos), Executive Decree No. 37045-MP-MEIC of February 22, 2012, this Decree does not create or modify procedures, requirements, or formalities, and therefore does not require the regulatory improvement process. en la totalidad del texto - Texto Completo Norma 44836 Fijación del monto de las dietas para miembros de la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura (INCOPESCA) N° 44836-MAG EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERÍA En uso de las facultades conferidas por los artículos 140, incisos 3), 8), 18) y 20) y 146) de la Constitución Política y los artículos 25, 27.1, 28.2b de la Ley 6227 del 2 de mayo de 1978, Ley General de la Administración Pública, la Ley Nº 7138 del 16 de noviembre de 1989, la Ley Nº 7384 del 16 de marzo de 1994, Ley de Creación del Instituto Costarricense de Pesca y Acuicultura y la Ley Nº 8436 del 1º de marzo del 2005, Ley de Pesca y Acuicultura.
1.-Que el artículo 60 de la Ley Nº 7138 de 16 de noviembre de 1989, establece la potestad del Poder Ejecutivo de remunerar las dietas de los miembros de las Juntas Directivas, de las Instituciones Autónomas y demás Junta Directivas nombradas por el Poder Ejecutivo, de conformidad con el índice de inflación que determine el Banco Central de Costa Rica.
2.-Que las dietas a los miembros de la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, no se les ha aplicado los aumentos anuales de los periodos 2015, 2016, 2017, 2018, 2019, 2020, 2021 y 2022.
3.-Que, para el caso de los años 2019 y 2020, de conformidad con la Ley N°. 9635, Ley de Fortalecimiento de las finanzas públicas, del 03 de diciembre de 2018, se establece en su Transitorio XXXIV que los montos que se reconocen por concepto de dieta a los miembros de juntas directivas de las entidades públicas no aumentarán durante los próximos dos años a partir de la aprobación de dicha ley, por lo que en razón de lo anterior para todos sus efectos en cuanto al cálculo de la inflación de esos años debe considerarse como un factor 0 (cero).
4.-Que según las disposiciones normativas aplicables, en relación con los montos de variación acumulada correspondiente a los índices de inflación, (índice de precios al consumidor), a diciembre de los años 2015, 2016, 2017, 2018, 2021 y 2022; datos que fueron extraídos de la página web del Banco Central de Costa Rica, derivados del Instituto Nacional de Estadísticas y Censos (INEC); en concordancia con el Informe rendido por la Dirección Administrativa Financiera del Instituto Costarricense de Pesca y Acuicultura mediante oficio INCOPESCA-PE-DAFI-012-2024 y en apego a los principios de lógica y conveniencia, se hace necesario ajustar las dietas a los miembros de la Junta Directiva del INCOPESCA, en aras de compensar el aumento en el costo de vida y la inflación, por lo que deberán de fijarse las mismas en la suma de ¢58.840,00 (cincuenta y ocho mil ochocientos cuarenta colones exactos), suma que incluye la inflación de los períodos 2015, 2016, 2017, 2018, 2021 y 2022 citados.
5.-Que mediante Acuerdo de Junta Directiva Junta Directiva, AJDIP/060-2024, sesión 10-2024 acordaron; de conformidad con el criterio remitido mediante oficio INCOPESCA-PE-DAFI-012-2024, suscrito por parte de la señora Betty Valverde Cordero, Directora Administrativa Financiera del INCOPESCA, así como, lo indicado por parte del Ministerio de Agricultura y Ganadería en el oficio DM-MAG-816-2023, determinar el monto de ¢58.840,00 (cincuenta y ocho mil ochocientos cuarenta colones), como la posible suma a ser percibida por concepto de dietas por parte de los señores directores.
6.-Que el rige del aumento a las dietas establecido en el presente Decreto, será a partir de su publicación, para lo cual el INCOPESCA cuenta con los recursos presupuestarios necesarios y aprobados, para atender el pago de las mismas.
7.-Que de conformidad con los párrafos segundo y tercero del artículo 12 del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero de 2012, el presente Decreto no crea ni modifica trámites, requisitos o procedimientos, por lo que no requiere del trámite de mejora regulatoria.
